WHEREAS, a portion of Sunnyland Elementary School has been found to be uns afe for student occupancy and it is deemed necessary an d advisable that such portion be replaced and that ot her capital improvements be made at said site; and WHEREAS, in order to provide funds to pay part of the cost of acquiring, constr ucting, equipping and making said improvements it is deemed necessary and advisable that the district iss ue and sell its general obliga tion bonds in the aggregate principal amount of $650,000 or so much thereof as may be issu ed under the laws of the State of Washington governing the limitation of indebtedness of school district; an d WHEREAS, the question of whether or not the district may iss ue and sell said bonds for such purposes must be submitted to the qualified electors of the district for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Bellingham School District No. 401, Whatcom County, Washington, as follows: Sect ion 1. It is hereby found and declared that the welfare of the students and other inhabitants of the district requir es the district to carry out the plans hereina fter provided at the time or times and in the order deemed most necessary and advisable by the Board of Directors of the district. Section 2. The district shall construct and equip an additio n and make capital improvements to Sunnyland Elementary School including special educational facilities and, if funds are available, shall acquire, construct, equip and make such other capital improvements to the facilities of the district as are found necessary by the Board of Directors. Section 3. For the purpose of providing funds necessary to pay part of the cost of the improvements described in Section 2 abo ve, the district sh all issue and sell its general obliga tion bo nds in the aggregate principal amount of $650,000 or so much thereo f as may be issued and sol d under the laws of the State of Washi ngton governing the limitation of indebtedness of school districts. The balance of the cost of said improvements shall be paid by moneys no w in or to be paid into the district's Building Fund, out of the moneys which the district may now or later have on hand and available for such purpose, and by po ssible State of Washin gton and United States grants of money. Said bonds shall be sol d in such amounts and at such tim e or times as deemed necessary and advisable by the Board of Directors and as permitted by law, shall bear interest at a rate of not to exceed the maximum rate permitted at the time said bonds are sol d, and shall mature serially in such amounts and at such time or times within fif teen years from date of is sue as authorized by the Board of Directors of the district -2- and as provided by law. Said bonds shall be general obligations of the district and, unless paid from other sources, both principal the reo f and interest thereo n shall be payable out of annual tax le vies to be made upon all the taxable property within the district without limitation as to rate or amount. The exact date, form, terms, and maturities of said bonds shall be as hereafter fixed by resol ution of the Board of Directors. In the event the proceeds of the sale of said bonds, pl us any or all of the other moneys above-d escribed , are insufficient to make all of the capital improveme nts hereinbef ore provided for, the district shall use the available funds for paying the cost of those improvements deemed most ne cessary and to the best interests of the district by the Board of Directors. Section 4. It is her eby found and declared that an emergency exists requiring the su bmission to the qualified el ectors of the district of the proposition of whet her or not the district sh all issue said general obligation bonds for their ratification or rejection at a special election to be held therein on February 8, 1976. The Whatcom County Auditor as ex officio supervisor of el ections is hereby requested to also find the ex istence of such emergency and to call and conduct said special el ection to be hel d within the school di strict on said date and to submit to the qualified el ectors of the district the proposition hereinafter set forth. BELLINGHAM SCHOOL DISTRICT NO. 501 WHATCOM COUNTY, WASHINGTON AT TEST: -4- RESOLUTION NO. 18-76 A RESOLUTION of the Board of Directors of Bellingham School District No. 501, Whatcom County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 8, 1977 of a proposition authorizing the levy of an excess tax of approximately $6.31 per $1000 of assessed value (100% of true and fair value unless specifically otherwise provided by law) to raise the sum of $4,258,664 for the district General Fund. WHEREAS, the money to be paid into the General Fund of the district will be insufficient during the fiscal year 1977-78 to enable the district to operate properly and to take care of all financial obligations, it is deemed necessary in order to prevent the impairment of the district's contracts that the district levy $6·31 a tax of $4,258,664 or approximately per $1000 of assessed value (100% of true and fair value unless specifically otherwise provided by law) upon all taxable property within the district in 1977 for collection in 1978 in excess of the annual tax limitation the district is permitted by law to levy without a vote of the people; and WHEREAS, the Constitution and laws of the State of Washington provide that the question of whether or not such excess tax may be levied for such purposes must be submitted to the qualified voters of the district for their approval or re- jection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Bellingham School District No. 501, Whatcom County, Washington, as follows: Section 1: It is hereby found and declared that the welfare of the children of the district requires it to carry out the plans hereinafter provided. Section 2: That for the purpose of providing part of the funds required to secure proper textbooks, instructional supplies and teaching materials, to make necessary repairs and replacements to school district facilities, to pay adequate salaries, to prevent the impairment of the obligation of the district's contracts and to properly carry on the functions of the schools within the district, the district authorizes the• County Commissioners of Whatcom County to levy a tax of approximately $6.31 per $1000 of assessed value (100% of true and fair value unless specifically otherwise provided by law) upon all taxable-property within the district in 1977 for collection in 1978 in excess of the annual tax levy permitted the district without a vote of the people for the purpose of providing $4 , 258 , 664 for the district General Fund. Section 3: It is hereby found and declared that an emergency exists requiring the submission to the qualified voters of the district of the proposition of whethe r or not there should be levied such excess tax for the purposes described herein at a special election to be held within the district on February 8, 1977. The Whatcom County Auditor as ex-officio supervisor of elections in Whatcom County is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the district on that date and to submit to the qualified voters of the district at said special election the proposition hereinafter set forth.
