Re: Resolution 52-88 of the Whatcom Transportation Authority
providing for an annexation and election thereon
Dear Pete:
Enclosed please find a duplicate original Resolution No.
52-88 of the Whatcom Transportation Authority that was passed
by the Board on July 6, 1988. The Resolution provides for the
annexation of two separate areas of Whatcom County to the
Whatcom Transportation Benefit Area and provides that the
annexation and the imposition of a sale and use tax shall be
submitted to the electorate of the two areas sought to be
annexed. The proposed annexation and Resolution conform with
the procedures for annexation of contiguous territory to the
Authority as provided in RCW Chapter 36.57A.130. I am
enclosing a copy of this statute for your information.
The Resolution, particularly Exhibit "A", describes by
election precincts the two areas to be annexed, and there are
two separate ballot titles for each of the two areas. Further,
the Resolution provides that the annexation and imposition of
the sales tax be placed on the November 8th, 1988, ballot in
accordance with RCW Chapter 29.13.010. This statute generally
provides that all state, county, city, town and district
general elections shall be held on the first Tuesday after the
first Monday of November in the year in which they may be
called. The statute also provides that the county, if it deems
an emergency exists, may call a special election on one of the
other dates specified in the statute provided a resolution is
presented to your office 45 days prior to the proposed election
date. The statute does not mention any time frame in which we
are to present the enclosed Resolution to the Auditor's office
prior to the general election; however, I am presenting, in any

event, the enclosed Resolution to your office well in advance
of the 45 day period. I am also forwarding a copy of this
letter and the Resolution to the Prosecutor's Office to the
attention of Mr. Randy Watts.

A RESOLUTION OF THE WHATCOM TRANSPORTATION
AUTHORITY PURSUANT TO RCW 36.57A.140 AND RCW
82.14.045 PROVIDING FOR THE ANNEXATION OF
CERTAIN TERRITORY TO THE WHATCOM TRANSPORTATION
BENEFIT AREA, DESCRIBING THE BOUNDARIES TO BE
ANNEXED, AND PROVIDING FOR SUBMISSION TO THE
ELECTORATE OF THE TERRITORY SOUGHT -TO BE
ANNEXED A PROPOSITION AUTHORIZING THE INCLUSION
WITHIN THE WHATCOM TRANSPORTATION BENEFIT AREA
AND THE IMPOSITION OF A SALE AND USE TAX AT THE
RATE OF THREE TENTHS OF ONE PERCENT (.003 ) OF
THE SELLING PRICE (IN THE CASE OF A SALES TAX)
OR THE VALUE OF THE ARTICLE USED (IN THE CASE
OF A USE TAX) TO BE COLLECTED BY THE WHATCOM
TRANSPORTATION AUTHORITY
WHEREAS, the Whatcom Transportation Authority
(Authority) is a public transportation benefit area (PTBA)
created in accordance with the procedures established by
chapter 36.57A RCW; and
WHEREAS, RCW 36.57A.140 provides there shall be
submitted to the electorate of the area sought to be annexed a
proposition authorizing the inclusion of the area within the
PTBA and authorizing the imposition of such taxes authorized by
law; and
WHEREAS, RCW 82.14.045 authorizes a PTBA for t.he-
purpose of providing funds for the operation, maintenance or
capital needs of public transportation systems to fix and
impose sales tax provided that no such sales and use tax shall
be imposed without submitting such an authorizing proposition
to the voters and obtaining approval of a majority of persons
voting thereon; and
WHEREAS, there has been public interest shown in
extending the boundaries of the Whatcom Transportation Benefit
Area to include the Ferndale city limits and Townships 4 and 5
East of the Ferndale city limits as one area and the election
precincts east and west of the Guide Meridian and bordering
thereon from the Bellingham city limits to the Canadian border

which election precincts for the two areas to be annexed are
more particularly described in Exhibit "A" attached hereto and
by this reference made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, the authority
determines that it would be in the best interest and general
welfare of the public and the Whatcom Transportation Benefit
Area to annex as two separate areas the Ferndale city limits
and Townships 4 and 5 east of the Ferndale city limits, as one
area, and the election precincts east and west of the Guide
Meridian and bordering thereon from the city limits of
Bellingham to the Canadian border with each_ area including
those election precincts more particularly described in Exhibit
"A" attached hereto.
BE IT FURTHER RESOLVED that there shall be submitted
on November 8, 1988, to the electorate of the above described
two areas to be annexed a proposition authorizing the inclusion
of the two areas within the Whatcom Transportation Benefit Area
and authorizing the imposition of a sales and use tax at the
rate of three tenths of one percent ( .003 ) of the selling price
(in the case of a sales tax) or the value of the article used
(in the case of a use tax).
BE IT FURTHER RESOLVED that the ballot titles for
the respective areas to be annexed be submitted to the Whatcom
County Auditor and read substantially as follows:

Public Transportation Benefit Areas
36.57A.130
36.57A.100 Agreements with operators of local pub-
lic transportation services Operation without agree-
ment prohibited Purchase or condemnation of assets.
Except in accordance with an agreement made as pro-
vided in this section or in accordance with the provisions
of RCW 36.57A.090(3) as now or hereafter amended,
upon the effective date on which the public transporta-
tion benefit area commences to perform the public
transportation service, no person or private corporation
shall operate a local public passenger transportation ser-
vice within the public transportation benefit area with
the exception of taxis, buses owned or operated by a
school district or private school, and buses owned or op-
erated by any corporation or organization solely for the
purposes of the corporation or organization and for the
use of which no fee or fare is charged.
An agreement may be entered into between the public
transportation benefit area authority and any person or
corporation legally operating a local public passenger
transportation service wholly within or partly within and
partly without the public transportation benefit area and
on said effective date tinder which such person or corpo-
ration may continue to operate such service or Any part
thereof for such time and upon such terms and condi-
tions as provided in such agreement. Such agreement
shall provide for a periodic review of the terms and con-
ditions contained therein. Where any such local public
passenger transportation service will be required to cease
to operate within the public transportation benefit area,
the public transportation benefit area authority may
agree with the owner of such service to purchase the as-
sets used in providing such service, or if no agreement
can be reached, the public transportation benefit area
authority shall condemn such assets in the manner and
by the same procedure as is or may be provided by law
for the condemnation of other properties for cities of the
first class, except insofar as such laws may be inconsis-
tent with the provisions of this chapter.
Wherever a privately owned public. carrier operates
wholly or partly within a public transportation benefit
area, the Washington utilities and transportation com-
mission shall continue to exercise jurisdiction over such
operation as provided by Iaw. [1977 ex.s. c 44 § 4; 1975
Ist ex.s. c 270 § 20.1

36.57A.110 Powers of component city concerning
passenger transportation transferred to benefit area
Operation of system by city until acquired by benefit
area --Consent. The public transportation benefit area
shall have and exercise all rights with respect to the
construction, acquisition, maintenance, operation, exten-
sion, alteration, repair, control and management of pas-
senger transportation which any component city shall
have been previously emlx)wered to exercise and such
powers shall not thereafter be exercised by such compo-
nent cities without the consent of the public transporta-
tion benefit area: Provided, That any city owning and
operating a public transportation system on July 1, 1975
may continue to operate such system within such city
until such system shall have been acquired by the public
transportation benefit area and a public transportation
benefit area may not acquire such system without the
consent of the city council of such city. [1975 1 st ex.s. c

36.57A.120 Acquisition of existing system Labor
contracts, employee rights preserved —Collective bar-
gaining. If a public transportation benefit area shall ac-
quire any existing transportation system, it shall assume
and observe all existing labor contracts relating ta•such
system and, to the extent necessary for operation of fa-
cilities, all of the employees of such acquired transpor-
tation system whose duties are necessary to operate
efficiently the facilities acquired shall be appointed to
comparable positions to those which they held at the
time of such transfer, and no employee or retired or
pensioned employee of such systems shall be placed in
any worse position with respect to pension seniority,
wages, sick leave, vacation or other benefits that he en-
joyed as an employee of such system prior to such ac-
quisition. The. public transportation benefit area
authority shall engage in collective bargaining with the
duly appointed representatives of any employee labor
organization having existing contracts with the acquired
transportation system and may enter into labor contracts
with such employee labor organization. [1975 1st ex.s. c

S6.57A.130 Treasurer and auditor Powers and
duties Transportation fund —Contribution of sums
for expenses. The treasurer of the county in which a
public transportation benefit area authority is located
shall be ex officio treasurer of the authority. In the case
of a multicounty public transportation benefit area the
county treasurer of the largest component county, by
population, shall be the treasurer of the authority. How-
ever, the authority, by resolution, and upon the approval
of the county treasurer, may designate some other per-
son having experience in financial or fiscal matters as
treasurer of the authority. Such a treasurer shall possess
all of the powers, responsibilities, and duties the county
treasurer possesses for a public transportation benefit
area authority related to investing surplus authority
funds. The authority may (and if the treasurer is not a
county treasurer, it shall) require a bond with a surety
company authorized to do business in the state of
Washington in an amount and under the terms and con-
ditions the authority, by resolution, from time to time
finds will protect the authority against loss. The pre-
mium on any such bond shall be paid by the authority.
All authority funds shall be paid to the treasurer and
shall be disbursed by the treasurer only on warrants is-
sued by the county auditor, upon orders or vouchers ap-
proved by the authority. However, the authority may, by

resolution, designate some person having experience in
financial or fiscal matters, other than the county auditor,
as the auditor of the authority. Such an auditor shall
possess all of the powers, responsibilities, and duties that
the county auditor possesses for a public transportation
benefit area authority related to creating and maintain-
ing funds, issuing warrants, and maintaining a record of
receipts and disbursements.
The treasurer shall establish a "transportation fund,"
into which shall be paid all authority funds, and the
treasurer shall maintain such special accounts as may be
created by the authority into which shall be placed all
money as the authority may, by resolution, direct.
If the treasurer of the authority is a treasurer of the
county, all authority funds shall be deposited with the
county depositary under the same restrictions, contracts,
and security as provided for county depositaries. If the
treasurer of the authority is some other person, all funds
shall be deposited in such bank or banks authorized to
do business in this state that have qualified for insured
deposits under any federal deposit insurance act as the
authority, by resolution, shall designate.
An authority may provide and require a reasonable
bond of any other person handling moneys or securities
of the authority, but the authority shall pay the pre-
mium on the bond.
The county or counties and each city or town which is
included in the authority shall contribute such sums to-
wards the expense for maintaining and operating the
public transportation system as shall be agreed upon be-

36.57A.140 Annexation of additional area. (1) An
election to authorize the annexation of territory contigu-
ous to a public transportation benefit area may be called
within the area to be annexed pursuant to resolution or
petition in the following manner:
(a) By resolution of a public transportation benefit
area authority when it determines that the best interests
and general welfare of the public transportation benefit
area would be served. The authority shall consider the
question of areas to be annexed to the public transpor-
tation benefit area at least once every two years.
(b) By petition calling for such an election signed by
at least four percent of the qualified voters residing
within the area to be annexed and filed with the auditor
of the county wherein the largest portion of the public
transportation benefit area is located, and notice thereof
shall be given to the authority. Upon receipt of such a
petition, the auditor shall examine it and certify to the
sufficiency of the signatures thereon.
(c) By resolution of a public transportation benefit
area authority upon request of any city for annexation
thereto.
(2) The resolution or petition shall describe the
boundaries of the area to be annexed. It shall require
that there also be submitted to the electorate of the ter-
ritory sought to be annexed a proposition authorizing the
inclusion of the area within the public transportation
benefit area and authorizing the imposition of such taxes
authorized by law to be collected by the authority. [1983

36.57A.150 Advanced financial support payments.
Counties -that have established a county transportation
authority pursuant to chapter 36.57 RCW and public
transportation benefit areas that have been established
pursuant to this chapter are eligible to receive a one—
time advanced financial support payment from the state
to assist in the development of the initial comprehensive
transit plan required by RCW 36.57.070 and 36.57A-
.060. The amount of this support payment is established
at one dollar per person residing within each county or
public transportation benefit area, as determined by the
office of financial management, but no single payment
shall exceed fifty thousand dollars. Repayment of an
advanced financial support payment shall be made to the
public transportation account in the general fund or, if
such account does not exist, to the general fund by each
agency within two years of the date such advanced pay-
ment was received. Such repayment shall be waived
within two years of the date such advanced payment was
received if the voters in the appropriate counties or pub-
lic transportation benefit areas do not elect to levy and
collect taxes enabled under authority of this chapter and
RCW 35.95.040 and 82.14.045. The state department of
transportation shall provide technical assistance in the
preparation of local transit plans, and administer the
advanced financial support payments authorized by this

36.57A.160 Dissolution and liquidation. A public
transportation benefit area established pursuant to this
chapter may be dissolved and its affairs liquidated when
so directed by a majority of persons in the benefit area
voting on such question. An election placing such ques-
tion before the voters may be called in the following
manner:
(1) By resolution of the public transportation benefit
area authority;
(2) By resolution of the county legislative body or
bodies with the concurrence therein by resolution of the
city council of a component city; or
(3) By petition calling for such election signed by at
least ten percent of the qualified voters residing within
the area filed with the auditor of the county wherein the
largest portion of the public transportation benefit area
is located. The auditor shall examine the same and cer-
tify to the sufficiency of the signatures thereon: Pro-
vided, That to be validated, signatures must have been
collected within a ninety day period as designated by the
petition sponsors.
Any dissolution of a public transportation benefit area
authority shall be carried out in accordance with the

NOTICE IS HEREBY GIVEN, that on Tuesday, November 8, 1988 in Whatcom
County, Washington, a General and Special Election will be held.
The names of said nominees will appear under the respective titles of
the offices for which they are candidates upon the ballot, which ballot will
by used and voted at the General and Special Election to be held in the
entire County of Whatcom, State of Washington.
Notice is further given that said election will be held at the regularly
designated polling places for each of the voting precincts of Whatcom County,
Washington, on Tuesday, November 8, 1988 and that each of said polling places
will be open from 7:00 A. M. to 8:00 P.-M. of said day.
