WHEREAS, the money in and to be paid into the General Fund of Blaine School District No. 503, Whatcom County, Washington during the 1986-87, 1987-88 and 1988-89 school years will be insufficient to enable the District to take care of all its necessary financial obligations and to properly meet the educational needs of students attending the District's schools; and WHEREAS, in order to properly provide for said financial obligations and educational needs of the District for the next two successive school years, it is deemed necessary that a tax of approximately $ .99 per thousand dollars of assessed valua- tion (based on 100% of true and fair value) to provide $ 700, 000. for the District's General Fund to be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1986 for collection in 1987 and that a tax of approximately $ .99 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $ 750, 000. for the District's General Fund be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1987 for collection in 1988; and WHEREAS, the Constitution and laws of the State of Washington require that the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection, NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Blaine School District No. 503, Whatcom County, Washington, as follows: Section 1. It is hereby found and declared that the welfare of the students and other residents of the District requires the District to carry out the plans hereinafter provided. Section 2. In order to provide $ 700, 000. for the General Fund of the District, a tax of approximately $ .99 per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1986 for collection in 1987 upon all the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors and that in order to provide $ .99 for the General Fund of the District, a tax of approximately $ 754 000. per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1987 for collection in 1988 upon all the taxable property within the District in excess of the maximum annual tax -levy permitted by law to be levied for the District without a vote of the electors. Upon approval by the voters of Proposition No. 1 hereinafter set forth, the District may use the proceeds of such levies during the 1986-87, 1987-88 and 1988-89 school years by incurring an indebtedness by the issuance of warrants against the General Fund of the District, and may expend the proceeds of said levies to pay such part of the general expenses of maintenance and operations of the District as may be authorized or allowed by law for the use of excess levy funds. Section 3. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition of whether or not such excess taxes should be levied in 1986 and 1987 for their ratification or rejection at a special election to be held there on February 4, 1986. The Whatcom County Auditor as ex officio supervisor of elections in Whatcom County is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth. WHEREAS, improvements and additions to school facilities are needed in Blaine School District No. 503, Whatcom County, Wash- ington (the "District") in order to provide the students of the District with necessary and adequate educational facilities; and WHEREAS, in order to provide funds to pay part of the costs of acquiring, constructing, equipping and making said necessary capital improvements it is deemed necessary and advisable that the District issue and sell its general obligation bonds in the aggregate principal amount of $600,000.00 or so much thereof as may be issued under the laws of the State of Washington governing the limitation of indebtedness of school districts; and WHEREAS, the Constitution and laws of the State of Wash- ington provide that the question of whether or not the District may issue and sell said bonds for such purposes must be submitted to the qualified electors of the District for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Blaine School District No. 503, Whatcom County, Washington, as follows: Section 1. Findings. This Board of Directors (the "Board") hereby finds and declares that the welfare of the students and other inhabitants of the District requires the District to carry out the plans hereinafter provided at the time or times and in the order deemed most necessary and advisable by the Board. Section 2. Capital Improvements. The District shall modernize and make structural improvements, changes and additions to Blaine Elementary School, including but not limited to, installing insulation for walls and ceilings, roof reconstruction, new carpet and other floor surfaces, new ceiling surfaces, new toilet facilities, a new boiler, new doors and partitions, new tack boards and chalk boards, and other improvements, for the purposes of improving the fire rating of the building, improving the energy efficiency of the school building and upgrading the elementary school facilities of the District. If funds are sufficient, the District shall acquire, construct, equip and make such other capital improvements to District facilities as the Board deems necessary. The Board shall determine the application of available moneys so as to accomplish, as nearly as may be, all improvements described or provided for in this section. The Board shall determine the exact extent and specifications for construction of structures or other improvements. If the Board shall determine that it has become impractical to accomplish any of such improve- ments or portions thereof by reason of changed conditions, incompatible development, costs substantially in excess of the amount of bond proceeds estimated to be applied thereto, or acquisition by a superior governmental authority, the Board shall not be required to accomplish such improvement and may apply bond proceeds as set forth in this section. If any or all of the improvements have either been completed, or their completion duly provided for, or their completion found to be impractical, the District may apply the bond proceeds or any portion thereof to other portions of the improvements or to other capital purposes -2- 49MEY:09 of the District or to redemption of the bonds as the Board in its discretion shall determine. In the event that the proceeds of sale of the bonds, plus any other moneys of the District legally available, are insufficient to accomplish all of the capital improvements provided by this section, the District shall use the available funds for paying the cost of those improvements for which the bonds were approved deemed by the Board most necessary and to the best interest of the District. Section 3. Authorization of the Bonds. For the purpose of providing part of the funds necessary to pay the cost of the improvements described in Section 2 above, the District shall issue and sell its unlimited tax levy general obligation bonds in the aggregate principal amount of not to exceed $ 600,000.00. The balance of the cost of said improvements shall be paid by moneys which the District may now or later have on hand and available for such purposes, and by possible state or federal grants of money. None of said proceeds shall be used for the replacement of equipment or for any other than a capital purpose. Such bonds shall be issued in an amount not exceeding the amount approved by the qualified electors of the District as required by the Consti- tution and laws of the State of Washington or exceeding the amount permitted by the Constitution and laws of the State of Washington. Section 4. Details of Bonds. The bonds provided for in Section 3 hereof shall be sold in such amounts and at such time or times as deemed necessary and advisable by the Board of Directors and as permitted by law and this resolution, shall bear interest at a rate or rates not to exceed the maximum rate permitted by law at the time said bonds are sold, and shall mature in such amounts and at such time or times within a maximum term of twelve (12) years from date of issue, but may mature at -3- 49MEY:09 an earlier date or dates as the Board may, in its discretion, determine to be in the best interests of the District and as provided by law. Said bonds shall be general obligations of the District and, unless paid from other sources, both principal thereof and interest thereon shall be payable out of annual tax levies to be made upon all the taxable property within the District without limitation as to rate or amount and in excess of any constitutional or statutory tax limitations. The exact date, form, terms, and maturities of said bonds shall be as hereafter fixed by resolution of the Board. After voter approval of the bond proposition and in anticipation of the issuance of such bonds, the District may issue short term obligations as author- ized and provided by Chapter 39.50 RCW. Section 5. Bond Election. It is hereby found and declared that an emergency exists requiring the submission to the quali- fied electors of the District of the proposition of whether or not the District shall issue such bonds for such purposes at a special election to be held therein on February 4, 1986. The Whatcom County Auditor as ex officio supervisor of elections is hereby requested also to find the existence of such emergency and to call and conduct said special election to be held within the school district on said date and to submit to the qualified electors of the District the proposition hereinafter set forth.
