Bond Election . . . . . . . . . . . . . . . 4 *This Table of Contents is not a part of the following resolution. -i- CMW019/03 RESOLUTION NO. 17-87 A RESOLUTION of the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, providing for the sub- mission to the qualified electors of the school district at a special election to be held therein on February 2, 1988, of a proposition for the issuance of its general obligation bonds in the aggregate principal amount of $300,000 for the purpose of pro- viding funds to acquire, construct, equip and make certain capital improvements to the facilities of the school district. WHEREAS, improvements to school facilities are needed in Meridian School District No. 505, Whatcom County, Washington, (the "District") in order to provide the students of the District with adequate, proper and safe educational facilities; and WHEREAS, in order to provide funds to enable the District to acquire, construct, equip and make such necessary capital im- provements to its existing facilities and add new facilities, it is deemed necessary and advisable that the District issue and sell its unlimited tax levy general obligation bonds in the principal amount of $300,000; and WHEREAS, the Constitution and laws of the State of Washing- ton provide that the question of whether or not such bonds may be issued and sold for such purposes must be submitted to the qualified electors of the District for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, as follows: Section 1. Findings. This Board of Directors (the "Board") hereby finds and declares that the best interest of the students and other inhabitants of the District requires the District to carry out the plans hereinafter provided at the time or times and in the order deemed most necessary and advisable by the Board. Section 2. Ca ital Im rovements. The District shall: (1) construct and equip an addition to the library at Meridian Middle School, (2) construct an all-weather track at Meridian High School; (3) construct a storage addition to the gymnasium at Meridian Middle School; (4) Construct a building for storage and restrooms at Meridian High School; and (5) Install a ventilation system in the gymnasium at Meridian High School. The cost of all necessary architectural, engineering, legal and other consulting services, inspection and testing, adminis- trative and relocation expenses, costs of issuance and other statutorily authorized costs incurred in connection with the making of the foregoing capital improvements shall be deemed a part of the costs of such improvements. Such improvements shall be complete with all necessary furniture, equipment and appurtenances. If available funds are sufficient, the District shall acquire, construct, equip and make other capital improvements to the facilities of the District, all as the Board of Directors finds necessary. The Board shall determine the application of available moneys as between the various projects set forth above so as to accomplish, as nearly as may be, all improvements described or provided for in this section. The Board shall determine the exact extent and specifications for construction of structures or other improvements. If the Board shall determine that it has become impossible or impractical to accomplish any one or more of such improvements or portions thereof by reasons, including but not limited to, changed conditions, incompatible development, costs substantially in excess of the amount of bond proceeds estimated to be applied thereto, or acquisition by a superior governmental authority, the Board shall not be required to -2- CMWO19/03 accomplish such improvement and may apply bond proceeds as set forth in this section. If any or all of the improvements have either been completed, or their completion duly provided for, or their completion found to be impossible or impractical, the District may apply the bond proceeds or any portion thereof to other portions of the improvements or to other capital purposes of the District or to redemption of the bonds (hereinafter authorized) as the Board in its discretion shall determine. In the event that the proceeds of sale of the bonds, plus any other moneys of the District legally available, are insufficient to accomplish all of the capital improvements provided by this section, the District shall use the available funds for paying the cost of those improvements for which the bonds were approved deemed by the Board most necessary and to the best interest of the District. Section 3. Authorization of Bonds. For the purpose of providing part of the funds necessary to pay the costs described in Section 2 hereof, the District shall issue and sell its unlimited tax levy general obligation bonds in the principal amount of not to exceed $300,000. The balance of the cost of such improvements shall be paid out of any moneys now in, or to be paid into, the District's Capital Projects Fund, out of moneys which the District now has or may later have on hand which are legally available for such purposes and out of possible grants of money from the State of Washington or the United States. None of said bond proceeds shall be used for the replacement of equipment or for any other than a capital purpose. Such bonds shall be issued in an amount not exceeding the amount approved by the qualified electors of the District as required by the Constitu- tion and laws of the State of Washington. Section 4. Details of Bonds. The bonds provided for in Section 3 hereof shall be sold in such amounts and at such time -3- CMWO19/03 or times as deemed necessary and advisable by this Board and as permitted by law, shall bear interest at a rate of not to exceed the maximum rate permitted by law at the time the bonds are sold, and shall mature in such amounts and at such time or times within a maximum term of five years from date of issue, but may mature at an earlier date or dates, as authorized by the Board of the District and provided by law. Said bonds shall be general obligations of the District and, unless paid from other sources, both principal thereof and interest thereon shall be payable out of annual tax levies to be made upon all the taxable property within the District without limitation as to rate or amount. The exact date, form, terms and maturities of said bonds shall be as hereafter fixed by resolution of the Board of Directors. After voter approval of the bond proposition and in anticipation of the issuance of such bonds, the District may issue short term obliga- tions as authorized and provided by Chapter 39.50 RCW. Section 5. Bond Election. It is hereby found and declared that an emergency exists requiring the District to submit to the qualified electors of the District the proposition of whether or not the District shall issue such bonds for such purposes at a special election to be held therein on the 2nd day of February, 1988. The Whatcom County Auditor as ex 'officio supervisor of elections is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth. The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition to the Whatcom County Auditor in the following form: -4- CMWO19/03 PROPOSITION NO. 2 MERIDIAN SCHOOL DISTRICT NO. 505 GENERAL OBLIGATION BONDS - $300,000 To construct a library addition and gymnasium storage addition at Meridian Middle School and an all-weather track, storage building and gymnasium ventilation system at Meridian High School and other capital improvements, shall Meridian School District No. 505 issue $300,000 of general obli- gation bonds payable, both principal and interest, out of annual property tax levies in excess of constitutional or statutory limitations, maturing within a maximum term of five years, as provided in District Resolution No. 17-87 ? WHEREAS, the money in and to be paid into the General Fund of Meridian School District No. 505, Whatcom County, Washington during the 1988-89, 1989-90 and 1990-91 school years will be insufficient to enable the District to take care of all of its necessary financial obligations and to properly meet the educational needs of students attending the District schools; and WHEREAS, in order to properly provide for said financial obligations and educational needs of the District for the next two successive school years, it is deemed necessary that a tax of approximately $2.56 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $395,000 for the District's General Fund be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1988 for collection in 1989 and that a tax of approximately $2.63 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $413,000 for the Districts General Fund be levied upon all of the taxable property within the District in excess of the maximum annual levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1989 for collection in 1990; and WHEREAS, the Constitution and laws of the State of Washington require that the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, as follows: Section 1. In order to provide $395,000 for the General Fund of the District, a tax of approximately $2.56 per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1988 for collection in 1989 upon all the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors and that in order to provide $413,000 for the General Fund of the District, a tax of approximately $2.63 per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1989 for collection in 1990 upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors. Upon approval by the voters of Proposition No. 1 hereinafter set forth, the District may use the proceeds of such levy during the 1988-lY89, 1989-90 and 1990-91 school years by incurring an indebtedness by the issuance of warrants against the General Fund of the District and may expend the proceeds of such levy to pay such part of the general expenses of maintenance and operation of the District as may be authorized or allowed by law for the use of excess levy funds. Section 3. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition of whether or not such excess tax should be levied for their ratification or rejection at a special election to be held thereon on February 2, 1988. The Whatcom County Auditor as ex officio supervisor of elections in Whatcom County is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth. The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition in the following form: "PROPOSITION NO. 1" TWO-YEAR SCHOOL OPERATION AND MAINTENANCE LEVIES Shall the following excess taxes for operation/maintenance purposes be levied for the Meridian School District's General Fund upon all taxable property within the District: Approximately $2.56 per $ 1,000 assessed value (based on 100% of true and fair value) to provide $395,000 for 1989 collection; and approximately $2.63 per $1000 assessed value (based on 100% of true and fair value) to provide $ 413,000 for 1990 collection all as specified in School Board Resolution No. 16-87.
