WHEREAS, the undersigned, as the duly elected, qualified and
acting Auditor of Whatcom County, Washington, has jurisdiction of
and is required by law to conduct all special elections for
code cities within the county; and
WHEREAS, the City of Blaine is a code city within the
boundaries of said county; and
WHEREAS, pursuant to Ordinance No. 1766 passed on September
16, 1985, a certified copy of which has been delivered to the
undersigned, the City of Blaine has found that an emergency
exists requiring the holding of a special election on November 5,
1985; and
WHEREAS, said City by said ordinance has authorized and
directed the undersigned to assume jurisdiction of and conduct
said special election;
NOW, THEREFORE, it is hereby authorized and ordered as
follows:
The undersigned concurs in the finding of an emergency and
does hereby assume jurisdiction of the above -mentioned special
election of the City of Blaine, Washington, authorized and
ordered by Ordinance No. 1766 passed on September 16, 1985, and
will conduct said special election to be held November 5, 1985.

ORDINANCE NO. 1766
XN ORDINANCE of the City Council of the City of
Blaine, Washington, adopting a plan of addi-
tions and betterments to its water supply and
distribution system, providing that part of
�6QP the costs thereof shall be paid from the pro-
ceeds of a general indebtedness to be incurred
by the City, and providing for the submission
to the qualified electors of the City at a
special election to be held on November 5,
1985, of the proposition of whether or not the
City should issue its general obligation bonds
in an aggregate principal amount not to exceed
$ r,57DO 0,°° in order to pay part of the costs of
such additions and betterments.
WHEREAS, it is deemed necessary and advisable by the City
Council of the City of Blaine, Washington (the "City"), that the
City shall purchase, acquire, construct and install certain
additions and betterments to its existing water supply system; and
WHEREAS, in order to provide funds to pay part of the costs
thereof, it is deemed necessary and advisable that the City issue
and sell its unlimited tax levy general obligation bonds in the

principal amount of not to exceed and
WHEREAS, the Constitution and laws of the State of Washington
provide that the ordinance providing for such additions and
betterments and the question of whether or not such bonds shall be
issued must be submitted to the voters of the City for their
ratification or rejection;
NOW, THEREFORE, the City Council of the City of Blaine,
Washington, DO ORDAIN AS FOLLOWS:
Section 1. It is hereby deemed necessary and advisable that
the City of Blaine, Washington, construct certain additions and
betterments to its existing system of water supply and
distribution hereinafter provided at the time or times and in the
order deemed most necessary and advisable by the City Council.
The City hereby adopts the following plan for such additions
and betterments:
The City shall acquire, construct, equip and install the
following additions and betterments to its existing system of
water supply and distribution all as more particularly described
in the Comprehensive Water Plan of the City of Blaine, Washington
prepared by Hammon, Collier & Wade -Livingstone on file with the
City (the "Project") at the time or times and in the order deemed
most necessary and advisable by the City Council;
(a) two one -million gallon water storage tanks to be located
within the watershed area and on Harvey Road north of H Street;
(b) a water pumping station;
(c) a water production well;
(d) piping between the water storage tanks; and
(e) other capital improvements necessarily related to the
construction, acquisition, equipping and installation of the
aforementioned capital improvements and such other capital
improvements to the water supply and distribution system of the
City as found necessary by the City Council.
The estimated cost of the Project is hereby found and
declared to be as near as may be the sum of $ �� �•"� *�z� �a,_
Section 2. For the purpose of providing a part of the City's
share of the costs of the Project, the City shall issue and sell
its unlimited tax levy general obligation bonds in the amount of
-(the "Bonds") . None of the proceeds of such bonds
shall be used for the replacement of equipment or for any other
than a capital purpose.

Section 3. The Bonds shall be issued and sold at such time
or times as permitted by law and as deemed necessary and advisable
by the City Council, shall bear interest payable at a rate or
rates not to exceed a maximum rate authorized by ordinance and
shall mature in such amounts and at such times within twenty years
from date of issue as authorized by ordinance and as provided by
law. The Bonds shall be general obligations of the City, and
unless paid from other sources, both principal of and interest on
the bonds shall be payable from annual tax levies in excess of
regular property tax levies to be made upon all the taxable
property within the City without limitation as to rate or amount.
The exact date, form, terms and maturities of said Bonds shall be
as hereafter fixed by the City Council.
In the event the proceeds of the sale of the Bonds, plus any
or all of the other moneys above -described, are insufficient to
make all of the capital improvements hereinbefore provided for,
the City shall use the available funds for paying the cost of
those improvements for which the respective Bonds were issued
deemed most necessary and in the best interest of the City by the
City Council.
The City hereby irrevocably covenants and agrees that each
year during the life of the Bonds, if authorized by the voters as
provided herein, it will cause to be levied annually a tax upon
all the property within the City subject to taxation, in excess of
taxes the City is permitted to levy without a vote of the people,
in an amount which, together with any other money legally
available and to be used therefor, will be sufficient to pay the
principal of and interest on the Bonds as the same shall become
due. All of such taxes so collected shall be paid into a bond
redemption fund established for such purpose.

The City hereby irrevocably pledges that the annual tax
provided for herein to be levied for the payment of such principal
and interest, if approved by the voters as provided herein,
together with any other money legally available and to be used
therefor, will be and is hereby irrevocably set aside, pledged and
appropriated for the payment of the principal of and interest on
the Bonds.
The full faith, credit and resources of the City are hereby
pledged for the annual levy and collection of such taxes and to
the prompt payment of the principal of any interest on the Bonds
as the same shall become due.
Section 4. It is hereby found and declared that an emergency
exists which requires the submission to the qualified electors of
the City of the proposition whether or not this ordinance shall be
ratified and the Bonds shall be issued at a special election to be
held therein on November 5, 1985.
The Whatcom County Auditor, as ex-officio supervisor of City
elections, it hereby requested also to find the existence of such
an emergency and to call and conduct a special election_ to be held
within the City on that date and to submit to. the qualified
electors of the City the proposition hereinafter set forth. The
City Clerk is hereby authorized and directed to certify the
proposition to the County Auditor in the following form:

Section 5. The City Clerk is hereby authorized and
directed to deliver a certified copy of this ordinance to the
Whatcom County Auditor for publication of notice not more than
ten nor less than three days prior to the election in a newspaper
of general circulation within the City.
Section 6. This ordinance shall become effective five
days from and after its publication in the manner required by
law.
PASSED by the City Council of the City of Blaine,
Washington, at a regular meeting thereof held this Ikih day of
September, 1985.

Clerk of the City of Blaine, Washington (the "City"), and keeper
of the records of the City Council (herein called the "Council"),
DO HEREBY CERTIFY:
1. That the attached Ordinance No.1766 (herein called the
"Ordinance") is a true and correct copy of an ordinanceofthe
City, as finally adopted at a meeting of the Council held on the
day of September, 1985, and duly recorded in my office.
2. That said meeting was duly convened and held in all
respects in accordance with law, and to the extent required by
law, due and proper notice of such meeting was given; that a
quorum was present throughout the meeting and a legally sufficient
number of members of the Council voted in the proper manner for
the adoption of said Ordinance; that all other requirements and
proceedings incident to the proper adoption of said Ordinance have
been duly fulfilled, carried out and otherwise observed and that I
am authorized to execute this certificate.
