I further certify that the difference (261) between the number of votes cast for the two
top candidates for this office (Christine Gregoire and Dino Rossi) is less than one-half
of one percent of the total vote cast for these two candidates and less than 2,000
votes.
THEREFORE, pursuant to RCW 29A.64.020, I hereby order that a machine recount
be made of all votes cast for the Office of Governor of the State of Washington and
the county canvassing boards of the counties involved certify the results of said
recount to the Secretary of State in the manner provided by RCW 29A.64.040.

Dear Mr. Rossi:
The Whatcom County Canvassing Board, or its designated representatives, will conduct a
mandatory machine recount of the votes cast for the office of Washington State Governor pursuant to an
order from the Washington Secretary of State. Enclosed please find an Open Public Meeting Notice
announcing the recount of ballots which will occur after a Logic and Accuracy test beginning on
Monday, November 22, 2004 at 9:00 a.m. This meeting will take place in the Ballot Counting Room of
the Whatcom County Auditor's Office at 311 Grand Avenue, Suite 103 in Bellingham, Washington.
The recounting of ballots will continue until finished.
You and/or your representatives and legal counsel may observe the recount.

The undersigned officers designated by law as constituting the Canvassing
Board for the County of Whatcom, State of Washington, hereby certify that this is a full,
true and correct copy of the Mandatory Recount for the office of Governor in Whatcom
County, State of Washington; that the total number of active registered voters in all
precincts was 106,094; the total number of inactive registered voters in all precincts was
15,626; the total number of all registered voters in all precincts was 121,720; and that
the total number of votes cast in such precincts was 91,501.

RECONVENING OF THE CANVASSING BOARD NOVEMBER 23, 2004 FOR
THE RECOUNT OF THE NOVEMBER 2, 2004 GENERAL ELECTION FOR
THE OFFICE OF WASHINGTON STATE GOVERNOR

The meeting was held in the Ballot Counting Room of the Whatcom County Auditor's Office.
Shirley called the meeting to order.
Sam requested an explanation of why the turnout in Bellingham precinct 65 was significantly greater
than the reported number of registered voters in that precinct. Shirley and Pete explained that
Bellingham precinct 65 is on the campus of Western Washington University and our greatest number of
provisional voters were at that polling location. Provisional voters use a ballot from the poll where they
are voting, regardless of the precinct in which they are registered. Those ballots are indiscernible from
other poll ballots once they have been removed from the provisional envelope and prepared for
processing. They are included in the reporting for the precinct in which they are cast. Shirley explained
the processing of provisional ballots, including the method of duplicating ballots where the voter was
not eligible to vote in all races. Sam questioned why the turnout reported in Bellingham precinct 65 for
the 2000 General Election did not exceed the number of registered voters. Pete explained that we were
not prepared for a high turnout of provisional voters in that election. In the 2004 General Election, we
set up an election board that was solely responsible for provisional voters at WWU. This, plus increased
publicity about provisional voting, increased voter awareness and increased voter interest all contributed
to the high number of provisional voters at the WWU polling location. Pete also explained that the
Elections Office continued to process new registrations after the poll books were printed and the Logic
and Accuracy test was performed. According to a rule made by the Secretary of State's office, we are
not allowed to update our total registration figure after the Logic and Accuracy test. Therefore, it is also
likely that the actual registration for Bellingham precinct 65 is greater than the official registration total
used on the reports in this election. Dave and Sam asked if updated registration numbers were used on
the recount reports. Pete explained that the registration totals were not updated according to state law.
Discussion continued regarding the handling of provisional ballots.

Sam asked if any observers had questions about provisional ballots or about the recount.
Bill questioned if there is any physical difference between poll and provisional ballots. Pete answered
there is no difference. Absentee ballots are different in physical appearance.
Bill asked if there was any physical record made of the provisional turnout in Bellingham precinct 65.
Pete responded that there were estimates, but the best record was the provisional roster. Bill asked if
that roster could be produced for review. Sam agreed and requested that the rosters for the poll at WWU
be brought to the meeting for review.
While the rosters were being gathered, Bill and Barry commented to the Board that the Elections staff
had done a good job of explaining the recounting process and answering any questions asked by
observers. The processing over the past two days had been smooth and methodical.
Pete brought in the rosters from the poll at WWU. The observers were allowed to view the rosters along
with the Board. The regular roster was reviewed and Pete explained that the total number of names in
that roster matched the total number of reported registered voters in precincts 65 and 115. The Inactive
Roster was then reviewed and it was noted that no signatures were contained in that roster. Pete
confirmed that the voters in the inactive roster were not included in the total number of reported
registered voters. The Provisional Rosters were then reviewed and it was noted that there were a
significant number of signatures in those rosters. Dave and Sam totaled the signatures for each roster
and determined that the rosters accounted for 731 provisional voters at that precinct. Sam commented
that he was reasonably satisfied that the provisional voters accounted for the significant difference
between the number of reported registered voters and the turnout of voters in Bellingham precinct 65.
Shirley presented to the Board the Final Summary Reports from the recount and the Board reviewed the
difference between those counts and the counts certified on November 17. It was noted that the net
result was Gregoire received 3 additional votes. Dave questioned why there was a net increase of 4
ballots, but the only increase in counts was the 3 additional votes for Gregoire. Shirley commented that
one ballot may not have included a vote in the governor's race. Bill addressed the Board and explained
that upon examining the reports he discovered 26 instances where there were variances in the numbers.
Of those 26 variances, there was a net increase of 4 ballots and a net increase of 3 votes for Gregoire.
Bill further informed the Board that approximately 18-19 of the 26 variances occurred in the Bellingham
precincts and that the largest variance was + or — 2 votes. The Board thanked Bill for sharing this
detailed observation.
The Board requested an Over, Under and Blank Vote report from the recount to compare to the report
accepted on November 17. Pete created the requested report and the numbers were compared to the
November 17 report. The combined over, under and blank votes were identical to the combined
numbers on the November 17 report.
Sam moved to accept the recount of the office of Washington State Governor as presented by the
Whatcom County Auditor. Dave seconded the motion and all voted in favor and signed the Summary
Report. Shirley signed the Oath of County Auditor and all the Canvassing Board members signed the
Certification of the Canvassing Board, certifying the recount.
Sam moved to accept the poll and absentee reports of the Over, Under and Blank votes for the recount.
Dave seconded the motion and all voted in favor and signed the reports.

Sam moved to accept the Precinct Detail Report for the recount. Dave seconded the motion and all
voted in favor.
Sam moved to accept the combined report of the Over, Under and Blank votes for the recount. Dave
seconded the motion and all voted in favor and signed the report.
Observers were provided with copies of documents and logs and copies were also placed in the
Auditor's file. Shirley and Larry completed and signed a seal log for the Document Case which was
also copied. The original seal log was placed in the Document Case and the case was then sealed with
the seal number recorded on its seal log. The Document Case was placed in the Auditor's vault.
The Canvassing Board meeting adjourned at 11:56 a.m.

The meeting was held in the Ballot Counting Room of the Whatcom County Auditor's Office.
Auditor staff members brought in the 2004 General Election Document Case and the transfer cases
labeled with numbers 136, 150, 151, 154, 104, 155, 153, 148, 147, 101, 138, 146, 102, 152, 103 and
"Lynden City." Debbie, Shirley and Ethel opened the Document Case and the numbered cases and
removed the seal logs. Shirley, Barry and Larry verified the seal numbers to the numbers on the logs
removed from each case and signed the logs. The "Lynden City" transfer case was not opened at this
time.
Pete created an Activity Report and presented the report to the observers. Special attention was given to
the activity at approximately 3:15 p.m. on November 22 when the election program would not accept a
partial set of ballots from Bellingham precinct 95. Pete explained that after the recounting was
concluded, a Precinct Detail Report would be printed to compare the turnout in Lynden City precincts 1,
3, and 5 to the turnout on the certified returns dated November 17. Ballots for those precincts were in
the machine when the above -mentioned error occurred and Pete was doubtful that those ballots were
counted. Pete explained that, after considering the matter, he believes the synchronization between
card reader 1 and 2, controlled by serial converters, was stopped until card reader 1 was cleared which
reset the com port which would not have allowed those 3 precincts ballots to be added to the totals. .
The recounting of ballots resumed at 8:55 a.m.
Ethel pulled the absentee, mail -in and provisional ballots out of the transfer cases by precinct number,
placed the header cards with the appropriate ballots and reviewed the ballots for precinct. Pete
processed the cards through the card reader. After each batch of ballots had been processed and
removed from the card reader, the header card was removed and a black marker was used to mark the
top of the stack of ballots with a second stripe to note that they had been recounted. Debbie inspected
each stack of ballots, secured them by elastic bands and listed the precincts on the transfer case label.

The counted ballots were then placed into transfer cases which were labeled with a "re-counted" sticker.
Tina also helped to remove header cards and inspect processed ballots.
After processing was completed, Pete created a Precinct Abstract Report. The turnout in Lynden City
precincts 1, 3 and 5 was compared to the turnout in those precincts on the certified returns dated
November 17. Shirley, Pete and all the observers agreed that the above -mentioned ballots had not been
counted and should be processed through the card reader at this time. Shirley, Barry, Amy and Larry
signed this Precinct Abstract Report.
Pete opened the "Lynden City 1, 3 and 5" transfer case. Shirley and the observers verified that the seal
number matched the seal number recorded on the Recount Seal Log dated November 22. Pete removed
the ballots from the "Lynden City" transfer case, placed the header cards and processed them through
the card reader. The header cards were then removed, the ballots striped and bound by elastic bands
then returned to the transfer case which was numbered "R57" and labeled with a "re-counted" sticker.
After processing the ballots for Lynden City precincts 1, 3 and 5, Pete created a new Precinct Abstract
Report which was used to compare the turnout in those precincts to the turnout on the returns dated
November 17. The turnout was identical. Shirley, Barry, Amy and Larry signed this Precinct Abstract

Pete created a Precinct Status Report showing that all precincts were active except for 6 absentee
precincts which are vote -by -mail and do not have "absentee" voters. Shirley, Barry and Larry reviewed
and signed the Precinct Status Report.
Debbie and Ethel sealed the 15 transfer cases numbered R43 to R57. A single log sheet was created to
record the seals on these transfer cases. Shirley, Barry and Larry verified the seal numbers and signed
the seal log.
Pete created Summary Reports (Absentee, Poll and Combined) containing the recounted totals for the
office of Washington State Governor. Pete also created a Recount Final Abstract Report.
Pete removed the back-up computer zip disk from the Document' Case, performed a backup of the
2004rec election program and files and saved it to the zip disk. The name of the back-up file is
"recount2." The Election system was shut down. The computer zip disk containing the back-up file
was placed in the Document Case.
The observers were provided with copies of all documents and logs and copies were also placed in the
Auditor's file. The original documents and logs were placed in the Document Case.
The recount concluded at 10:55 a.m.

The meeting was held in the Ballot Counting Room of the Whatcom County Auditor's Office.
Auditor staff members previously brought in the 2004 General Election Document Case and the transfer
cases containing the poll ballots.
Pete distributed procedures for the 2004 General Recount Process and he explained the procedures to the
observers, including the work he did on Saturday, November 20. (A copy is attached hereto.) Using the
program activity reports, Pete confirmed that he did not do any counting or tabulating as part of his work
on November 20.
Bill asked for confirmation that no activity would be done today with any offices other that the
recounting process occurring in the ballot counting room. Pete affirmed.
Aliya questioned if we would be duplicating any ballots today. Shirley and Pete confirmed that it was
unlikely unless a card was damaged for some reason and unable to be processed.
Debbie left the room at 9:35 a.m.
At 9:40 a.m. Shirley opened the Document Case and removed the seal log. Shirley, Larry and Barry
verified the seal number to the number recorded on the log and signed the log.
Pete presented the following reports:
(1) Summary Report from the 2004gen program showing counts for all races certified on
November 17; -

(2) Summary Report from the 2004rec program showing only counts for the governor's race as
of November 17, confirming the copy;
(3) Activity Report from the 2004gen program showing no activity since November 17; and
(4) Activity Report from the 2004rec program showing activity performed on November 20 to
create an exact duplicate of the programming for the 2004gen then to modify the program to
only report the governor's race.
Shirley and Tina compared the count totals on both Summary Reports for the governor's race to the
Combined Summary Report printed on November 17 and the counts agreed. Shirley, Tina, Larry and
Amy signed both the 2004gen and the 2004rec Summary Reports. Shirley, Larry and Amy signed the
Activity Report.
Logic and Accuracy Test
Test began: 9:55 a.m.
Pete zeroed out the counts in the 2004rec program and created a zero report which was verified and
signed by Shirley, Tina, Larry and Barry.
Barry and Larry accompanied Pete to the Auditor's vault where Barry and Larry agreed to test precincts
Custer 1 and Delta 1 both contained in L&A case #5.
L&A transfer case #5 was brought back to the ballot counting room. Shirley opened the case and
removed the seal log from inside. Shirley, Larry and Barry verified the seal number to the number on
the log and signed the log.
Ethel and Pete processed the prepared test decks for Custer 1 and Delta 1 for both poll and absentee.
After the cards were processed, the decks were returned to L&A transfer case #5.
Pete created L&A Summary Reports (poll, absentee and combined) and explained the results of the test
to the observers. Pete explained the relation of the punch position to the L&A test results. Gregoire, in
punch position #91, received a combined total of 4 votes. Rossi, in punch position #92, received a
combined total of 8 votes. Bennett, in punch position #93, received a combined total of 12 votes.
Shirley, Barry and Larry signed the Summary Reports.
Shirley, Barry and Larry completed a seal log for L&A Test Deck case #5. Tina copied the log and
provided copies to the observers and placed a copy in the Auditor's file. The original log was placed in
the case and the case was sealed and returned to the Auditor's vault.
The Logic and Accuracy Test concluded at: 10:25 a.m.
Recount of Ballots
Recounting of ballots began: 10:25 a.m.
The transfer cases containing the poll ballots were removed from the cart and placed on tables. Shirley
removed the original Election Night Seal Log from the Document Case. Shirley, Barry and Larry
verified the seal numbers from the log matched the seal numbers on all the cases and signed the log.
After the seals were verified, Ethel and Pete opened the transfer cases.

Pete zeroed out the totals in the 2004rec election program and created Poll, Absentee and Combined
zero reports. The reports noted zero balances. Shirley, Barry and Larry reviewed the reports and signed
the top of the reports.
Ethel and Joyce pulled the poll ballots out of the transfer cases by precinct number, placed the header
cards with the appropriate ballots and reviewed the ballots for precinct. Pete and Ethel processed the
cards through the card readers. After each batch of ballots had been processed and removed from the
card reader, the header card was removed and a black marker was used to mark the top of the stack of
ballots with a second stripe to note that they had been recounted. Once they were recounted, the stacks
of processed ballots were placed back into the poll transfer cases from which they were removed and the
cases were returned to the cart.
Periodically during processing, various media entered the room to take pictures and interview Shirley
and the observers.
After all poll ballots had been counted, Pete created a Precinct Status Report showing that 113 of 119
poll precincts were active. Pete explained that the six inactive poll precincts were vote -by -mail
precincts which would be counted along with the absentee ballots. Larry and Barry reviewed and signed
the report.
Debbie returned to the meeting at 11:30 a.m.
Shirley, Ethel and Debbie recorded the seal numbers to be used to seal the poll transfer cases on a seal
log. Ethel and Debbie sealed the cases with the seal numbers recorded on the log. Larry and Barry
verified that the seal numbers were recorded properly. Debbie, Ethel, Barry and Larry signed the seal
log for the poll transfer cases. The original log'was copied and then placed in the Document Case. The
poll transfer cases were then placed in the Auditor's vault.
Ethel verified that all the poll header cards were accounted for and returned the poll header cards to the
Document Case.
Pete explained that an absentee ballot from Bellingham precinct 46 was found among the poll ballots.
He explained possible reasons why this could have occurred. Pete held the ballot while allowing the
observers to view the ballot up close.
The recount of poll ballots concluded at 11:50 a.m.
Auditor staff members brought in 57 sealed transfer cases numbered 101 to 157 containing the absentee,
mail -in and provisional ballots. The cases were not opened at this time.
At 12:00 p.m. Pete called a 30 minute recess for lunch. Everyone left the room and the door was locked.
Meeting reconvened at 12:40 p.m.

Transfer cases numbered 127, 109, 122, 115, 120, 116, 112, 124, 114, 129, 117, 156 and 157 were
removed from the cart, placed on the table and opened. Debbie, Barry and Larry verified the seal
numbers to the numbers on the logs removed from each case and signed the logs.
Pete reminded the observers that he would be adding to this group of ballots the absentee ballot from
Bellingham precinct 46 which was found earlier among the poll ballots.

The recounted ballots were then placed into transfer cases which were labeled with a "re-counted"
sticker. Tina also helped to remove header cards and inspect processed ballots.
Shirley returned to the meeting at 1:50 p.m.
After the first group of transfer cases were processed, a second group of transfer cases were removed
from the cart and placed on the table. Ethel opened the transfer cases numbered 107, 123, 110, 113,
108, 105, 121, 118, 126, 106, 125 and 128 and removed the seal logs. Shirley, Barry and Larry verified
the seal numbers and signed the seal logs.
Ethel pulled the absentee, mail -in and provisional ballots out of the transfer cases by precinct number,
placed the header cards with the appropriate ballots and reviewed the ballots for precinct. Pete
processed the cards through the card reader. After each batch of ballots had been processed and
removed from the card reader, the header card was removed and a black marker was used to mark the
top of the stack of ballots with a second stripe to note that they had been recounted. Debbie inspected

Secretary of State Sam Reed visited the meeting at 2:00 p.m. for a few minutes to observe and greet the
participants.
After the second group of transfer cases were processed, a third group of transfer cases were removed
from the cart and placed on the table. Ethel opened the transfer cases numbered 139, 143, 145, 142,
133, 130, 134, 111, 119, 135 and 132 and removed the seal logs. Shirley, Barry and Larry verified the
seal numbers and signed the seal logs.

During processing, an absentee ballot from precinct Custer 3 was discovered to have been sliced by the
letter opener. Shirley labeled and duplicated the ballot. Tina labeled the original ballot, entered the
duplicated ballot information on the Duplication Log and placed the original ballot into an envelope.
Tina also verified the ballot was duplicated correctly.
At 3:45 p.m. Pete explained to the observers that for an unknown reason, the counting system would not
accept additional absentee ballots from Bellingham precinct 95. The absentee ballots already counted
for that precinct were located and removed from transfer cases #R1 and #R30. Pete zeroed out the
absentee totals for Bellingham precinct 95 and created an absentee zero report. He also created a poll
report for Bellingham 95 to show that the poll counts were not zeroed out. Shirley, Barry and Larry
reviewed the reports and signed the top of the reports. Pete also explained that he would set aside the
absentee ballots from Lynden City which were in the counter when the error occurred just in case the
counts from those precincts were affected by the error. Those Lynden City precinct absentee ballots
were placed in a special transfer case labeled "Lynden City." Pete processed the absentee ballots from
Bellingham precinct 95 through the card reader and the system accepted the ballots. A third black stripe
was made on the top of the ballots to show that they had been reprocessed.
After the third group of transfer cases were processed, a fourth group of transfer cases were removed
from the cart and placed on the table. Ethel opened the transfer cases numbered 141, 140, 131, 144,
137, 149, 152, 150, 151, 147 and 154 and removed the seal logs. Shirley, Barry and Larry verified the
seal numbers and signed the seal logs.
Ethel pulled the absentee, mail -in and provisional ballots out of the transfer cases numbered 141, 140,
131, 144, 137 and 149 by precinct number, placed the header cards with the appropriate ballots and
reviewed the ballots for precinct. Pete processed the cards through the card reader. After each batch of
ballots had been processed and removed from the card reader, the header card was removed and a black
marker was used to mark the top of the stack of ballots with a second stripe to note that they had been
recounted. Debbie inspected each stack of ballots, secured them by elastic bands and listed the precincts
on the transfer case label. The recounted ballots were then placed into transfer cases which were labeled
with a "re-counted" sticker.
At 4:25 p.m. Pete announced that we would not be able to finish by 5:00 p.m. Therefore, ballots were
not removed from the opened transfer cases numbered 152, 150, 151, 147 and 154. Shirley, Larry and
Barry completed seal logs for these cases which were then copied. The original seal logs were placed in
the cases and the cases were re -sealed.
These cases were added to the cart along with transfer cases numbered 103, 102, 146, 138, 101, 104,
155, 153, 136 and 148. These fifteen transfer cases were taken to the Auditor's vault.

A single log sheet was created to record the seals on the 42 remaining transfer cases. Pete and Ethel
sealed the transfer cases numbered R1-R34 and R36-R42 containing recounted ballots (there is no case
numbered "R35"). The "Lynden City" transfer case was also sealed. Shirley, Barry and Larry verified
the seal numbers on all 42 cases and signed the seal log.
Pete removed the back-up computer zip disk from the Document Case, performed a backup of the
2004rec election program and files and saved it to the zip disk. The name of the back-up file is
"recountl." The Election system was shut down. The computer zip disk containing the back-up file
was placed in the Document Case.
Shirley, Barry and Larry verified that the seal number to be used to seal the Document Case was
properly recorded and signed the log sheet. The original log was placed in the Document Case. The
transfer cases were placed in the Auditor's vault.
All observers were provided with copies of all documents and logs and copies were also placed in the
Auditor's file. The original documents and logs were placed in the Document Case, except as noted
above. The Document Case was then sealed with the seal number recorded on its seal log. The
Document Case was placed in the Auditor's vault.

Shirley called the meeting to order.
Shirley presented the Minutes from the Canvassing Board meeting on November 17, 2004. Sam moved
to accept the Minutes and Dave seconded the motion. All voted in favor and signed the Minutes from
the November 17, 2004 Canvassing Board meeting.
Sam brought forth a question posed to the Board by Larry regarding the variance of 2 ballots on the
Absentee Reconciliation Report accepted by the Board on November 17. Debbie and Pete explained the
possible causes of the variances shown on the report, i.e. a ballot was in with the wrong precinct or the
opening board counted envelopes that did not contain ballots, etc. Pete clarified that this report should
be labeled as "Working Papers" because its function is to help the Auditor's staff to identify any
anomalies in the counts from each precinct.
Sam moved to authorize the Auditor's staff to proceed with the Logic and Accuracy Test. Dave
seconded the motion and all voted in favor.

Washington State Governor after completing the Logic and Accuracy Test. Dave seconded the motion
