SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE:
Per RCW 36.34.130 and Whatcom County Code 1.10.340, the Whatcom County Property
Management Committee has recommended to surplus and transfer Whatcom County real property, tax
parcel 380419 006520 0000, to the City of Bellingham for the appraised value of $15,000 and all
related closing costs

RESOLUTION NO. 2025-031
DECLARING WHATCOM COUNTY REAL PROPERTY AS SURPLUS AND APPROVING
TRANSFER
WHEREAS, RCW 36.34.005 authorizes counties to establish comprehensive procedures for the
management of county property, including the sale of surplus real estate where it is found to be in the
best interest of a county to sell same; and
WHEREAS, in Whatcoin County Code (WCC), Chapter 1.10, Whatcom County has established
those procedures; and
WHEREAS, Whatcom County owns a property located on Jenson Road and Agate Bay Lane; and
WHEREAS, there are limited records on this property but they indicate that the property has
been owned by Whatcom County since the early 1900's; and
WHEREAS, the property has no utility to Whatcom County; and
WHEREAS, the City of Bellingham has interest in ownership of the property to support an
acquisition of adjacent property that is located in the Lake Whatcom watershed and Whatcom County has
interest in transferring the property to the City of Bellingham to support their watershed acquisition; and
WHEREAS, an appraisal was completed and the property was valued at $15,000; and
WHEREAS, WCC 1.10.340 allows for a transfer of property to a governmental agency without a
public sale; and
WHEREAS, RCW 36.34.130 allows for transfer of property from a County to another
governmental agency by means of private negotiation upon such terms as may be agreed upon and for
consideration as may be deemed to be adequate; and
WHEREAS, the Whatcom County Property Management Committee, having met and
considered Whatcom County's best interest, recommends that the County Council declare Whatcom
County real property, tax parcel number 380419 006520 0000, to be surplus property and that the
property be transferred to the City of Bellingham upon payment of the appraisal value of $15,000 and all
related closing costs.
3 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to declare
4 Whatcom County real property, tax parcel number 380419 006520 0000, to be surplus and that the
5 property be transferred to the City of Bellingham in exchange for the payment of $15,000 and all related
6 closing costs.
