She asked if any of the five tied candidates from Precinct #102 was present. Henry Schwake, the only candidate from Precinct #102 that was present, drew a straw. Other candidates and observers that were present for the coin toss drew the remaining four straws to verify that Henry drew the longest straw. With verification completed, Shirley announced Henry Schwake the winner of Democratic Precinct Committee Officer for Precinct #102. Shirley asked for PCO candidates from Precinct #148. Jake Sager was the only candidate present. Shirley announced there would be a coin toss for Precinct #148 with only two candidates tied. HAND RECOUNT TIED PCO RACES PRIMARY ELECTION AUGUST 19, 2008 - MINUTES - Date: September 8, 2008 Meeting Began: 9:00 a.m. in Auditor's Election Center In Attendance: Debbie Adelstein, Chief Deputy Auditor Samantha Hamlin, Recount Board Meredith Charlton, Recount Board Jim Fox, Observer John Palmer, Observer David Hunter, Observer Sara Weir, Observer John Gooch, Observer Jeanne Quinvalan, Observer stopped by Elisabeth Britt, Observer stopped by At 8:20 a.m., Debbie Adelstein and members of the recount board retrieved two sealed boxes of ballots (seal #1185 and seal #1186) from the Auditor's vault that contained the write-in ballots for this election. They transported the boxes of ballots to the Auditor's election center. Recount board members signed the oath of office. At 9:10, the observers arrived in the center and Debbie unsealed ballot boxes #1185 and #1186. It was determined the recount of those precincts with observers present would take place first. The recount of the PCO races commenced for the following precincts: Precinct # 123 Precinct #235 Precinct #236 Precinct #102 Precinct #140 Precinct #226 Precinct #141 Precinct #148 Precinct #209 Precinct #219 The following changes in precinct results were noted: 1. Precinct #123 indicated one vote for John L. Palmer, one vote for George Reigel, and two votes for Ellen Barton. (In the original count of PCO ballots, the two votes for Ellen Barton was noted, however, the lookup indicated there was no Ellen Barton registered in that precinct.) The name Ellen Barton was looked up on the voter registration database and no Ellen Barton was indicated. After lunch, Observer Jim Fox pointed out there was in fact an Ellen Barton in that precinct so a further search of the database was made. There is an M. Ellen Barton listed but a search of Ellen Barton would not have indicated this. This precinct will be referred to the Canvassing Board for its determination. 2. Precinct #141 reflected two ballots writing in Jim Cozad, however one of those ballots did not designate a party; therefore, only one vote for Jim Cozad should be registered. This results in James Hardin as the winner of the Democratic PCO with 2 votes. Hand Recount — PCO Tied Races Primary Election August 19, 2008 The members of the recount board signed each of their count tally sheets and Debbie signed each as well (attached to these minutes). At 3:10 the recount was complete, the ballots resealed in the storage boxes (seal # 1129 and #1113), and the boxes of sealed ballots were transported to the Auditor's basement vault. Meeting adjourned at 3:10 p.m. At 4:00 p.m., the recount board re -assembled after a review of the count tally sheets to further inspect ballots from precinct #140. The hand recount did not reflect one of the candidates that previously had received a vote. It appeared that not all of the ballots from precinct #140 may have been retrieved during the initial sort. The storage boxes were retrieved from the vault, opened, and all the remaining ballots were inspected to see if there were any additional ballots from precinct #140 that had been missed. Two were discovered, with one containing a PCO write-in vote for Timothy McNitt. This vote was added to the recount tabulation report. The ballots were replaced in the boxes and resealed (seal #1257 and #1258). The boxes were returned to the Auditor's basement vault. This is also to confirm that Jim Fox and Jeanne Quinlivan will represent their party and will participate in the calling of either heads or tails and in the draw -by -lot for candidates that are not present or have not sent delegates. The Canvassing Board will meet at 2:30 p.m. today, Tuesday Sept 9 in the conference room in my office to determine a voter intent issue in precinct 123, and in precinct 141 Jim Cozad received two votes for PCO and on one of the write-in ballots, a political party was not listed. The requirement for write-in votes for non declared PCO candidates is that the write-in ballot must include the political party. Therefore, one vote will be subtracted from Jim Cozad's votes and James Hardin will be elected with two votes. The Canvassing Board will Certify the recount for PCO candidates.
