Disend, Deputy Prosecuting Attorney DATE: December 1, 1982 RE: Petition requesting annexation to Whatcom County Cemetery District No. 3 CHIEF CIVIL DEPUTY Eugene R. Moses CIVIL DEPUTY Bruce L. Disend This is in response to your memo of November 18, 1982 requesting direction on how to proceed with the peti- tion requesting annexation to Whatcom County Cemetery District No. 3. RCW 68.18.010 sets forth the requirements for annexation to the Cemetery District. Those requirements may be summarized as follows: 1. Any territory contiguous to a cemetery district and not within the boundaries of a city or town or other cemetery district may be annexed to such cemetery district by petition of 150 of the qualified registered electors re- siding within the territory proposed to be annexed. The petition which has been filed states that the petitioners represent not less than 150 of the qualified electors. How- ever, I cannot determine from the petition whether the territory 1-1 Ii proposed for annexation is contiguous to the cemetery district. By carbon copy of this letter to the elections department, I would request that they make that determination. 2. The petition is filed with the Cemetery Commis- sioners of the Cemetery District. If the Commissioners agree with the proposal, then they file the petition with the County Auditor. The Auditor has 30 days from the date of filing the 1 petition to examine the signatures and certify the sufficiency or insufficiency of them. After the Auditor has certified the sufficiency of the petition, proceedings are held before the County Council in the same manner as the original proceed- ings to form the cemetery district. Formation of a cemetery Memo to William P. Roehl December 1, 1982 Page Two (2) district is governed by the provisions of RCW 68.16. The County Council holds a hearing on the petition not less than 20 nor more than 40 days from the date the petition is received from the County Auditor. RCW 68.16.030. Attached is a resolution setting the date for the hearing on the petition. 3. A copy of the petition, with the names of the petitioners omitted, together with a notice signed by the Clerk of the Council, stating the day, hour and place of the hearing must be published in three consecutive weekly issues of •the official newspaper of the County prior to the hearing date. A copy of the petition, with the names of the petitioners omitted, together with a. copy of the notice attached, must be posted for not less than 15 days before the date of hearing in each of three public places within the boundaries of the proposed district. RCW 68.16.040. 4. At the hearing, Council receives such evidence as it may deem material in favor of or opposed to the inclusion of any lands into the district. RCW 68.16.050. 5. If Council finds that the proposal will be conducive to the public welfare and convenience, a resolution is passed providing for the annexation. RCW 68.16.060. A resolution approving the annexation is attached. 6. An election is then held within the boundaries of the area proposed to be annexed to the cemetery district. The election is held in the same manner as provided by law for special elections in the County. RCW 68.16.070. A ballot title for purposes of this election is attached. I.f two-thirds of all of the votes cast in the election are in favor of annexa- tion, the Council, by resolution, declares the territory duly annexed to the cemetery district. A resolution declaring the annexation is attached. 7. The County Council has the obligation to deter- mine "on an equitable basis" the amount of obligation which the territory to be annexed to the district shall assume, if any, to place the taxpayers of the existing district on a fair and equitable relationship with the taxpayers of the territory to be annexed, since the latter are coming into an on -going rN Memo to William P. Roehl December 1, 1982 Page Three (3) district previously supported by the taxpayers of the exist- ing district. This obligation may be paid to the district in yearly installments which are fixed by the Council as long as they are within the limits outlined in RCW 68.16.230. That provision provides: "The Board of Cemetery Commissioners shall have no authority to contract indebtedness in any year in excess of the aggregate amount of the currently levied taxes, which annual tax levy for cemetery district purposes shall not exceed 11 1/4 cents per thousand dollars of assessed valuation." The amount of the obligation and the plan of payment determined by Council must be set out in general terms in the notice of election for annexation. Upon the entry of the order of the Council incorporating the contiguous territory within the existing district, the territory becomes subject to the indebtedness of the existing district. RCW 68.18.010. 8. In the event the petition is signed by 60% of the qualified registered electors residing within the territory proposed to be annexed, and should the Cemetery Commissioners agree with the petition, an election in the territory and a hearing on the petition can be dispensed with and the Coucnil may enter its order incorporating such territory without the need of further proceedings.
