The City of Bellingham's Proposition No. 1 concerns a Greenways Levy for greenways, open
space, parks and trails.
For the purpose of funding the acquisition, development and maintenance of
greenways, open space, parks and trails, this proposition would authorize the City to
increase its regular property tax levy up to $2.49 per $1,000 (representing a
continuation of $0.57 per $1,000 of assessed value) for collection in 2007, and to levy
the additional amount for nine succeeding years together with annual increases thereon
as allowed under RW 84.55. Should this proposition be approved?

Shirley Forslof called the meeting to order at 2:15 p.m. The purpose of the special
Canvassing Board Meeting was to accept or reject ballots referred by the Election Staff. One
ballot was signed by the voter. The Board unanimously voted to reject this ballot.
The other ballots referred to the Board consisted of markings not previously seen in prior
elections. Shirley stated the meeting was to determine voter's intent with a consensus from
the Canvassing Board.
Pete Griffin handed out copies of WAC 434-261-075 (Manual inspection of ballot - -
Acceptability of marks or punches) to the Canvassing Board Members for their review prior to
the inspection of the ballots. The arrows on the ballots in question were not connected as the
instructions on the ballot stated. The particular ballots brought to the Canvassing Board for
their determination either had the word "yes" or the word "no" entirely blackened in, a line was
drawn through a "yes" or "no", or an "X" was drawn over a "yes" or "no". It was discussed by
the members that the voter's intent was ambiguous and a determination could not be made.
Royce Buckingham recited item #5 of WAC 434-261-075 which states, "If a ballot contains
marks or punches that differ from those specified in the voting instructions, those marks or
punches shall not be counted as valid votes unless there is a discernable and consistent
pattern, to the extent that the voter's intent can clearly be determined. If there is such a
pattern, the ballot shall be duplicated to reflect the voter's intent."
Royce made a motion to reject all ballots presented to the Board based upon WAC 434-261-
075. All voted in favor and the motion passed unanimously.
Royce stated that there was no possibility of a pattern with the ballots presented in today's
meeting. He was not inclined to establish this as a rule for all future elections. Royce
suggested that questionable voter's intent should be determined by the Canvassing Board at
each election to discern if a pattern is established for that particular election.

Manual inspection of ballot -- .Acceptability of marks or punches.
(1) If the voter returns voting responses by mail on any form other than the ballot sent, the votes thereon shall be
acceptable and tallied provided that:
(a) Only votes for offices or measures for which the voter is eligible are counted.
(b) The candidate or measure response position for which the voter is voting can be clearly identified.
(c) The ballot issued is not returned, or if returned, contains no marks or punches indicating an attempt to vote it.
(d) A valid signature on an absentee oath is on file with the county auditor.
The votes accepted must then be duplicated to a ballot that can be read by the electronic voting equipment.
(2) Corrected absentee ballots shall be counted in the following manner:
(a) If a voter follows the instructions for correcting a vote, either the written instructions or other instructions given to
the voter by the county auditor, the correction shall be made by duplicating the ballot and then tabulating the duplicated
ballot.
(b) If a voter appears to have corrected the ballot in a manner other than as instructed, the vote for that candidate or
issue shall not be tabulated unless the voter provides written instructions directing how the vote should be counted or
has clearly attempted to erase a mark.
(3) If a voter has indicated a write-in vote on the ballot which duplicates the name of a candidate who already appears
on the ballot for the same office, the ballot shall be duplicated to count one vote for the candidate indicated. Such a vote
shall be counted pursuant to RCW 29A.60.021.
(4) If a voter signs the oath with a mark and does not have two witnesses attest to the signature, the envelope must
be treated as if it were unsigned.
(5) If a ballot contains marks or punches that differ from those specified in the voting instructions, those marks or
punches shall not be counted as valid votes unless there is a discernable and consistent pattern, to the extent that the
voter's intent can clearly be determined. If there is such a pattern, the ballot shall be duplicated to reflect the voter's
intent.

Shirley Forslof called the meeting to order at 10:00 a.m. Debbie Adelstein gave a presentation
on signature comparison. She reminded Canvassing Board Members that the "broader picture"
needs to be looked at when comparing signatures and not just a few single characteristics of a
signature. Style and general appearance, i.e., spacing, proportions and slants all need to be
taken into consideration when comparing a signature. Distinctive characteristics should also be
targeted — "nuggets", and there should be more than one.
The first set of ballots presented to today's Canvassing Board meeting were ballots with an "X"
marked through either the "Yes" or "No" vote. It was decided at the May 15, 2006 Canvassing
Board Meeting that ballots that contained an "X" drawn over a "Yes" or "No", blackened out of
the "Yes" or "No", or a line drawn through the "Yes" or "No" would not be counted as the voter's
intent was ambiguous based upon WAC 434-261-075.
Barbara pointed out that there seems to be a tendency to place an "X" on what a person would
want to vote for. Shirley said when a person takes a test, they "X" or fill in the oval for the
answer that indicates their choice. Shirley stated that after the May 15 Canvassing Board
meeting she found in our Canvassing Board Guidelines adopted in September, 2005, that one
of the samples of voter intent included an "X" being placed near a name rather than the arrow
being completed. That guideline says to accept it as a vote and duplicate the ballot. (See
attached sample) A discussion then ensued regarding Canvassing Board Policies and
Procedures versus WAC 434-261-075. It was also noted that on the May 16, 2006 ballot the
words "Yes" and "No" appears to be enclosed in a box. The Canvassing Board agreed that the
box may have been what led a voter to "X" out the "Yes" or "No" rather than connecting the
head and tail of the arrow that corresponded to the "Yes" or "No" vote despite instructions to the
contrary. Canvassing Board Members agreed that a new policy should be added to the
Canvassing Board Policies and Procedures to count a vote that demonstrates a line being
drawn through a choice, an "X" through a choice, or a `blackened out' choice.

Shirley made a motion to adopt a guideline to accept ballots with an "X" through a choice, a line
drawn through a choice or a blackened out choice. The motion passed unanimously. On future
ballots, an effort will be made to remove the lines around the choices that made them look like
"boxes."
Royce made a motion to accept Ballots # C-48 through C-212 (the ballots submitted with this
marking problem). Motion passed unanimously.
The second set of ballots were then presented to the Canvassing Board for review and
determination. Two envelopes, Ballots #C-88 and #C-104, were placed in an "On Hold" status
pending checking the original registration signature, if available. The remaining ballots were
reviewed for signature match and determination was made to accept or reject them (see
attached listing).
Royce suggested reconvening the Canvassing Board meeting this afternoon to allow time to
contact Dan McShane, the County Council representative at the May 15 meeting, to discuss the
change in policy on acceptance of the ballots previously rejected. A review of the rejected
ballots from the May 15, 2006 meeting will be discussed when the Canvassing Board
reconvenes this afternoon.

Shirley Forslof called the meeting to order. Dan McShane is in Olympia today and is
unavailable to discuss the new information regarding possible acceptance of the ballots that
were rejected on May 15.
Shirley stated that after reviewing the 2005 Canvassing Board guidelines and in consideration
of this morning's Canvassing Board meeting, that all ballots that were rejected at the May 15,
2006 Canvassing Board Meeting because of "X" marks, blackened -out marks, or a line drawn
through the "Yes" or "no" choice, should be accepted and allowed to be duplicated by Elections
Staff. Royce stated that he had reconsidered based upon this morning's discussion and was
willing to accept the ballots previously rejected at the May 15, 2006 meeting. He also stated
that this was not an issue in the Primary and General Elections of 2005 as the previous ballots
did not have boxes around the choices. He agreed that the box may have contributed to voters
filling out the ballot incorrectly. Royce made a motion to accept previously rejected ballots and
the motion passed unanimously.
Ballot #C-88 was presented to the Board along with a copy of the original voter registration.
The Board unanimously agreed to reject the ballot due to discrepancy in the signatures.

Regarding Ballot #C-104, Debbie stated that she was unable yet to gain access to the County
Archives to retrieve the original registration. She will continue to try to obtain a copy of the
registration by the Final Canvassing meeting tomorrow. Shirley made a motion to authorize
staff to count Ballot #C-104 if the signature on the original registration matches the signature on
the ballot envelope. Motion passed.

Shirley Forslof called the meeting to order at 2:10 p.m. Debbie Adelstein presented the
Canvassing Board Ballot Reconciliation Report. Debbie explained that the Reconciliation
Report now reflects accountability for every ballot envelope that arrives at the Auditor's Office
as well as the number of ballots we expect to count. Debbie reviewed the new form and also
explained that the "total envelopes returned" minus "envelopes challenged" equaled the net
amount of ballots that are qualified to count.
Debbie then presented the Official Summary and Precinct Reports. Shirley commented that
the turnout for this election was at least 10% higher than in previous special elections. She
also stated there were few over -votes and under -votes. Out of 17,405 ballots, 11 votes were
under -votes and only 1 vote was an over -vote.
Shirley made a motion to accept the Reconciliation Report, Official Election Results Report,
and the Precinct details report. Barbara Brenner seconded the motion and the motion passed
unanimously.
Shirley, Barbara, and Royce then signed the Official Election Results Report.
Barbara Brenner then swore Shirley Forslof in prior to signing the Official Canvass. Shirley
signed the oath followed by Barbara as witness.
Shirley read aloud the Official Election Results: 10,231 voted "Yes" and 7,162 voted "No".
The Greenways III Levy passed by 58.82%. All members of the board signed the results.
Nancy Moore then presented the minutes of the May 25, 2006 Canvassing Board meeting.
The members of the board read and signed the minutes of the last meeting.
Shirley stated that she wanted to commend the Elections Staff on their conduct of this
election. She also commented that the voters did a great job on marking their ballots.

GREENWAYS III LEVY
The Canvassing Board of Whatcom County will begin the official canvass of the May 16,
2006 Special Election pursuant to Chapter 29A.60 RCW, with open public meetings
scheduled to begin on May 25, 2006 at 10:00 a.m. Meetings may be added or canceled
depending upon issues to be decided by the Canvassing Board. The Canvassing
Board will determine the status of ballots from the Special Election. The official signing
of the Certification of Election will take place at the final Canvassing Board meeting on
May 26, 2006 at 2:00 p.m.
The Canvassing Board meetings will be held in the Whatcom County Council
Committee Room on the first floor of the Whatcom County Courthouse, 311 Grand
Avenue, Bellingham, Washington. The Canvassing Board meetings are open public
meetings, and shall be continued until the activity for which these meetings are held has
been completed. For exact times and locations call (360) 676-6742 or TTY (360) 738-
4555.
A record of the proceedings of the Whatcom County Canvassing Board shall be made
and maintained in the County Auditor's Office, and shall be available for public
inspection and copying. The record shall be retained for the same time period required
by law for the retention of ballots.

NOTICE OF CLOSING OF THE REGISTRATION BOOKS AND
SPECIAL PROCEDURE FOR LATE REGISTRATION FOR THE
SPECIAL ELECTION ON MAY 16, 2006
The registration books in Precincts 201 through 247 within the City of Bellingham, Whatcom
County, Washington, will be closed to mail -in registrations and transfers between precincts after
Saturday, April 15, 2006. They will remain closed until after the Special Election held on Tuesday, May
16, 2006.
Mail -in voter registration forms must be postmarked no later than April 15, 2006 in order to
register by mail for the Special Election on May 16, 2006.
Mail -in voter registration forms can be picked up at the following locations:
Auditor's Office
Licensing Sub Agents
Bellingham City Fire Stations
Bellingham Public Libraries
City Clerks Offices
Post Offices
Whatcom County Rural Libraries
State Drivers License Agency
Major grocery stores
If an unregistered person, otherwise qualified to vote in the state, county, and precinct in which
he or she applies for registration, is not registered to vote by the closing date of April 15, 2006, he or
she may register to vote or change his or her address in person until May 1, 2006 in the office of the
Whatcom County Auditor and receive a ballot for the Special Election.
This special procedure for late registration, which a person may use to register to vote or
change his or her address after the close of mail -in registration, begins April 17 and ends
May 1, 2006.
Please note the special registration and voting procedure can be done only at the County
Auditor's Office in the Whatcom County Courthouse at 311 Grand Avenue, Suite 103 in Bellingham.
