NOTICE OF SPECIAL ELECTION ON THE QUESTION OF THE FORMATION OF WATER DISTRICT NO. 18, TO BE HELD WITHIN THE BOUNDARIES OF THE PROPOSED DISTRICT ON MAY 16, 1989. NOTICE IS HEREBY GIVEN to the qualified electors of the proposed Whatcom County Water District No. 18, that on Tuesday, May 16, 1989, a special formation election will be held for the purpose of establishing it as a Water District. The undersigned further represent to you: 1. The property proposed to be included in the Acme Water District is wholly situated in Whatcom County and the description thereof is attached hereto, marked "Exhibit All and is, by this reference incorporated herein as though fully set forth. 2. The object for the creation of •the Acme Water District is to acquire and operate the Acme Water Association water distribution system, to acquire and operate a water well now being drilled for our benefit pursuant to a grant from the Washington State Department of Community Development and to facilitate the improvement of said water distribution system. 3. The petition shall be filed in the Auditor's Office at least 30 days prior to the election (in this case, no later than 4:30 p.m. Friday, April 14). C. Three individuals have already been nominated for the three commissioner positions by petition as set forth above: Jim Baker for position 1; Gary Smith for position 2; and Sara Galbraith for position 3. Section 5. CALLING FOR A SPECIAL ELECTION THAT WILL DETERMINE WHETHER WATER DISTRICT 18 SHALL BE ESTABLISHED IN ACME WHEREAS, a petition has been received requesting the formation of a water district in a tract of land consisting of a portion of Townships 37 and 38 North, Range 5 East of W.M., Whatcom County; and WHEREAS, the County Auditor has certified that the petition is sufficient, and recommends that the proposed new water district be numbered Water District No. 18; and WHEREAS, a public hearing was duly advertised as required by RCW 57.04, and took place on April 6, 1989; and WHEREAS, as a result of the hearing the County Council has determined that a special election shall be ordered to take place; NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that a special election will take place on May 16, 1989, in order to determine if the citizens within the proposed boundaries of Water District 18 wish to form said district, and that the proposition will be placed on the ballot as stipulated in RCW 57.04.050, as follows: WATER DISTRICT 18, ACME ... A board meeting of the Whatcom County Challenged Ballot Canvassing Authority was called on May 19, 1989, in the office of the County Auditor. Shirley Forslof, Whatcom County Auditor, Tom Burton, County Legislative Authority and Robert A. Carmichael, County Deputy Prosecuting Attorney were present. The absentee ballots to be shown before the canvassing board were numbered one through three for identification. By unanimous decision of the board, it was decided that ballots numbered one and two (#1 ballot from Acme and #2 ballot from Blaine City) were deemed valid and counted. Ballot numbered three from Blaine City was deemed invalid and not counted. The board meeting on May 26, 1989, was for the offical sign- ing of the canvass of the Special Election held on May 16, 1989. State law (RCW 29.10.140) requires the county auditor to notify, by certified mail, any voter who's registration has been challenged. The notification must be mailed to the address at which the challenged voter is registered, to any address provided by the challenger as required by RCW 29.10.130, and to any other address that the auditor could reasonably expect the challenged voter might receive such notification. Included with the notification must be a request that the voter appear at a hearing to be held within ten days of the mailing of the request, at the place and time specified, in order to assist the auditor in determining the validity of the challenge. (see attached certificate) 5) Mr. Engholm was able to confirm five (5) names. None of the named individuals attempted to vote. 6) At approximately 4:00 PM an individual came to the Poll to vote but admitted he owned property in the proposed district but did not live there. He was told that he was not eligible to cast a ballot. 7) At approximately 5:00 PM an individual entered the poll with a voter card issued by our office with the correct precinct and address to place it within the district. This person was allowed to vote a Question Ballot. This ballot was sealed in the proper manner by the Election Board and transmitted to the Counting Center in the proper manner. The reason for the Question Ballot was that the voters' name did not appear in the Poll Book. 8) All ballots and equipment was handled properly at the Poll prior to transport to the Counting Center. * Attached are the Challenge Forms completed by George Engholm on the morning of the 16th of May.
