[ 1 JAR69/05 �1."� v ORDINANCE NO. 606 23 3 AN ORDINANCE of the City of Bla ii• , Washington, providing for the submissi-cm +to the qualified electors of the City at a special election to be held therein on September 16, 1986, of a proposition au- thorizing the City to levy regular property taxes for ten years in excess of the 106% limitation for the purpose of providing approximately $100,000 in each of such years for street maintenance and construction and providing for an annual levy and the col- lection of taxes. WHEREAS, the streets of the City of Blaine, Washington (the "City") will require significant expenditures for maintenance and construction over the next decade; and WHEREAS, the projected resources of the City due to the constraints of the 106% levy limitation will be inadequate to provide the funds necessary for such street maintenance and construction; and WHEREAS, to provide additional funds for such a purpose it is deemed necessary and advisable that the City levy regular property taxes in excess of the 106% limitation over ten years to provide $100,000 in each of such years for such limited purposes; and WHEREAS, Chapter 169, Laws of 1986, amends RCW 84.55.050, and permits the question of whether or not the City may exceed the 106% levy limitation for such limited purpose and term to be submitted to the qualified electors of the City for their rati- fication or rejection; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BLAINE, WASHINGTON, AS FOLLOWS: Section I. Findings. The City hereby finds that the public health, safety and welfare requires a ten-year street maintenance and construction program. The City finds that in addition to funds projected to be available for such purposes, it will require $100,000 in each of the next ten years to provide necessary street maintenance and construction of City streets. Section 2. Levy. For the purpose of providing funds necessary to pay a portion of required street maintenance and construction costs in the years 1987 through 1996, the City shall submit to the qualified electors of the City a proposition as authorized by RCW 35.55.050, as amended by Chapter 169, Laws of Washington, 1986 to exceed the 106% levy limitation on regular property taxes contained in RCW 84.55.010. The proposition shall provide for regular taxes to be levied in 1986 through 1995 for collection in 1987 through 1996 respectively, a period of ten years, for the sole purpose of providing $100,000 in each year for street maintenance and construction within the City. Upon approval of such proposition, the City shall increase its regular property tax levy by approximately $1.15 per thousand dollars of assessed value in 1986 for collection in 1987 above the $1.71 per thousand dollars of assessed value of regular property taxes which is expected to be levied within the 106% levy limitation. The levy rate for tax years 1987 through 1995 will vary to reflect the larger municipal tax base anticipated. Property taxes levied in 1996 for collection in 1997 and in later years shall be computed as if the limitation on levies contained in RCW 84.55.010 had been in effect from 1986 through 1995 and authority to exceed the 106% limitation under this ordinance had not been approved and such increased property taxes had not been made. Section 3. Ballot Title. It is hereby found that an urgent need exists for the funding of street maintenance and con- struction; and it is hereby declared that an emergency exists requiring submission to the qualified electors of the City JAR67/38 -2- a proposition authorizing regular property tax levies in excess of 106% levy limitation for the purpose described in this ordi- nance at a special election to be held thereon on September 16, 1986. The Whatcom County Auditor, as ex officio Supervisor of Elections, is hereby requested also to find the existence of such emergency, and is requested to assume jurisdiction of and to call and conduct a special election and to submit to the qualified electors of the City the proposition set forth below. The City Clerk is hereby authorized and directed not less than 45 days prior to September 16, 1986, to certify the proposi- tion to the Whatcom County Auditor in the following form: The City of Blaine, Washington Proposition No. 1 (Street Improvement Levy) Shall the City of Blaine, to pay part of the costs of street construction and maintenance, increase its annual regular property tax levy for ten years by approximately $1.15 per thousand of assessed valuation (to total approximately $2.86 per thousand of assessed valuation) and in 1995 reduce its regular property tax levy to the amount otherwise provided by law, to provide $100,000 per year in 1987 through 1996, all as specified in Ordinance No. /fQ5 LEVY YES LEVY NO Section 4. Section 5. Effective Date. This ordinance shall become effective five days from and after the date of its passage and publication as provided by law. A nr •,....F,.,.,. ..t-_n G INTRODUCED BY: Tom Burton PROPOSED BY: Council DATE: August 11986, 2 RESOLUTION NO. 86-40 3 A RESOLUTION SETTING A SPECIAL ELECTION 4 WITHIN THE CITY OF BLAINE TO DETERMINE IF THE CITY OF BLAINE SHALL BE ANNEXED 5 INTO THE RURAL LIBRARY DISTRICT 6 WHEREAS, R.C.W. 27.12.360 allows a city the size of Blaine to enact an Ordinance annexing it to the rural 8 library district; and, 9 WHEREAS, the City of Blaine has enacted such an Ordinance; and, 10 WHEREAS, the Ordinance has been reviewed by the State 11 Library as well as the Blaine Library Board in accordance with state law and the Boards have recommended annexation; and, 12 WHEREAS, after this has occurred R.C.W. 27.12.370 indicates that the County legislative authority shall by 13 Resolution call a special election to be held in such city 14 at the next date provided in R.C.W. 29.13.010; and, 15 WHEREAS, R.C.W. 29.13.010 allows for a special election to be set on the day of the primary election if an emergency 16 is found; and, WHEREAS, the Whatcom County Council finds that an 17 emergency does exist in this case as the grant received by the City of Blaine requires construction to begin within 18 six (6) months of receiving the grant.
