Perry Eskridge, Republican Observer Cory Walker, Republican Observer Charlie Crabtree, Republican Observer The meeting was held in the Council Committee Room of the Whatcom County Courthouse. Shirley called the meeting to order. Shirley presented to the Board minutes from the meeting on December 13. Sam moved to approve the minutes from the December 13 meeting and Shirley seconded the motion. All voted in favor and signed the minutes. Debbie distributed copies of the updated working papers showing count totals from the manual recount. Shirley explained that the ballots approved the by Canvassing Board on December 13 had been added to the report. Debbie explained the new count totals and discussion ensued. Shirley explained that one provisional ballot from King County and one provisional ballot from Skagit County had been received by the Auditor's Office for review by the Board. Shirley stated that she had confirmed each county had kept the respective ballots in secure storage. Shirley gave the following historical background for each provisional ballot. Provisional Ballot #1 Shirley informed the Board that this ballot had been voted in Whatcom County and mistakenly forwarded by the Whatcom County Elections Office to King County. The voter's registration in King County had been cancelled pursuant to a notice from Whatcom County that he was now registered here. Therefore, King County rejected his provisional ballot. The voter discovered the status of his provisional ballot and filed a signed affidavit in the case currently before the State Supreme Court. Shirley described Whatcom County's standard procedures for handling provisional ballots and stated that, in this instance, the Whatcom County Elections Office had made an error. Provisional Ballot #2 Shirley informed the Board that this ballot had been voted in Skagit County in the city of Rockport where a section of the city runs into Whatcom County. The voter was registered in Whatcom County in the Newhalem precinct, which is a Vote -By -Mail precinct. The voter's address was listed on the provisional envelope but there was no specific indication that the voter lived in Whatcom County. Skagit County rejected the provisional ballot because the voter was not registered there. The voter discovered the status of his provisional ballot and filed a signed affidavit in the case currently before the State Supreme Court. It is unclear why Skagit County failed to Page 1 — Canvassing Board Meeting, December 14, 2004 — Minutes forward the ballot to Whatcom County. Shirley again described Whatcom County's standard procedures for handling provisional ballots and stated that, in this instance, Skagit County had made an error. Bill asked if both voters were registered as absentee voters. Shirley confirmed that the voter of Ballot 41 was an absentee voter in the Semiahmoo precinct and the voter of Ballot #2 lives in the Newhalem precinct which is Vote -By -Mail only. Bill asked if the Auditor had confirmed that no mail ballot had been received from either voter. Attached to both provisional ballots was a "Certification of Registration" report, which was generated by the Election registration system. Under the column entitled "Election Information; Total Elections Voted" both voters appeared to be given credit for having voted in the 2004 General Election. The Board requested that an Election staff member join the meeting to clarify the report. Ethel Heyrend joined the meeting and confirmed that the report did seem to give them credit for voting. The report, however, was generated by a new computer system and Ethel commented that the information on the report did not appear to be complete. The Board suggested that Ethel research the election system to make a definite determination of whether or not the voters had returned their mail ballots. Bill asked for an explanation of what action in the computer system would have generated the apparent voting credit. Bill also asked if a notation would have been made as to who would have taken that action and when it took place. Barry asked if an actual return envelope could be produced for hard confirmation. Sam requested that no additional marks be made on either the provisional envelopes or the reports. The Board meeting recessed to allow Ethel to research the matter. Bill and Barry accompanied Ethel to the Elections Office where they observed her research. The meeting reconvened at 3:50 p.m. Shirley informed the Board that the new election computer system generates a list of all elections in which any activity took place for the voter regardless of whether or not their mail ballot was returned. In the case of both voters researched, the detail of their voting history for the 2004 General Election read, "Absentee Issued but not Returned." The report generated by the system gives the appearance that the voter voted, however the status detail shows that no ballot was returned. Shirley stated that she would request this report to be modified to more accurately reflect the voter's voting history. Bill requested that a visual search be conducted of the absentee return envelopes for Semiahmoo and Newhalem precincts to provide hard confirmation that no ballot had already been counted for these voters. Bill based this request on the anomalies apparent in the election computer system, on the voters' history of voting by mail ballot and on the basis of the envelopes being readily available and in the Auditor's possession. Discussion ensued regarding the magnitude of such an undertaking. Shirley informed the Board that it could take a significant amount of time to accurately examine the 1100+ envelopes in those precincts. Karen asked if there was any reason to believe an absentee ballot may have been returned. Shirley explained the computer system showed no ballot had been returned and that is the same information relied upon by the Election staff to make any necessary determinations on whether or not a voter had returned a ballot. Bill suggested that the new system could have had an anomaly in how the entry was made. Sam suggested conducting a random test of two absentee voters known to have not voted and see if the report and voting history reflect the same notations as those of the voters in question. Bill commented that this random test would not satisfy the concern over these two specific voters. Karen asked how the verification procedures being discussed compared to how the Board and the Elections Office regularly determine the status of the return of a mail ballot. Sam stated the random test would satisfy him that the "Certification of Registration" report was unreliable and should not be considered by the Board. Page 2 — Canvassing Board Meeting, December 14, 2004 — Minutes The Board meeting recessed again. Sam accompanied Ethel to the Elections Office to conduct the test described above. The meeting reconvened at 4:04 p.m. Sam reported that the test confirmed that the same notation appeared on two randomly tested voters who were know to have not returned their absentee ballot. Each voter's "Certificate of Registration" showed a credit for voting in the 2004 General Election but the detail in their voting history read "Absentee Issued but not Returned." Sam offered his opinion that the "Certificate of Registration" form showed an incomplete report of voting history. Bill asked Sam if he was satisfied that the test proved no absentee ballot was returned by the voters in question. Sam stated that he was satisfied by the test that the "Certificate of Registration" report is unreliable. Bill then renewed his request to have a visual inspection conducted on the absentee ballots for Semiahmoo and Newhalem precincts. Sam then continued to clarify that the status detail given on the election computer system does satisfy him that no ballots were returned by the voters in question. Sam further commented that this is a reliable record of the voting history. Sam replied that he is not amenable to Bill's request because, as pointed out by Karen, such an exhaustive process is not consistent with the regular practice of the Board and Election staff in determining the status of the return of a mail ballot. Bill commented the State Supreme Court had ruled that election administrators were not to reconsider ballots previously rejected. Shirley cited RCW 29A.60.210, which authorizes election officials to re -canvass when a discrepancy or error is discovered. Shirley stated that the votes were validly cast and the voters should not be denied their rights because of an office error. Perry commented that, in the affidavit filed with the Supreme Court by the voter whose ballot was sent to King County, the voter states that he did not attempt to check the status of his provisional ballot until December 6. Perry argued that the voter "slept on his rights" by waiting so long to determine the status of his ballot. Sam asked how the voter's involvement mattered. Perry expressed the opinion that it is the voter's burden to make sure his/her ballot is counted. Barry pointed out that, in this instance, Whatcom County had not placed the status of this provisional ballot on the website so the voter would not have been able to check the status earlier if he had tried. Shirley commented that it was the Elections Office that made the error, not the voter. Debbie reiterated Barry's comment that the voter could not have accessed the status of his ballot if he had tried. Shirley again commented that the Elections Office had made the error, not the voter. Karen commented that this was a heavy burden to place on a voter. Bill suggested that a provisional voter's responsibility is greater than the regular voter. Amy brought up the seven provisional ballots accepted by the Board on December 6 and asked if any of those voters had attempted to access the status of their ballot. Shirley responded that David McEachran (Whatcom County Prosecuting Attorney) had based his acceptance of those ballots on the Board's duty to accept every valid ballot. Bill commented that none of those seven voters filed affidavits with the State Supreme Court. Barry responded that the filing of an affidavit was irrelevant. Sam moved that, based on RCW 29A.60.210, the Canvassing Board accept the ballots for counting. Karen seconded the motion. Sam stated that he had heard and understood the arguments presented by the Republican Party but that his opinion was not swayed. Sam read from RCW 29A.60.210 and commented that these ballots represent a discrepancy, which must be corrected as required by law. All voted in favor to accept and count the two provisional ballots. The Board signed a copy of each voter's Voting History, which showed their mail ballot had not been returned. Shirley opened the two sealed provisional envelopes and removed the ballots from the sealed security envelopes. The optical scan ballot from Skagit was voted for Gregoire. On the Whatcom County punch card, position number "91" was removed (Gregoire). Bill expressed appreciation for the Board's patience in hearing the arguments of the Republican Party. The ballots were placed in a sealed manila envelope and put in the transfer case labeled "Canvass Board." Shirley, Sam and Karen verified the seal number to be used to seal the case and signed the seal log. Page 3 — Canvassing Board Meeting, December 14, 2004 — Minutes The Board meeting recessed while Debbie and Tina returned to the Elections Office to finalize the certification reports. Tina returned to the meeting at 4:50 p.m. and the meeting reconvened. Tina informed the Board that the reports would take awhile longer to finalize. Barry addressed the Board and explained an issue which concerned the Democratic Party. Barry explained that nine (9) poll ballots voted at the Bellingham Senior Center should have been referred to the Board for review after counters discovered them on Saturday, December 11. These nine ballots each had "bulging" chads, which, in the opinion of the Democratic Party, formed a discernable pattern. Six of the ballots were from Bellingham precinct 93 and three ballots were from Bellingham precinct 13. Barry offered drawings made by the observers showing the pattern of bulging chads on each ballot. Barry commented that he had voted at the same poll location and, although he had used considerable force in punching his ballot, there remained many similar "bulging" chads on his ballot, which he had removed by hand. This problem was likely caused by the votomatic being too full of chads. Shirley explained the standards set in law by the state of Washington to determine what constitutes a vote. For punch card ballots, a chad must be detached on two corners. When there is no detachment, there is no legal authority to remove the chad and count the vote. These ballots did not have corners detached as the ballots reviewed on December 13 had. Discussion ensued regarding the method used by the Election staff to determine if review by the Canvassing Board is necessary. It was confirmed that Election staff decides whether or not the Board should review a ballot, not observers. The Board noted that only the Democratic Party wished for these ballots to be reviewed, not the Republican Party. Barry reiterated his request that the Board review these nine ballots. Sam asked for clarification of the events surrounding this situation on Saturday. Bill said that the observer at the table had objected to the ballots then the counters had asked for direction from staff. It was staff who determined how to proceed and the decision was made no review was necessary. Cory commented that, at the time, observers from both parties agreed to the determination. The team leaders present on Saturday were Bill (R) and Andrew (D). Sam asked if the observers had been granted veto power to require review of questioned ballots. Shirley stated observers did not have veto power and that only the Election staff made determinations on questioned ballots. Shirley and Debbie clarified the methods they used in making a determination on the ballots they examined. Shirley clarified that the observers are there to ensure that the workers are abiding by the law, but they do not have authority to forward ballots to the Board for review. Sam concluded that an observer would take note of an objection while counting and would then bring it to the Canvassing Board meeting, which would be the venue in which their objection could be heard. Amy stated that Andrew told Shirley of his objection and opinion that the ballots should be reviewed but Shirley had declined to send the ballots to the Board for review. Barry commented that the guidelines for processing damaged or unreadable ballots should be applied here. Amy, reading from RCW 29A.60.210, stated that an ascertainable pattern could be found on these ballots if the Board were given the opportunity to review them but the option was denied. Amy also pointed out that the ballot from Bellingham precinct 152, reviewed by the Board on December 13, had no apparent detachment. Bill commented that the Board was only asked to review ballots where the Auditor is not certain as to the voter's intent. It was clear that a procedure was in place to make this determination and the Election staff followed that procedure. The ballot from precinct 152 is an example of the Auditor being unable to ascertain the voter's intent. Debbie commented that the Election staff operates under the premise that they have been appointed by the Board as delegates to make determinations as they are able and only when they are unable to make a determination do they send a ballot to the Board for review. Debbie pointed out that questioning the determination made on these Page 4 — Canvassing Board Meeting, December 14, 2004 — Minutes ballots would open up the opportunity to question all determinations made throughout the entire process and the manual recount would have to be redone to satisfy that concern. Barry responded that these concerns were related to specific instances, not general determination practices. Amy read the guidelines regarding a discernable pattern on a ballot and, in the opinion of the Democratic Party, such a pattern was evident on these ballots. Sam stated that, rather than examining this specific instance, he wanted to have reassurance that the Election staff made determinations on questioned ballots on a level and fair playing field. Cory commented that the Republican Party had no problem with the determinations made by the Election staff. He had not observed any disagreements at the time these ballots were discovered. Cory also commented that, although observers did not have any veto power, the Election staff took observers' objections seriously during the process. Shirley described the standards used in making determinations on all 91,000+ ballots in the manual recount. The state has set clear standards on when to remove chads. Karen expressed concern over the issue of there being a discernable pattern. Bill commented that the Board is not allowed to base a pattern on multiple ballots. Barry and Amy stated that the ballots in question each had, in their opinion, an individually discernable pattern. Bill said the Board is only allowed to examine votes for the office of governor. Sam clarified that he does not feel the law restricts him from examining the whole ballot in order to determine if there is a discernable pattern. The counters were, however, instructed to look only at the punch positions in the gubernatorial race. Debbie affirmed that the counters only looked at punch positions 91, 92 and 93 but Election staff examined the whole ballot when making a determination regarding the existence of a discernable pattern. In order to get the Board to take action on this issue, Sam moved that the Board reconsider the nine questioned ballots from the poll at the Bellingham Senior Center. Karen seconded the motion. Sam then spoke against the motion and commented that granting the Democratic Party's request would require the Board to consider any objections brought forward by the Republican Party as well. Karen expressed concern that the Board should consider whatever the law requires them to consider. Shirley reiterated that it was up to the Election staff to make determinations on questioned ballots. Shirley further commented that a pattern would not be ascertainable on a ballot where some punch positions were removed and some were dimpled. Karen asked if the issue of pattern was addressed when the Election staff examined the ballots. Shirley stated that the issue of pattern was addressed at that time. Barry stated that he only wants the Board to review the nine ballots in question, not the entire election. Bill commented that each Election staff member, when making a determination on a questioned ballot, used the same standard. Barry argued that state law requires review when there is a deviation. Sam clarified that the "deviation" requirement was in Whatcom County guidelines, not state law. Barry replied that the guidelines cite the RCW as a reference and he asked that the Board do the right thing and follow the guidelines, which require a review of such ballots. Shirley stated that she felt the appropriate procedure was followed, that the Election staff did consider patterns and blank votes and made determinations based on consistent standards. Shirley felt that Election staff had reviewed these nine ballots appropriately. Karen asked why the ballots reviewed by the Board on December 13 had been referred but these nine were not. Debbie answered that those ballots did appear to have either a pattern or detachment. Karen voted in favor of the motion to review the nine ballots in question from the poll at Bellingham Senior Center. Shirley and Sam voted against the motion and the motion failed. Barry asked that the record reflect the Whatcom County Democratic Party officially protests the Board's decision. Debbie presented the certification forms to the Board. Shirley read the statistics from the certification form. Debbie presented the final report showing the official totals from the manual recount. Debbie explained the totals and discussion ensued. Page 5 — Canvassing Board Meeting, December 14, 2004 — Minutes Bill reaffirmed that the accounting process done by the Auditor's Office during the manual recount was efficient and provided for many checks on accuracy. Bill concurred that the report reflects the accurate totals of the manual recount. Debbie explained that five additional votes were counted in the manual count compared to the machine count, seven additional votes were included from the provisional ballots accepted on December 6 and two additional votes were included from the provisional ballots accepted on December 14. Barry asked that the record reflect the Whatcom County Democratic Party officially objects to the final totals based on the motion which was presented and failed. Shirley signed the Oath of County Auditor and all the Canvassing Board members signed the Certification of the Canvassing Board, certifying the manual recount. The Board members also signed the final Reconciliation report for the 2004 General Election Manual Recount. Debbie copied the seal log for the transfer case labeled "Canvass Board." The original log was placed in the case and the case was sealed with the seal number recorded on the log. Shirley presented to the Board the minutes from meetings on December 7 and 10. Karen did not attend those meetings. Sam moved to approve both the December 7 and December 10 minutes. Shirley seconded and all voted in favor. Sam and Shirley signed the minutes. Shirley explained the purpose of this meeting was to review ballots which were brought to the Canvassing Board's attention by the Election staff. Debbie left the room to retrieve the ballots from the Auditor's vault. Sam asked about the two provisional ballots requested from King County and Skagit County. Shirley confirmed that the ballots had been received in the Auditor's Office today. Sam asked if the Board could address those ballots today. Shirley stated that the parties wanted more notice of the Board's review of those ballots. Karen asked the status of the case pending in the State Supreme Court. Shirley stated that the court may order Election officials to re-examine ballots previously rejected by the Canvassing Board. The Board discussed this possibility. Meg commented that the goal of the court case is to ensure that no ballots were rejected inappropriately. Bill suggested that the Canvassing Board cease to discuss the matter at this time since this issue is not before the Board today. Debbie brought in a sealed transfer case containing the ballots for review. The case was labeled "12/11/04 To Canvass Board." Bill asked for confirmation that this case was the same as one re -sealed this morning. Debbie confirmed it was. Shirley, Sam and Karen compared the seal number on the case to the seal number on the seal log and signed the log. Debbie opened the transfer case and removed the ballots which were each sealed in a white envelope. Ballot #1— Bellingham 86 (Absentee) The voter appears to have punched out position number "91" then crossed it out and punched position number "93." A red "W' was written next to the "X" over punch position "91"which the Board assumed was placed by the Opening Board, same as the ballots examined on December 10. The Board discussed possible reasons for the blue scratch mark. Amy stated that, in her opinion, it was a cause for concern. Shirley suggested the Opening Board may have crossed out the "ok" after being told that they should not have written "ok" on the ballot. Karen suggested that the Board only look at the ballot in the way it was received from the voter, i.e. without the red "ok" and the blue "scratch." Sam moved to accept the vote for punch position "93." Karen seconded the motion and all voted in favor to accept the vote for position "93.". Ballot #2 — Bellingham 45 (Absentee) The ballot was received with several, but not all, voted punch position numbers circled. Punch position number "91" was also circled but the chad in that position was not punched out. Shirley stated that she believed the voter forgot to punch out the vote for position number "91." Sam stated that, since not all voted position numbers were circled, there was no consistent pattern and therefore he was not convinced that the voter intended to vote position "91" just because it was circled. Sam moved to leave the blank vote on this ballot. Karen seconded the motion. Amy asked the Board to more carefully examine the ballot up against the light to see the condition of the chad's perimeter. Each Board member examined the ballot, holding it up against the light. Karen noted a discernable difference in the perimeter of the chad in position "91." Bill asked Shirley to explain the standard set in law for determining what constitutes a vote. Shirley explained that the law requires a vote to be counted when, on a punchcard ballot, two or more corners of a chad are detached. Sam observed that, although there was a discernable difference in the perimeter of the chad, no corners were detached. Sam reiterated his motion to accept the blank vote and Karen seconded the motion. All voted in favor to accept the blank vote. Ballot #3 — Ferndale City 5 (Poll) None of the punches on this ballot line up with the chads. Shirley suggested that the voter probably did not push the ballot all the way into the votomatic machine. A punch was noted in equal proximity to both positions "91" and "92." Meg asked if any of the votes on that ballot would have been counted. Shirley commented that they would not if they didn't line up with the chad, but the Board is only considering the votes for the gubernatorial race at this time. Sam moved to leave this as a blank vote for the gubernatorial race. Karen seconded the motion and all voted in favor to accept the blank vote. Ballot #4 — Bellingham 152 (Poll) The chad in punch position "91" on this ballot appears to have 2 possibly detached corners. Sam commented that approximately five other chads on this ballot are identical in appearance to the chad in position "91." Karen noted an identifiable pattern on the ballot, given the other chads which were only partially detached. Karen made a motion to accept the vote for punch position "91." Shirley seconded the motion. Bill asked for more clarification of the "pattern" observed by the Board and commented that the Board is only reviewing votes in the gubernatorial race. Karen and Shirley confirmed that the Board is only reviewing votes in the gubernatorial race, however the Board is comparing all aspects of the ballot, including other chads, to identify a pattern that would reflect the will of the voter. Bill commented that he was not able to see the "detachment" on this ballot and asked the Board for further clarification of what constituted this "detachment." Meg suggested that votomatics in the polls were often full of chads which could account for the chads on this ballot not being fully punched out. Sam asked if the Board could confirm whether the other chads with a similar condition could be identified to determine if they would have been votes in other races. This would help the Board determine if there was indeed an identifiable pattern on how this ballot was voted. Tina brought in a Ballot Guide. The punch position numbers of the other similar chads were compared to the Ballot Guide and it was determined that all, except "233," were active punch positions in this election. Bill asked for further clarification of what corners were detached on the chad for punch position "91." Sam commented that he was not so much convinced by the "detachment" of the chad, but by the identifiable pattern established by the other similar chads on the ballot. Bill commented that, on the Ballot Guide in his possession, punch position "233" was a valid punch position in another race. Sam stated that Bill's comment made him further confident in believing there was an identifiable pattern on the ballot. Shirley and Karen noted that the bottom left and top left corners of the chad appeared to be detached. All members of the Board voted in favor of the motion to accept the vote in punch position "91." Shirley confirmed that the four ballots reviewed by the Board today would be added to the count totals for the manual recount. Shirley commented that the counting boards did an excellent job and the total number of ballots counted in the manual recount had only increased by one compared to the machine count. Bill offered a commendation from the Republican Party to the Whatcom County Auditor's Office. He complimented Shirley, the Election staff and the counting boards on an excellent job in this recount. He described Shirley as having a firm but polite hand in overseeing the process and thanked Shirley and the Election staff for being available and accessible and willing to give explanations to observers when requested. Bill expressed to the Canvassing Board a reassurance that the Whatcom County Auditor's Office conducted a professional operation and it was the best recount he had ever observed. In his opinion, Whatcom County had set the standard for how to conduct a recount. Amy concurred with Bill. Shirley also complimented the Election staff and the counting board workers. The four reviewed ballots were returned to the transfer case which was labeled "Canvass Board." Shirley, Karen and Sam verified the seal number to be used to seal the case and signed the seal log. Shirley called the meeting to order. Shirley explained the purpose of this meeting was to review two (2) absentee ballots which were brought to the Canvassing Board's attention by the Election staff. One ballot was from the Semiahmoo precinct. One ballot was from Lynden City 5. Only the punch positions for the office of Washington State Governor were addressed by the Board. Debbie explained that, on both of the two ballots, the voter appeared to have placed an "X" over punch position "91" and then punched position "92." A red "ok" was also placed next to the "X" over punch position "9L" Initially, the Election staff did not know the meaning of the red "ok" on the ballots. One of the counters working on the manual recount was also a member of the Opening Board who processed the absentee ballots. That person, Phyllis Graham, informed the Election staff that the Opening Board had been instructed to place a red "ok" next to a mark on any absentee ballot which needed to be duplicated to reflect the will of the voter. The Board initially assumed that after placing the red "ok" mark on the ballots, the ballots were placed with other ballots ready to be counted rather than placing them with ballots to be duplicated. Shirley made a motion to accept the ballot punch position as "92." Sam seconded the motion and discussion ensued. Sam suggested another possibility which is that the voter may have placed the red "ok" on the ballot to further clarify his/her intent not to vote "91." Debbie reiterated that a member of the Opening Board had stated that it was their practice to write "ok" in red on a ballot where the voter had placed an "X" over a punch position. Wyoming observed that the "ok" was written next to punch position "91" and may indicate the voter's attempt to communicate that punch position "91" was "ok" rather than punch position "92." Tina suggested that a voter who knew enough to cross out the "91" when it was punched in error would have known to cross out the "92" if they had changed their mind and wanted to select "9 L" The Board asked that Phyllis join the meeting to give her explanation in person. Page 1 — Canvassing Board Meeting, December 10, 2004 — Minutes Phyllis Graham (Democrat) joined the meeting and confirmed that it was the Opening Board who placed the red "ok" on each ballot. Phyllis explained the "ok" was to signify that the ballot should be duplicated. At that point,.the Board assumed that the Duplication Board (made up of Election staff members) had made an oversight by missing the "ok" on the two questioned ballots. Sam stated that he was satisfied with the assumption that the "ok" was placed on the ballots by the Opening Board. Angela asked Phyllis to clarify if she had personally witnessed a member of the Opening Board placing a red "ok" on a ballot. Phyllis stated that she had done so herself as a member of the Opening Board pursuant to the instructions she had been given. Shirley made a motion that, given the assumption that the Opening Board had placed the red "ok" on both ballots, the Canvassing Board should accept punch position "92" on both ballots. Sam seconded this motion and all voted in favor. Shirley informed the Board of two Whatcom County registered voters who were named in the lawsuit brought forth by the Democratic Party and currently being heard in the State Supreme Court. One voter voted by provisional ballot in Whatcom County and that ballot was forwarded to King County where it was rejected because his registration there had already been cancelled. Shirley has requested that King County return that ballot to Whatcom County to be reviewed by the Canvassing Board. The second voter voted by provisional ballot in Skagit County. That voter claims to have informed the poll worker that he/she was registered in Whatcom County, however no indication of that was made on the provisional ballot envelope so it was rejected by Skagit County since they did not have the voter registered there. Shirley has requested that ballot from Skagit County so that it could also be reviewed by the Whatcom County Canvassing Board. Both ballots will be addressed at the final meeting of the Canvassing Board. Shirley notified the Board that an order had been received from the Office of the Secretary of State to manually recount the votes cast for the office of Washington State Governor in the November 2, 2004 General Election pursuant to a request made by the Democratic Party. Shirley explained to the Board that the absentee ballots would be sorted into precincts beginning at 8:00 a.m. on Wednesday, December 8. The counting of ballots by hand would commence on Thursday, December 9. The Board discussed the process of the manual recount. Dave questioned Shirley about the amendment to the Canvassing Guidelines which was approved by the Canvassing Board on December 6. Shirley presented the approved amendment to the Board for review. Dave moved to begin sorting absentee ballots on Wednesday, December 8 at 8:00 a.m. and to being counting ballots by hand on Thursday, December 9 in Room 513 of the Whatcom County Courthouse in accordance with the amended Guidelines. Discussion followed regarding the arrangements which have been made for the counting boards. Shirley confirmed that only the Auditor will have a key to Room 513 so that ballots will not need to be moved from the room once counting has begun. Sam seconded the motion and all voted in favor. Shirley presented to the Board the Guidelines for Recount Observers which is based on state law as well as the Auditor's experience. Shirley summarized the Guidelines and discussion ensued. Shirley clarified that only one Democratic observer and one Republican observer will be allowed to sit at each table with the counters. If Libertarian observers wish to participate, they will also be allowed one observer per table. All other observers must remain in the back of the room and not interfere with the recount process. Dave moved to accept the Guidelines for Recount Observers. Shirley seconded the motion and all voted in favor. Shirley called the meeting to order. Shirley explained to the Board that seven sealed security envelopes containing provisional ballots had been discovered in partially opened provisional signature envelopes after the certifications of the General Election and of the mandatory machine recount for the office of governor. These seven provisional ballots had been inspected and approved but were incorrectly placed by the opening board among empty envelopes instead of the envelopes that contained the ballots. These ballots were not counted in the General Election nor in the first recount. The ballots have been locked in secure storage for the duration of time since they were inspected, except when they were in the possession of workers who discovered them while alphabetizing the provisional ballot envelopes after certification of the election. Shirley said there will be a change in policy so that, in future elections, the empty provisional ballot envelopes will be inspected for any ballots left in the envelopes prior to the certification of an election. The Board discussed the matter at length. Dave expressed the opinion that the whole goal of the Canvassing Board is to ensure that every legitimate vote is counted and that should legally be the position of the Board. Shirley and Dan agreed with Dave's opinion. Dan moved to accept the seven provisional ballots in the manual recount of the race for Washington State Governor. Dave seconded the motion and all voted in favor. The Board agreed that the seven provisional ballots should be brought to the meeting for review by the Board. Shirley brought the seven ballots to the Board in a sealed envelope. Shirley opened the envelope and counted seven provisional envelopes, each containing one ballot. The Board examined the provisional envelopes. The Board discussed the importance of setting aside these ballots in case there were any legal challenges to their being included in the recount. The Board also discussed the importance of keeping the seven voter's ballots secret. Shirley suggested the Board open the ballots and count them in this meeting. Dave and Dan agreed. Shirley opened each sealed security envelope and removed the enclosed ballot. The Board authorized the Auditor's staff to include the accepted ballots from today in the totals for the upcoming manual recount. The ballots would be set aside in case there was any legal challenge to their inclusion. After counting, the write-in stubs were removed from each ballot and all seven ballots were place in a transfer case. The precincts were listed on the transfer case label and a red "counted" sticker was placed on the case. The transfer case was named "12/6/04 Prov. Ballots." Shirley, Dave and Dan verified the seal number to be used to seal the case and signed the seal log. The original log was copied and then placed in the transfer case before the case was sealed. Shirley presented to the Board an amendment to the Whatcom County Canvassing Guidelines. The amendment is a new chapter outlining the procedures for a manual recount. The Board reviewed the amendment. Dave moved to accept the amendment, Dan seconded the motion and all voted in favor. The Board members signed the amendment. Shirley presented to the Board Guidelines for the observers of the manual recount. The Board reviewed and approved the Guidelines. The Board discussed who would be present at the next Canvassing Board meeting. With the beginning of a statewide hand recount days away, I am writing because the WSRP wants to help make sure that best practices are implemented on a uniform, statewide basis for the handling of ballots so that no voter is disenfranchised by the physical handling of their ballots, and that there is a complete and accurate count of all legal ballots. We appreciate the magnitude of the effort about to be undertaken, and that many of you may already have policies in place that address some or all of these concerns. The key contact persons for the WSRP and the Rossi campaign on these matters are Peter Schalestock (206-669-8811) and Travis Sines (425-241-4380). If you have any questions about this letter, please contact them. Our concerns about ballot degradation are greater with punch card ballots because of deterioration from repeated handling. However, the WSRP believes that a few simple steps can help avoid inadvertent disqualification of votes during the handling process for all types of ballots. Ballot handling All persons handling ballots as part of the manual recount should wear plastic gloves. This will reduce the risk of smudges from skin oils, dirt or other materials that may become lodged under a worker's fingernails. Plastic gloves will also reduce the risk of damage to punch card ballots from long, sharp or broken fingernails. Foreign and sharp objects should be kept away from the counting tables to prevent damage to punch card ballots. Each time ballots are run through machines or handled the risk of chads coming loose increases, as was seen during the 2000 Presidential recount. We believe the elections office should take all reasonable steps to reduce the risk of further damage or deterioration of ballots. Similarly, pens, markers, or other writing utensils should be kept away from the counting tables. They have the ability to pierce punch cards or cause stray, and possibly disqualifying marks on optical scan ballots. Observers The ballot recount process should both be and appear fair. The recount process should be transparent, with error on the side of making the physical inspection of ballots observable, and verifiable to observers from both parties, and the press. Representatives of the Republican Party have contacted or will be contacting you to arrange for observers to be present throughout the recount. The ability to observe the manual inspection of ballots should be meaningful. There should be adequate facilities to accommodate both election workers and observers. Distant, designated observer areas that may prevent observers from seeing what is actually happening at each counting station defeat the statutory right to observe the process. We believe that both the election workers and party observers are integral in the statutory scheme for counting ballots, and giving Washingtonians confidence in the result. NO. 76321-6 OPINION ORDER By a petition invoking this court's mandamus jurisdiction and a statute entitled "Prevention and correction of election frauds and errors," RCW 29A.68.011, No. 76321-6 PAGE 2 various electors and the Washington State Democratic Central Committee seek an order directing Secretary of State Sam Reed to promulgate "uniform standards" for the manual recount now taking place in the Washington State election for Governor. Their Motion and Brief in Support of Emergency Partial Relief specifies that three such sets of standards are being sought: (1) standards that ensure that all ballots rejected in previous counts are fully canvassed so that the hand recount produces as complete and accurate a tabulation as possible; (2) standards for evaluating previously -rejected signatures according to the more liberal standards applied in most counties; and (3) standards that allow party representatives to meaningfully witness the hand recount, by observing all actual ballots being counted. Petitioners thus argue that, contrary to current practice, in a manual recount election workers and canvassing boards must consider anew all ballots previously left uncounted, in keeping with their statutory duty to count all votes cast or each ballot cast, though their argument mainly focuses on rejections made on the basis that absentee and provisional ballot signatures do not match with signatures on file. They seem to suggest that this is necessary in part because King County improperly refused to permit voters to protest the decision not to count their ballots on November 17, 2004, the date the election results were certified. Petitioners further suggest that, contrary to the election statutes, including a statute that requires the Secretary to promulgate uniform election rules, the various counties now employ disparate tests and procedures for comparing signatures, with King County having a greater rejection rate than other counties that is statistically significant. And they suggest that the procedures in place for witnessing the recount are contrary to law, and that such witnesses must be given "a meaningful opportunity to be heard before erroneous government action finally disenfranchises a voter." This court- is mindful that it is the policy of the State of Washington "to encourage every eligible person to register to vote and to participate fully in all No. 76321-6 PAGE 3 elections." RCW 29A.04.205. "No right is more precious in a free country than that of having a voice in the election of those who make the laws under which, as good citizens, we must live. Other rights, even the most basic, are illusory if the right to vote is undermined." Wesberry v. Sanders, 376 U.S. 1, 17, 84 S.Ct. 526, 11 L. Ed. 2d 481 (1964). Nonetheless, we must reject petitioners' arguments. In this context, a "ballot" is a physical or electronic record of the choices of an individual voter, or the physical document on which the voter's choices are to be recorded. RCW 29A.04.008(1)(c),(d). "`Recount' means the process of retabulating ballots and producing amended election returns...." RCW 29A.04.139 (emphasis added). The procedure for recounts is set forth in RCW 29A.64.041, and starts with the county canvassing board opening "the sealed containers containing the ballots to be recounted." See RCW 29A.60.110. Thus, under Washington's statutory scheme, ballots are to be "retabulated" only if they have been previously counted or tallied, subject to the provisions of RCW 29A.60.210. It follows that this court cannot order the Secretary to establish standards for the recanvassing of ballots previously rejected in this election. And petitioners' call for uniform signature -checking standards (seemingly beyond the statutory require- ment that the signature on an absentee ballot be the same as the signature in voter registration files) is beyond the relief that can be afforded in this action.' Petitioners suggest in their reply brief that a claimed disparity in signature -checking standards implicates equal protection concerns under the privileges and immunities clause of our state constitution, CONST. art. I, § 19, but they claim no discriminatory intent. We are mindful that King County rejected a higher percentage of signatures than did other counties, but the record before us does not establish the reason for this disparity, and it ' RCW 29A.40.110(3) requires that the signature on an absentee ballot return envelope be "the same" as the signature in the voter registration files, as determined by the canvassing board or its designated representative, whereas WAC 434-253-047 requires a signature for a provisional ballot that "matches a voter registration record." No. 76321-6 PAGE 4 could be for factors other than the standard employed .2 We do not take petitioners' argument to suggest that a claimed disparity in rejection rates of voter signatures triggers some independent right, constitutional or otherwise, to a recanvassing of rejected ballots under a newly developed standard, nor does such an argument come to mind. Petitioners also seem to suggest that recanvassing of rejected ballots is necessary because the methods employed by King County to allow voters to rehabilitate rejected absentee and provisional ballots run afoul of Washington's statutory and regulatory scheme. But we find no support for this notion. We note that the county gave absentee voters who failed to sign their ballot affidavits until 4:30 p.m. on November 16, 2004, the day before certification, to sign and return the affidavits, in accordance with WAC 434-240-235. And although this regulation does not require as much, the county likewise permitted absentee voters with problem signatures until 4:30 p.m. on November 16 to provide an updated signature. The county's procedure for handling signature problems with respect to provisional ballots, which also specified a deadline of 4:30 p.m. on November 16, appears to comport with pertinent regulations and federal law, and petitioners do not persuasively suggest otherwise. Although, as petitioners point out, RCW 29A.60.190(1) provides that the election results should include absentee ballots Z We note in passing that the declaration of Dean C. Logan, Director of King County Records, Elections and Licensing Division, says that King County, like many other counties, looks for three points of similarity between the signatures on absentee and provisional ballot envelopes and the signatures on file. If staff finds less than three points of similarity, a supervisor looks at the signatures using the same three-point system. "If the supervisor also believes there is a question as to the validity of the signature, it is referred to the canvassing board for a determination." Petitioners have submitted the declaration of Joshua C. Jungman, who says that he and other Democratic staff members contacted county auditors to investigate the methods and procedures used to compare and verify signatures. Several auditor offices reported using the same three point method, with canvassing boards having the final say. Mr. Jungman suggests that in King County the decision "doesn't go to the canvassing board," but does not say who provided this information. Significantly, petitioners do not suggest that any particular method of signature verification is faulty, or what uniform method should be mandated by the Secretary. No. 76321-6 PAGE 5 postmarked on or before the date of the election and received on or before the date of certification, this statute does not address how ballots rejected for missing or invalid signatures are to be handled. As for petitioners' request that we order the Secretary to promulgate "standards that allow party representatives to meaningfully witness the hand recount," we are not convinced that such standards are presently lacking. RCW 29A.64.041 provides that the recount may be observed by persons representing the candidates, that these witnesses may make no record of the names, addresses, or information on the ballots, poll books, or applications for absentee ballots unless authorized by the superior court, and that the Secretary or county auditor may limit the number of observers to not less than two on each side if, in his or her opinion, a greater number would cause undue delay or disruption of the recount process. Petitioners provide no support for their suggestion that witnesses or observers are participants who have a right to be heard and influence this manual recount process. For the foregoing reasons, we reject petitioners' arguments and deny their petition for mandamus and request for relief under RCW 29A.68.011. Specifically, we request that you recanvass and tabulate the ballots from the voters who confirm, by the attached declarations or in person, that they are properly registered voters who signed and timely cast ballots in this election. Attached for you convenience is the Supreme Court's decision in Washington State Republican Party, et al., v. King County Division of Records, Elections, and Licensing Services, et al., No. 76399-2 (December 22, 2004). As you will see, the Supreme Court has determined that, under RCW 29A.60.210, "a canvassing board may decide that ballots should be recanvassed before certification of a recount." Id. at 3. Such a recanvass is appropriate where there is "an apparent discrepancy or an inconsistency in the returns" which the Court specifically held to include "something to indicate that an error or a mistake has been made; that the total as shown is not the true one." Id at 4, quoting with approval State ex rel. Doyle v. Superior Court of King County, 138 Wash. 488, 244 Pac. 702 (1926). According to the Court, the final day for such recanvassing is the date on which the Secretary of State certifies the final results from all counties in the manual recount. Id at 3 n.2. The attached declarations demonstrate that valid ballots were mistakenly rejected; they demonstrate conclusively that "an error or a mistake has been made" and that the existing tallies of ballots are not the "true" tallies of valid ballots cast. Your existing returns are "at odds with other evidence," id. at 5, now before you. It was our understanding and our reading of the relevant statutes, prior to the Supreme Court's recent decision, that these ballots could not be recanvassed. NO. 76399-2 OPINION ALEXANDER, C.J.—During the hand recount in the 2004 Washington State election for Governor, the King County Canvassing Board discovered that some 573 ballots had been coded by election workers as having "no signature on file" after the workers found no signatures of the voters casting those ballots in the County's electronic elections database. But the workers had failed to check for signatures elsewhere, such as the voters' original registration forms, the archive of images from No. 76399-2 PAGE 2 the County's old electronic registration system, and the registration records maintained by the Secretary of State. At its December 15, 2004, meeting, the canvassing board decided to recanvass these ballots pursuant to RCW 29A.60.210 to determine whether the failure to count the ballots in the Governor's race was erroneous. The next day, the Washington State Republican Party, Christopher Vance, and Jane Milhans filed in Pierce County Superior Court this action for declaratory and injunctive relief against the canvassing board and the King County Division of Records, Elections and Licensing Services, and sought a temporary restraining order prohibiting recanvassing of the 573 ballots. On December 17, 2004, after a hearing on the request for a restraining order, the Pierce County Superior Court issued the requested order. The court concluded that "RCW 29A.60.210 does not apply in this context." Now, the Washington State Democratic Central Committee, an intervenor below, seeks direct review of the superior court's order, arguing that the King County Canvassing Board properly concluded that RCW 29A.60.210 permits recanvassing of the 573 ballots.' The canvassing board joins in that request, as does the Secretary of State, who is the chief elections officer of the State and who also intervened below. We grant review and reverse the superior court. This hand recount of ballots came before the court very recently in a case involving whether a recount necessarily involves a recanvassmg of previously - rejected ballots. In our decision in that case, issued December 14, 2004, we held that under Washington's recount statute, "ballots are to be `retabulated' only if they have been previously counted or tallied, subject to the provisions of RCW 29A.60.210." ' The Washington State Democratic Central Committee initiated this review by filing a notice of appeal directed to this court, a statement of grounds for direct review, and a motion for accelerated review. Because the superior court's decision is not a final judgment or other decision subject to appeal under RAP 2.2(a), we redesignate the Democratic Central Committee's notice as a notice for discretionary review. RAP 5.1(c). Thus, the superior court's decision is subject to review under the criteria of RAP 2.3(b). No. 76399-2 PAGE 3 (Emphasis added.) The quoted language, referencing the "recanvassing" statute, RCW 29A.60.210, acknowledges that under proper circumstances a canvassing board may decide that ballots should be recanvassed before certification of a recount. Indeed, the Secretary of State's Director of Elections, Nick Handy, has provided this court with a detailed declaration explaining how other counties have already employed RCW 29A.60.210 to count votes from ballots not counted in the original returns for this election. Our prior opinion did not hold that the recanvassing statute may not be employed by canvassing boards during a recount.2 The question here is thus whether RCW 29A.60.210 authorized the King County Canvassing Board to recanvass the 573 ballots in question. RCW 29A.60.210 provides in part: Whenever the canvassing board finds that there is an apparent discrepancy or an inconsistency in the returns of a primary or election, the board may recanvass the ballots or voting devices in any precincts of the county. Since this statute permits recanvassing, the statutory definition of "canvassing" is also pertinent. RCW 29A.04.013 provides: "Canvassing" means the process of examining ballots or groups of ballots, subtotals, and cumulative totals in order to determine the official returns of a primary or general election and includes the tabulation of any votes that were not tabulated at the precinct or in a counting center on the day of the primary or election. And although our election statutes do not define "returns," RCW 29A.60.120(3) provides that the "official returns" are "[t]he returns produced by the vote tallying system, to which have been added the counts of questioned ballots, write-in votes, and absentee votes." 2 While RCW 29A.60.210 requires recanvassing prior to certification of an election, and RCW 29A.60.190 speaks of certification occurring on the fifteenth day following a general election, it is clear to us that whenever a recount occurs, amended abstracts are certified that supersede any prior abstract of the results. RCW 29A.64.061. The statute does not define "certification," but the regulations promulgated by the Secretary of State make clear that certification involves the preparation and transmission of abstracts of votes to the Secretary of State. See WAC 434-262-010, -020, and -080. No. 76399-2 PAGE 4 As noted, the King County Canvassing Board says that these 573 ballots were previously coded by election employees as having "no signature on file." The board has now concluded that this designation may have been in error, since election workers failed to check the signatures against voter records on file, as required by RCW 29A.40.110(3) and King County rules for this election. The board has therefore decided to recanvass the ballots and correct any such errors that it finds. Respondents suggest that there may have been some impropriety involved in this decision, or that the ballots involved might have been tampered with, but point to no facts supporting such a conclusion.3 The question becomes whether the type of error thus identified amounts to "an apparent discrepancy or an inconsistency in the returns" of the election, as contemplated in RCW 29A.60.210. This court has issued but one opinion construing the recanvassing statute. See State ex rel. Doyle v. Superior Court of King County, 138 Wash. 488, 244 Pac. 702 (1926). The version of the statute then in effect permitted the opening of voting machines to recanvass the vote "whenever it shall appear that there is a discrepancy in the returns of any election district ...." In Doyle all votes tallied, but some returns were not made in both words and figures and in ink, as required by statute. Given these facts, this court found it "quite evident that there is no disagreement or discordance upon the returns made by the precinct officers." Informed by a dictionary definition of the word "discrepancy," it concluded that "[a] discrepancy referred to by the statute would be something to indicate that an error or a mistake has been made; that the total as shown is not a true one." Doyle, 138 Wash. at 492. No. 76399-2 PAGE 5 [t]here is no claim that there is any difference between the number of persons who voted and the number of votes cast. Neither is it claimed that any total shown on any return is incorrect.... Nor is there any claim that if the counter compartment were opened it would show details different from those contained upon the returns. Nor is there any claim that the returns as made are actually incorrect. Id. Here, by contrast, the canvassing board has concluded that the returns as made may indeed be "actually incorrect." The board also says that finther examination of the ballots under question may well show details "different from those contained upon the returns." When election workers found no matching signatures for these ballots in the county's electronic voter files, the ballots were apparently set aside to check for signatures elsewhere, including original paper registration forms. But this was never done. Instead, the ballots were described to the canvassing board and not counted in the returns as votes. Respondents would have us narrowly construe "an apparent discrepancy or an inconsistency in the returns" to mean only an arithmetic error disclosed on the face of the returns. But this is contrary to Doyle, which speaks in terms of "incorrect" returns and returns at odds with other evidence. Moreover, since the statute permits recanvassing, it is instructive to remember that canvassing involves "examining ballots or groups of ballots, subtotals, and cumulative totals in order to determine the official returns," RCW 29A.04.013. Here, certain ballots were coded as having "no signature on file" without having been fully examined to properly place them in that category. In that sense they were never fully canvassed, and the seeming error in placing them in any category has become evident to the King County Canvassing No. 76399-2 PAGE 6 Board. Under Doyle this is just the sort of apparent discrepancy or inconsistency that the board can correct through recanvassing.4 It thus follows that the superior court erred in granting a temporary restraining order, and that the King County Canvassing Board properly concluded that it had authority to recanvass the subject ballots pursuant to RCW 29A.60.210. Based on the law as declared in this opinion, respondents are not entitled to injunctive relief. Therefore, the superior court's "Temporary Restraining Order and Order to Show Cause" is reversed and vacated, and the cause is remanded to the superior court for entry of an order of dismissal forthwith. CHIEF JUSTICE 4 Our decision accords with the only analogous out-of-state authority cited to us, Comley ex rel. Harrison v Wilson, 116 Conn. 36, 163 A. 465 (1932). The court there held that in using the phrase "discrepancy in the returns" the legislature "could hardly have intended only a discrepancy apparent by comparison of the respective votes cast for the different offices or officers as they appear in the moderator's return." Comley, at 42. Rather, the legislature must have intended reference to the figures giving the total number who have voted, "for only in this way could there be any definite information indicating the failure of the machine to register votes for the candidates as a whole or for those of any one party." The 'county Auditor's Office will begin a manual hand re- count today of the more than 91,000 ballots cast in the Nov 2 election. With Republican Dino Rossi leading Democrat Christine Gre- goire by only 42 votes after the machine recount, each ballot cast in the state will be under scrutiny from election workers, party officials and others. "Our observers so far have lrnown the rules and adhered to the guidelines, but when the staff is working with ob- servers, there is some pres- sure," said Auditor Shirley Forslof. "If anyone sits and looks over your shoulder while you're working, you'd probably feel a little different than when you're working alone."
