YES 4 NO 4 FINAL CANVASSING BOARD MEETING FEBRUARY 13, 2004 FOR THE FEBRUARY 3, 2004 SPECIAL ELECTION AND DIKING DISTRICT 1 SPECIAL ELECTION MINUTES February 13, 2004 Meeting began: 2:00 p.m. In attendance: Shirley Forslof, Whatcom County Auditor (Canvassing Board Member) Dave Grant, Civil Prosecuting Attorney (Canvassing Board Member) Sam Crawford, County Council Member (Canvassing Board Member) Rich Griffith, Chief Deputy Auditor Tina Padilla, Auditor's staff The meeting was held in the Council Committee room. Shirley called the meeting to order. Shirley presented to the Board the revised Special, Absentee, and Poll Ballot Canvass Report. Dave moved to accept the Special, Absentee, and Poll Ballot Canvass Report and the motion was passed. The Canvassing Board members signed the report. Shirley presented to the Board a revised Absentee Ballot Reconciliation Report which included the ballots counted since the last meeting. Dave moved to accept the Absentee Ballot Reconciliation Report and the motion was passed. The Canvassing Board members signed the report. The Board discussed the statistics shown on the Precinct Abstract Report and the Special Election Summary Report, paying special attention to the turnout of absentee voters in this election. The Canvassing Board members signed the Official Election Returns and the Canvassing reports for the following resolutions: (1) Annexation of the City of Blaine into Fire Protection District No. 13 (passed); (2) Bellingham School District #501 M & O Levy and Tech Levy (passed); (3) Concrete School District #11 Levy (totals only); (4) Lynden School District #504 Levy (passed); (5) Mt. Baker School District #507 Levy (passed); (6) Blaine School District #503 Levy (passed); (7) Nooksack Valley School District #506 Levy (passed); and (8) Meridian School District #505 Levy (failed). Page 1 — Final Canvassing Board Meeting February 13, 2004 (Minutes) Shirley presented to the Board the Official Canvass of the Diking District 1 Election and the Ditch, Diking, Drainage, Consolidated Drainage Improvement, and Flood Control Special District Elections. The Board reviewed the vote tally sheet from the Diking District 1 Election and compared the totals to the Canvassing Certificate. Shirley explained that, according to RCW 85.38.115, no election was required for the other special districts since no or no more than one candidate filed in any position up for election. The one person filing is considered to have been elected to the position at the February 3, 2004 Special Election that otherwise would have taken place for such position. Shirley, Sam and Dave signed the Official Canvass of the Diking District 1 Election and the Ditch, Diking, Drainage, Consolidated Drainage Improvement, and Flood Control Special District Elections. The Board discussed the timeline and procedures for the upcoming election of a County Charter Review Commission. Dave moved to adjourn and the motion passed. The Canvassing Board meeting adjourned at 2:45 p.m. Page 2 — Final Canvassing Board Meeting February 13, 2004 (Minutes) CANVASSING BOARD MEETING FEBRUARY 11, 2004 FOR THE FEBRUARY 3, 2004 SPECIAL ELECTION AND DIKING DISTRICT 1 SPECIAL ELECTION MINUTES February 11, 2004 Meeting began: 2:00 p.m. In attendance: Shirley Forslof, Whatcom County Auditor (Canvassing Board Member) Dave Grant, Civil Prosecuting Attorney (Canvassing Board Member) Sam Crawford, County Council Member (Canvassing Board Member) Rich Griffith, Chief Deputy Auditor Tina Padilla, Auditor staff Ethel Heyrend, Auditor staff Joyce Herrin, Auditor staff Shirley called the meeting to order. Shirley presented to the Board the Election Night Poll Ballot Reconciliation Report which showed a variance of 10 ballots. The Board reviewed the Report paying specific attention to the Meridian School District race. Rich explained that none of the precincts which voted on the Meridian School District race had a variance so that the Meridian School District race was not affected by the variance. Sam moved to accept the Poll Ballot Reconciliation Report and the Canvassing Board members signed the report. Shirley presented to the Board the Absentee Ballot Reconciliation Report which showed a variance of two ballots. Sam moved to accept the Absentee Ballot Reconciliation Report and the Canvassing Board members signed the report. Shirley presented the Special, Absentee, and Poll Ballot Canvass Report and the Canvassing Board reviewed each ballot on the list. Ballot # and Vote: Absentee #1 Rejected —ballot from 2003 General Election Absentee #175 Rejected —signature did not match Absentee #176 Rejected— signature did not match Sam moved to accept the Special, Absentee, and Poll Ballot Canvass Report and the Canvassing Board members signed the report. Shirley opened the transfer case labeled "DD1" and presented to the Board the questioned ballots from the Diking District 1 Election. The Board accepted 6 ballots which were returned without authorization paperwork but with the oath signed. The Board accepted 1 ballot which was returned with the oath signed and incomplete authorization paperwork. Staff informed the Board that a letter was sent to the voter who returned their ballot without signing the oath. The Board agreed to wait until Friday to reject this ballot so that the voter would have the opportunity to sign. Page 1 —Canvassing Board February 11, 2004 (Minutes) Sam moved to authorize the Auditor's staff to count the accepted ballots from the Diking District 1 Election and the Board agreed unanimously. The ballots were returned to the transfer case labeled "DD1" and Ethel and Joyce took the transfer case to the Auditor's Office ballot processing room to count the ballots. The next canvassing board meeting will be at 2:00 p.m. on February 13, 2004. They asked me if Dave Hall was authorized to use the Maroon County Van. I said yes. I confirmed with Sergeant Felmley that Dave Hall was my employee and was authorized to use the van. I also informed Sergeant Felmley that I had checked out the van with Veronica with Whatcom County Public Works Motor pool. They said that they would release Dave and that he was arrested and treated the same as any person who was reported driving a stolen vehicle. Sergeant Felmley told me that Larry Nims with the Jail Alternative Program had reported the van missing and the County Motor Pool did not have a record that I had rented this particular van. I phoned Sheriff Bill Elfo to let him know what happened. He said that he would look into the matter. At approximately 11:20 a.m. on 2/3/04, I reported, in person the incident to Randall Watts, Chief Deputy Prosecuting Attorney. I heard from Dave Hall at approximately 12:00 p.m. He said that a woman Police Officer had her hand on her gun and asked him to get into the van. Shortly thereafter, another police car pulled up in front of the van. The officer asked him to get out of the van and the women police officer handcuffed Dave. Dave persuaded the male police officer to call me. That is when I verified that Dave was an Auditor's Office Employee and authorized to drive the van. Dave Hall said that being arrested and hand cuffed would be an experience to relate to his grandchildren. He said that he would continue posting signs on mailboxes and be back in the Auditor's Office after 5:00 p.m. on February 3. Subsequently I found out that at 6:00 a.m. Tina Padilla, Auditor's Office Co -Coordinator had gone looking for the van. This particular van was located in close proximity to the Auditor's Election Van. The key fit and she started the van. It died as she was pulling out on Lottie Street from the County's Parking lot off of Lottie Street. She left the van in the parking lot and took the Election Van to Sudden Valley. Subsequently she gave the keys to the maroon van to Dave. He got into the van, started it and proceeded to place signs on mailboxes. Bill Elfo and Wendy Jones requested Dave's home phone number so they could call him.
