within the District, to maintain current educational
program funding levels and support the District's
educational programs, student services and

1. Remember to SIGN YOUR NAME on the outside of
the MAILING envelope on the line under the Voter
Affidavit. Your signature is compared to your
signature on file with the County. If you are unable to
sign your name, you must make an identifying mark
and have two people sign as witnesses next to your
mark.
2.In the Ballot Guide, to the right of each measure or
candidate, is a number which is assigned to a
position on your Ballot Card.
3. Use a paper clip, tooth pick or sharp pencil to punch
out the pre -scored square located just above the
number assigned to the candidate or measure.
4. Write in candidates may be voted for by using the
space provided on the flap attached to your ballot
card. You must list both the Name and Office of the
write-in candidate and the Political Party in Partisan
races. Do not punch out a position number for any
other candidate for that office.
5. After you have finished voting, place your Ballot
Card in the Ballot Security Envelope.
6. Place the Ballot Security Envelope containing your

7. Put a first-class stamp on the envelope and mail it so
it is postmarked no later than the day of the eler

FINAL CANVASSING BOARD MEETING MAY 7, 2004 FOR THE
APRIL 27, 2004 MERIDIAN SCHOOL DISTRICT LEVY ELECTION
MINUTES
May 7, 2004
Meeting began: 2:00 p.m.
In attendance: Shirley Forslof, Whatcom County Auditor (Canvassing Board Member)
Dave Grant, Civil Prosecuting Attorney (Canvassing Board Member)
Sam Crawford, County Council Member (Canvassing Board Member)
Rich Griffith, Chief Deputy Auditor
Tina Padilla, Auditor's staff
Charles Crabtree, Public Observer
Joe Elenbaas, Public Observer
The meeting was held in the County Council Committee Room.
Shirley called the meeting to order.
Shirley presented to the Board the Election Night Poll Ballot Reconciliation Report, the Precinct
Abstract Report with the Absentee Ballot Summary attached, and the Special, Absentee, and Poll
Ballot Canvass Report. The Board discussed the reports. Shirley moved to accept the reports
and all members voted in favor. The Canvassing Board members signed the reports.
Shirley presented to the Board an Over Votes, Under Votes and Blank Votes report and the
Board reviewed the figures on the report. Dave moved to accept the report. Sam seconded the
motion. All members voted in favor and signed the report.
Shirley presented to the Board the Special Election Summary Reports and the Board discussed
the statistics shown on that report and the Precinct Abstract Report.
Shirley presented the Official Canvass document for the Meridian School District Levy election
which showed that the levy initiative passed.
Sam presented to the Board a letter from Joe Elenbaas which all of the Board members had
previously reviewed. The letter challenged the validity of the election. Sam asked that the Board
address Mr. Elenbaas' concerns prior to signing the Official Canvass. Shirley described the steps
taken in conducting the election. Mr. Elenbaas questioned whether or not the deeming of an
emergency was documented in the election file. Dave stated that he did not see any flaws in the
process of this election and moved to accept and sign the final returns. Shirley seconded the
motion. Sam withheld voting to ask a question. Sam asked if it was the role of the Canvassing
Board to determine the validity of the election. Dave reiterated that he did not see any flaws in
how the election had been conducted but he declined to comment; as a Canvassing Board
member, on whether or not the Board had the power to determine the election's validity. Shirley

clarified the Board's role by reading the language of the Oath in the Official Canvass document.
After this discussion, Sam voted in favor of signing the final returns and emphasized that he was
not comfortable signing a document until he had been given the opportunity to question and
understand what he was agreeing to. The Board members signed the Official Canvass document.
Shirley moved to adjourn and the motion passed.
The Canvassing Board meeting adjourned at 2:30 p.m.

Re: Minutes of May 7* Canvass Board
Shirley,
Thank yam for supplying minates of subject meeting. Being present at said meeting, I have
some question as to the accuracy of same.
Specifically, in the last paragraph of page one, it is stated "...Dave reiterated that he did not
see any !laws in bow the eketion had been conducted but he declined to comment, as a
Canvassing Board member...", which is quite a bit different than it seemed at the time. Is
fact, it appmvd that Mr. Grant gave ample comment, even legal arguments, from a

It would also appear relevant to demonstrate in what capacity Mr. Grant's comments and
answers were — was he speaking as the member representing the Prosecutor, as the counsel
defending actions of the Auditor, or as the counsel of the Legislative representative
answering queries posed by said individual?
What would be easiest to clear this up would be provision of the tape of said meeting. You
might review it yourself to dear up what appears to be at the very least, a somewhat
obfuscated version of the mectins content.

As to your request for a further explanation of the "basis in law" for my comments, I

Nice move David, with your comments about implicit/explicit "deeming". That would nicely be used as a ruse
where mistakes could be/are made, and/or be the excuse herewith as an effort to avoid an outright potentially
prosecutable violation by the Election Official and yet do an end run around fulfilling one's duty under the law.
Would Ms. Forslof have accepted the resolution from the District without the "emergency" language included
because you advised her that their delivery demonstrated an "implicit" intent to use the "emergency" clause. I
think not. 1 also believe that the law demonstrates a need for an action on the part of the "deeming" that
becomes part of the record so as to hold parties responsible for their duty/actions. Of course, if you are correct,
there will exist language/written policy that demonstrates the correctness of your assertion. Please supply it!
You see David, this is not a matter of standing in the way of any bona fide political subdivision requesting a ballot
issue as the law contemplates — but rather an expectation that using the "emergency" provisions requires strict
compliance by all parties relative an allowance that grants special privilege to the applicant and additional
exposure to the taxpayer.
I would reiterate as it relates to your ability to discern as a canvass board what ballots should be counted and
Mich ones should be disqualified — it is just as easy to disqualify a ballot distributed inappropriately as it is to do
so for a party voting in the wrong precinct.
Please provide at the earliest time possible, your basis in law for the "implicit" approval you asserted. Further, it
is herewith requested that a copy of the minutes be made available.

WHEREAS, the money in and to be paid into the General Fund of Meridian School
District No. 505, Whatcom County, Washington (the "District"), during the 2004-2005,
2005-2006, 2006-2007, 2007-2008, and 2008-2009 school years will be insufficient to enable
the District to pay for necessary maintenance and operation expenses and to properly meet
the educational needs of the students attending District schools; and
WHEREAS, in order to properly provide for such maintenance and operation expenses
and to meet such educational needs, the Board of Directors of Meridian School District No.
505, Whatcom County, Washington (the "Board of Directors"), deems it necessary to levy
the following taxes for the District's General Fund upon all of the taxable property within the
District in excess of the maximum annual tax levy permitted by law to be levied within the
District without a vote of the electors:
A. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,820,000, said levy to be made in 2004 for
collection in 2005; and

2008-2009 school years by incurring indebtedness by the issuance of short term obligations
against the General Fund of the District, as authorized by RCW 39.50, and may expend the
proceeds of said levies to pay such part of the general expenses of maintenance and operation
of the District during such school years as may be authorized or allowed by law for the use of
excess levy funds.
Section 2. It is hereby found and declared that an emergency exists requiring the
submission to the qualified electors of the District of the proposition as to whether or not the
District shall levy such excess taxes for their ratification or rejection at a special election to
be held therein on April 27, 2004.
The Whatcom County Auditor, as supervisor of elections in Whatcom County, Washington,
is hereby requested to find the existence of such an emergency and to call and conduct said
special election to be held within the District on said date and to submit to the qualified
