HISTORY OF LEGISLATIVE FILE Date: Acting Body: Action: Sent To: 09/23/2025 Council Planning and Development RECOMMENDED FOR Committee APPROVAL Aye: 3 Donovan, Elenbaas, and Scanlon Nay: 0 09/23/2025 Council APPROVED Aye: 6 Buchanan, Byrd, Elenbaas, Galloway, Scanlon, and Stremler Nay: 0 emp Absent: 1 Donovan Whatcom County Page t Printed on 9/24/2025 Agenda Bill Master Report Continued (AB2025-579) Attachments: Memo, Proposed Resolution, Map Whatcom County Page 2 Printed on 9/24/2025 Proposed by: Planning & Development Services Introduction date: September 23rd, 2025 RESOLUTION NO.2025-030 RESOLUTION APPROVING A REVISION TO THE CORPORATE BOUNDARIES OF THE CITY OF LYNDEN TO INCLUDE A PORTION OF FLYNN ROAD RIGHT-OF- WAY WHEREAS, the City of Lynden ("City") adopted Ordinance No. 24-1692 on October 7, 2024, annexing approximately 279 acres of the Southwest Urban Growth Area into the City; and WHEREAS, a portion of the Flynn Road Right -of -Way ("Flynn Road ROW"), as legally described in Exhibit A, was inadvertently omitted from the aforementioned annexation because it was believed to have been incorporated into the City by Ordinance No. 1561 in 2018; and WHEREAS, the Washington State Office of Financial Management and the Washington State Department of Transportation requested that the City amend its annexation ordinance to include the omitted Flynn Road ROW and clarify the corporate boundaries; and WHEREAS, RCW 35A.21.210 authorizes a code city and the county in which it is located to revise corporate boundaries to include or exclude a portion of a public street or road right-of- way, with such revision becoming effective upon approval by both the city (by ordinance) and the county (by ordinance or resolution); and WHEREAS, the City of Lynden has adopted Ordinance No. 25-1710 to revise its corporate boundaries to include the omitted portion of the Flynn Road ROW, thereby adjusting the City's corporate boundary as legally described in Exhibit B and depicted in Exhibit C attached hereto; and WHEREAS, Whatcom County desires to approve this revision consistent with RCW 35A.21.210. Page 1 NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council approves the revision of the corporate boundaries of the City of Lynden to include the portion of Flynn Road Right -of -Way previously omitted, consistent with the boundaries described in City of Lynden Ordinance No.25-1710.
