RESOLUTION NO. 40-88 A RESOLUTION PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY AT THE GENERAL ELECTION TO BE HELD NOVEMBER 8, 1988, OF THE PROPOSITION OF WHETHER OR NOT THE CITY SHOULD ISSUE ITS GENERAL OBLIGATION BONDS IN AN AGGREGATE PRINCIPAL AMOUNT OF NOT TO EXCEED $3,575,000 FOR THE PURPOSE OF PROVIDING FUNDS FOR CONSTRUCTING AND EQUIPPING A PUBLIC INDOOR SWIMMING POOL AT CIVIC FIELD, RELOCATING ONE SOFTBALL FIELD, AND RELATED IMPROVEMENTS. WHEREAS, there is significant voter support for a swimming pool bond issue and the City is encouraged to construct and equip a public indoor swimming pool and related facilities at Civic Field; and WHEREAS, there is a benefit to the community to have and operate a swimming pool; and WHEREAS, the City Council of Bellingham, Washington believes it is in the best interests of the City for the electors to determine whether the City ought to make a major capital investment of its capital and commitment of a portion of its annual revenue to a swimming pool; and WHEREAS, construction of the swimming pool facilities will require the relocation of one softball field and related road improvements; and WHEREAS, in order to provide funds to pay the cost thereof, it is deemed necessary and advisable that the City issue and sell its general obligation bonds in the aggregate principal amount of not to exceed $3,575,000; and WHEREAS, the Constitution and laws of the State of Washington provide that the question of whether or not the City may issue such bonds for such purpose must be submitted to the qualified electors of the City for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BELLINGHAM, AS FOLLOWS: Section 1. The City Council finds that the City should construct and equip an indoor swimming pool and related facilities at Civic Field. Section 2. To provide funds to pay the cost of the swimming pool and related facilities to be constructed and equipped, and the relocation 0094L1 City of Bellingham CITY ATTORNEY 210 Lottie Street Bellingham, Washington 98225 Telephone (206) 676-6903 of one softball field and related road improvements, the City shall issue and sell its general obligation bonds in the aggregate principal amount of not to exceed $3,575,000 (the "Bonds"). The Bonds shall be sold at such time or times as deemed necessary and advisable by the City Council, shall bear interest at a rate not in excess of the maximum rate permitted by law, and shall mature in such amounts and at such times within a maximum term of 20 years from the date of issue as authorized by the City Council and as provided by law. Both principal of and interest on the Bonds shall be payable by annual levies in excess of regular property tax levies to be made upon all the taxable property within the City. The exact date, form, terms and maturities of the Bonds shall be as hereafter fixed by the City Council. None of the bond proceeds shall be used for the replacement of equipment or for other than a capital purpose. Section 3. It is hereby found and declared that the proposition of whether or not the City shall issue the Bonds shall be submitted to the qualified electors of the City for their ratification or rejection at a general election to be held therein on November 8, 1988. The Whatcom County Auditor is hereby requested to assume jurisdiction of and to call and conduct the special election, and to submit to the qualified electors of the City the proposition hereinafter set forth. The proposition to be submitted shall be in the following form: PROPOSITION NO. However, we have been contacted by the attorney representing the proponents, and they request that the signatures be verified. This request is apparently based upon a conversation with Shirley Forsloff. They are concerned that not validating the signatures may make the initiative subject to legal challenge. The Superior Court has ordered that the signatures be verified by today, September 23rd. Please take whatever steps are necessary to validate the signatures so that we may comply with the Court's order. Sorry for the unanticipated inconvenience.
