AUTHORIZATION OF CANVASSING BOARD REPRESENTATIVES
We the Whatcom County Canvassing Board, acting under the authority given in RCW
29A.60 do hereby authorize the following persons:

and any additional full time, extra help or seasonal employees hired by the County Auditor to act
as our representatives. At all times said representatives shall be properly supervised. Their
duties shall include issuing absentee and vote by mail ballots and maintaining security over
absentee and vote by mail ballots that have been voted and returned. Duties shall also include
processing of returned absentee, vote by mail ballots and provisional ballots in accordance with
the policies and procedures established by applicable laws and regulations and the Whatcom
County Canvassing Board to determine if each ballot meets those requirements (for example,
properly signed, timely receipt). Those ballots not meeting the requirements of said policies shall
be referred to the Canvassing Board for final determination regarding the disposition of the
ballot. Representatives of the board are authorized to make recommendations regarding the
disposition of such ballots but in all cases final determination will be made by the Canvassing
Board.
Duties shall also include opening, inspecting, preparing ballots for counting and counting
of ballots. Said preparation may include the enhancement of ballots and duplication of damaged
ballots which cannot be processed through the ballot tabulation system. An adequate record will
be kept of all such duplicated or enhanced ballots to allow for subsequent verification by the
Canvassing Board, as they might deem necessary.
Representatives are also authorized to process Provisional Ballots returned from the polls
or ballot drop off sites. Such processing may include determining if the voter is eligible to vote
in the election for which the ballot was cast and what precinct and/or district said voter is eligible
to vote in. Staff will make a recommendation on the Provisional Ballots not meeting the
requirements of applicable laws and Canvassing Board Policies, but in all cases final
determination shall be made by the Canvassing Board.
Further, the same representatives are authorized to audit election records, poll books,
ballot control records, transport carrier log, etc. during and after each election. Such auditing
functions and reports will be considered with the Canvassing Board's canvass of each election.

This delegation of authority shall be in effect through December 31, 2005. Further, the
Canvassing Board acknowledges that from time to time the individuals designated as its
representatives will change as staff changes occur in the Auditor's office, requiring additions to
and/or deletions from the list of individuals listed above.

One provisional ballot was forwarded to King County.
Ethel confirmed that each voter whose signature was in question had been notified in writing of
the discrepancy between their signature on file and their signature on the ballot envelope.
After review by the Canvassing Board, each ballot was returned to the Canvassing Board
envelopes and members initialed their acceptance or rejection. Shirley date stamped the
envelopes.
It was agreed upon by the Canvassing Board members that the meeting would be adjourned
and reconvene at 2:00 p.m. to allow Pete Griffin, Election Supervisor, to locate the RCW that
refers to "identifiable mark" on a ballot.

Shirley called the meeting to order.
Pete Griffin passed around copies of RCW 29A.60.040 to the Canvassing Board Members.
The RCW dictates that a ballot is invalid if "... it is marked so as to identify the voter."
With the law clearly defined, envelopes #25 and #38 that were placed in a holding pattern
from the morning's session were then reviewed.

After review by the Canvassing Board, each ballot was returned to the Canvassing Board
envelopes and members initialed their acceptance. Shirley date stamped the envelopes.
A motion was made by Shirley to approve the integrity of the "Log of Irregularly Voted Ballots".
Royce seconded the motion and the motion passed unanimously. The "Log of Irregularly Voted
Ballots" sheet was initialed by all Canvassing Board members and was placed in the September
28, 2005 Canvassing Board Meeting file.
A motion was made by Shirley to reject any ballots received after 8:03 p.m. in the Auditor's
Office on Tuesday, September 20, 2005. Royce seconded the motion and the motion passed
unanimously.
The Canvassing Board authorized the staff to count any remaining ballots prior to the signing of
the Official Canvass on Friday, September 30, 2005.
The next canvassing board meeting will be the signing of the Official Canvass for the Primary
and Special Election at 11:00 a.m., Friday, September 30, 2005.

Rejection of ballots or parts -- Write-in votes.
A ballot is invalid and no votes on that ballot may be counted if it is found folded together with another ballot
or it is marked so as to identify the voter.
Those parts of a ballot are invalid and no votes may be counted for those issues or offices where more
votes are cast for the office or issue than are permitted by law; write-in votes do not contain all of the
information required under "RCW 29A.60.020; or that issue or office is not marked with sufficient definiteness
to determine the voter's choice or intention. No write-in vote may be rejected due to a variation in the form of
the name if the election board or the canvassing board can determine the issue for or against which or the
person and the office for which the voter intended to vote.

Efforts made to reconcile difference:
1. Cross-checked all opening board log sheets to see that they were entered on this reconciliation tally sheet
correctly. RESULT: All entries on this tally sheet are the same as provided by the opening boards.
2. Examined all original ballots that were duplicated to be certain the duplicate ballot was not held upstairs in
error (and thus did not get included in the count). RESULT: There were no duplicate ballots retained with the
originals.
3. Explored whether the difference in precincts could be due to ballots of same style but for different precincts
being counted. RESULT: In only two instances would this be possible. (Precincts 701 and 801 are the same
style; 218, 242 and 246 are of the same style and perhaps one vote could be accounted for in this manner.
The net effect change could only be one vote.)
CONCLUSION.
There were differences between the opening board count and the machine count in 13 precincts. The
precincts in which a difference in count occurred (between what the machine counted and what was expected
to be counted) is most likely due to counting errors at the opening boards. The net effect was the machine
counted two more votes than was expected to be counted from the opening board reports. In reviewing reports
from the election management system, the number of ballots issued, returned and forwarded to the opening
boards equals the number of ballots counted by the ballot tabulation system (25,216), which would lend
credence to the theory that the discrepancies were due to counting errors at the opening boards.

The meeting was held in the County Council Committee Room.
Shirley called the meeting to order. The minutes from the September 28, 2005 meeting of the
Canvassing Board were approved and all members signed the minutes.
Debbie Adelstein presented the following reports to the Canvassing Board:
(1) Cumulative Report of Challenged Returns
Shirley made a motion for the Board's acceptance of the report, Royce seconded the motion,
and the motion passed unanimously.
(2) Reconciliation Report
Shirley made a motion for the Board's acceptance of the report, Barbara seconded, and the
motion passed unanimously.
(3) Ballot Tracking Log
Shirley made a motion for the Board's acceptance of the report, Royce seconded, and the
motion passed unanimously.
(4) Mail Ballot Official Results
Shirley made a motion for the Board's acceptance of the report, Royce seconded, and the
motion passed unanimously.
(5) Statement of Vote (Abstract)
Shirley made a motion for the Board's acceptance of the report, Barbara seconded, and the

Shirley Forslof was the first to sign the Certification of Canvassing Board followed by Barbara
Brenner and Royce Buckingham.
Barbara administered the Oath of Auditor to Shirley for the Special Election of Whatcom County
Cemetery District No. 1 and the oath was signed by Shirley, witnessed by Barbara.
Shirley Forslof was the first to sign the Certification of the Special Election of Whatcom County
Cemetery District No. 1 followed by Barbara Brenner and Royce Buckingham.

If an unregistered person, otherwise qualified to vote in the state, county, and precinct in which
he or she applies for registration, is not registered to vote by the closing date of August 20, 2005, he or
she may register to vote in person until September 2, 2005 in the office of the Whatcom County Auditor
and receive a ballot for the Primary and Special Election.
This special procedure for late registration, which a person may use to register to vote
after the close of mail -in registration, begins August 22 and ends September 2, 2005.

The Canvassing Board of Whatcom County, pursuant to Chapter RCW 29A.60 will begin
the open public meetings at 8:00 A.M. Thursday, September 1, 2005 at the office of
Shirley Forslof, Whatcom County Auditor, County Courthouse, 311 Grand Avenue, Suite
103, Bellingham, Washington. These meetings will be held to begin the initial
processing, including signature verification of the vote by mail ballots cast for the
Primary and Special Elections to be held on September 20, 2005. The opening of the
Vote By Mail Ballots may begin immediately open receipt pursuant to RCW 29A.40.110.
Please call (360) 676-6742 or TTY (360) 738-4555 for exact times and locations. The
meetings of the canvassing board are open public meetings, and shall be continued until
the activity for which these meetings are held has been completed.
A record of the proceedings of the County Canvassing Board shall be made and
maintained in the County Auditor's Office, and shall be available for public inspection
and copying. The record shall be retained for the same time period required by law for
the retention of absentee ballots.

September 20, 2005 Primary and Special Election pursuant to Chapter 29A.60 RCW,
with open public meetings beginning at 9:00 a.m. on September 27, 28, and 29, 2005.
Meetings may be added or canceled depending upon issues to be decided by the
Canvassing Board. The Canvassing Board will determine the status of ballots from the
Primary and Special Election. The official signing of the Certification of Election will
take place at the final Canvassing Board meeting on September 30, 2005 at 2:00 p.m.
The Canvassing Board meetings will be held in the Whatcom County Council
Committee Room on the first floor of the Whatcom County Courthouse, 311 Grand
Avenue, Bellingham, Washington. The Canvassing Board meetings are open public
meetings, and shall be continued until the activity for which these meetings are held has
been completed. For exact times and locations call (360) 676-6742 or TTY (360) 738-
4555.
A record of the proceedings of the Whatcom County Canvassing Board shall be made
and maintained in the County Auditor's Office, and shall be available for public
inspection and copying. The record shall be retained for the same time period required
