CMW1/063 RESOLUTION NO. 421 A RESOLUTION of Whatcom County Water District No. 4, Whatcom County, Washington, providing for the submission to the qualified electors of the District at a special election to be held therein on November 6, 1984, of a proposition of whether or not the District should issue its general obligation bonds in the aggregate principal amount of $50,000 for the purpose of providing the funds to acquire and improve land to be held for sewer purposes. WHEREAS, the Board of Water Commissioners of Whatcom County Water District No. 4, Whatcom County, Washington (the "District"), has by Resolution adopted on February 9 , 1984, approved a comprehensive program to reconstruct and improve its plan for sewers within the District; and WHEREAS, the State of Washington Department of Ecology and the County Council of Whatcom County have approved said compre- hensive plan; and WHEREAS, the Board of Water Commissioners of the District deems it necessary and advisable that the District acquire land within the District for the purpose of implementing said compre- hensive plan; and WHEREAS, in order to provide part of the funds necessary to pay the cost thereof it is deemed necessary and advisable that the District issue and sell its unlimited tax levy general obligation bonds in the aggregate principal amount of $50,000; and WHEREAS, the Constitution and laws of the State of Washington provide that the question of whether or not the District may issue such bonds for such purposes must be submitted to the qualified electors of the District for their ratification or rejection; and WHEREAS, it is further deemed necessary and advisable that the proposition herein provided for be submitted to such electors at a special election to be held on November 6, 1984; NOW, THEREFORE, BE IT RESOLVED by Whatcom County Water District No. 4, Whatcom County, Washington, as follows: Section 1. Findings. It is hereby found and declared that it is necessary for the public welfare and benefit of the inhabi- tants of the District that the District issue its general obligation bonds for the purposes set forth herein and that it carry out the plans hereinafter provided at the time or times and in the order deemed most necessary and advisable by the Board of Water Commissioners. Section 2. Sewer Comprehensive Plan. Pursuant to the comprehensive plan for sewers for the District, the District shall acquire unimproved land of approximately 5 acres legally described on Exhibit A hereto, and install drainage and land- scaping. Said property shall be retained by the District until such time as the Board determines to amend said comprehensive plan to provide for the acquisition, construction and instal- lation of sewerage improvements thereon. Section 3. Cost of Improvements. The estimated cost of the land acquisition and improvements contained in Section 2 is hereby declared to be, as near as may be, the sum of $50,000. The balance of the costs of such improvements shall be paid out of other available funds of the District. Section 4. Authorization of Bonds. For the purpose of providing part of the funds necessary to pay the cost of land acquisition and improvements described in Section 2 above, the District shall issue and sell its general obligation bonds in the aggregate principal amount of $50,000, or so much thereof as may -2- CMW1/064 be issued and sold under the laws of the State of Washington governing the limitation of indebtedness of water districts. Said bonds shall be issued in such amounts and at such time or times as deemed necessary and advisable by the Board of Water Commissioners, shall bear interest at a rate of not to exceed the maximum rate permitted by law, and shall mature within a maximum term of ten years from date of issue, but may mature at an earlier date or dates, as authorized by the Board of Water Commissioners and provided by law. Both principal of and inter- est on said bonds shall be payable by annual property tax levies in excess of constitutional or statutory limitations upon all the taxable property within the District in such amounts as are sufficient, together with other legally available funds, to pay such principal and interest as the same shall become due. The exact date, form, terms, options of redemption and maturities of said bonds shall be as hereafter fixed by resolution of the District. In the event the proceeds of the sale of said bonds, plus any or all of the other moneys available for such purposes, are insufficient to complete all of the land acquisition approved by the voters as herein provided for, the District shall use the available funds for paying the cost of land acquisition and improvements deemed most necessary and to the best interests of the District by the Board of Water Commissioners. Section 5. Useful Life of Improvements. The life of the land to be acquired or constructed by use of the proceeds of said bond is hereby estimated and declared to be no less than ten years. Section 6. Election Called. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition of whether or not the District shall issue said general obligation bonds for -3- CMW1/064 their ratification or rejection at a special election to be held on November 6, 1984. The Whatcom County Auditor as ex officio supervisor of elections is hereby requested to also find the existence of such emergency and to assume jurisdiction of and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth.
