RESOLUTION NO. �`�'� `A" � A RESOLUTION of the Board of Fire Commmissioners of Fire Protection District No. 6, Whatcom County, Washington, providing for the submission to the qualified electors of the District at a special election to be held therein on November 3, 1987, in conjunction with the State general election to be held on the same date, of a proposition authorizing the incurring of general indebtedness in the amount of not to exceed $50,000 for capital purposes only, other than the replacement of equipment, and author- izing the issuance of general obligation bonds evi- dencing such indebtedness, the principal of and interest thereon to be payable from annual property tax levies to be made in excess of regular property tax levies. WHEREAS, in the judgment of the Board of Fire Commissioners of Fire Protection District No. 6, Whatcom County, Washington (the "District"), it is essential and necessary for the protec- tion of the public health, life and property that the District acquire and equip a minipumper type truck and additional equip- ment for the District, the cost of which is estimated, as nearly as may be, to be $50,000; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF FIRE COMMISSIONERS OF FIRE PROTECTION DISTRICT NO. 6, WHATCOM COUNTY, WASHINGTON, as fol- lows: Section 1. The District shall acquire and equip a mini - pumper type truck and additional equipment for the District conditioned upon the ratification by the qualified electors of the District of the proposition described in Section 3 of this resolution. Section 2. For the purpose of providing the funds for the purposes specified in Section 1 hereof, and conditioned as provided in Section 1, the District shall incur a general indebtedness in an amount not to exceed $50,000 and in no event to exceed an amount, together with any outstanding general obligation indebtedness, equal to three -fourths of one percent of the value of the taxable property within the District. Costs of engineering, planning, financial, legal and other services lawfully incurred incident to the purposes specified in Section 1 of this resolution shall be appropriate capital costs to be paid from the proceeds of the bonds provided for by this resolu- tion. The bonds authorized shall be issued as a single issue, as a part of a combined issue with other authorized bonds, or in more than one series. The bonds shall be fully registered bonds; shall mature within five years from the date of issue (the life of the improvements to be acquired by the issuance of bonds being at least five years); shall be paid by annual prop- erty tax levies sufficient in amount to pay both principal and interest when due, which annual property tax levies shall be made in excess of regular property tax levies without limitation as to rate or amount but only in amounts sufficient to meet those payments of principal and interest when due; and shall be issued and sold in such manner and at such time as shall be required for the purpose for which such bonds are to be issued. - 2 - The exact date, form, terms, option of prior redemption, price, interest rate or rates and maturities of the bonds shall be fixed hereafter by resolution of the Board of Fire Commis- sioners. Pending the issuance of the bonds, the District may issue short-term obligations pursuant to Chapter 39.50 RCW. Section 3. There shall be submitted to the qualified electors of the District for their ratification or rejection at a special election to be held therein on November 3, 1987, in conjunction with the State general election to be held on the same date, the question of whether or not such indebtedness shall be incurred and such general obligation bonds issued and such excess property taxes levied. The Board of Fire Commis- sioners declares that an emergency exists and the Auditor of Whatcom County, Washington, as ex officio Supervisor of Elec- tions, is requested to find and declare the existence of an emergency and further is requested to call and conduct a special election and to submit such proposition to the qualified elec- tors of the District at such special election, as aforesaid, in the form of a ballot title substantially as follows: PROPOSITION GENERAL OBLIGATION BONDS - $50,000 Shall Fire Protection District No. 6 borrow $50,000 to pay the cost of acquiring and equipping a minipumper type truck and additional equipment for the District by selling general obligation bonds therefor maturing within five years and levy annual excess property taxes necessary to redeem the bonds, as provided in Resolution No. _ 5 ? The Secretary of the Board of Fire Commissioners of the District is directed (a) to certify to the Whatcom County Auditor a copy of this resolution showing its adoption by the Board of Fire Commissioners at least 45 days prior to the date of such special election, and (b) to perform such other duties as are necessary or required by law to the end that the question of whether or not bonds shall be issued and excess taxes neces- sary to redeem the bonds shall be levied shall be submitted to the voters of the District at that special election.
