RESOLUTION NO. 19-83 A RESOLUTION of the Board of Directors of Ferndale School District No. 5021, Whatcom County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 7, 1984, of the proposition of"whether or not the district should issue its general obligation bonds in the aggregate principal amount of $1,700,000 for the purpose of providing funds to acquire, construct, equip and make certain capital improvements to the facilities of the school district. WHEREAS, it is deemed necessary and advisable by the Board of Directors of Ferndale School District No. 502, Whatcom County, Washington, that in order to provide the students of the district with necessary and adequate educational facilities, the district should acquire, construct, equip and make certain capital improvements to its facilities; and WHEREAS, in order to provide funds to pay part of the costs of acquiring, constructing, equipping and making said improvements it is deemed necessary and advisable that the district issue and sell its general obligation bonds in the aggregate principal amount of $1,700,000 or so much thereof as may be issued under the laws of the State of Washington governing the limitation of indebtedness of school districts; and WHEREAS, the question of whether or not the district may issue and sell said bonds for such purposes must be submitted to the qualified electors of the district for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Ferndale School District No. 502, Whatcom County, Washington, as follows: Section 1. It is hereby found and declared that the welfare of the students and other inhabitants of the district requires the district to carry out the plans hereinafter provided at the time or times and in the order deemed most necessary and advisable by the Board of Directors of the district. Section 2. The district shall acquire, construct,_ install and equip capital improvements to the present high school site and facilities including improvements to the facilities known as Old Main and Alexander in order to meet present fire, health and safety codes and to provide improved classrooms, a library and science facility, shall make capital improvements to Vista Middle School and, if bond proceeds and other available funds permit, shall acquire, construct and make such other capital improvements to the facilities of the district as are deemed most necessary by the Board of Directors. Such improvements shall be complete with all necessary and proper facilities, utilities and appurtenances. Section 3. For the purpose of providing funds necessary to pay part of the cost of the improvements described in Section 2 above, the district shall issue and sell its general obligation bonds in the aggregate principal amount of $1,700,000 or so much thereof as may be issued and sold under the laws of the State of Washington governing the limitation of indebtedness of school districts. The balance of the cost of said improvements shall be paid by moneys now in or to be paid into the district's Building Fund, out of the moneys which the district may now or later have on hand and available for such purposes, and by possible State of Washington and United States grants of money. Said bonds shall be sold in such amounts and at such time'or times as deemed necessary and advisable by the Board of Directors and as permitted by law, shall bear interest at a rate of not to exceed the maximum rate permitted at the time said bonds are sold, and shall mature serially in such amounts and at such time or times within 10 years from the date of issue as authorized by the Board of Directors of the district and as provided by law. Said bonds shall be general obligations of the district and, 1ODLH/020 -2- unless paid from other sources, both principal thereof and interest thereon shall be payable out of annual tax levies to be made upon all the taxable property within the district without limitation as to rate or amount. The exact date, form, terms, and maturities of said bonds shall be as hereafter fixed by resolution of the Board of Directors. In the event the proceeds of the sale of said bonds, plus any or all of the other moneys above -described, are insufficient to make all of the capital improvements hereinbefore provided for, the district shall use the available funds for paying the cost of those improvements deemed most necessary and to the best interest of the district by the Board of Directors. , Section 4. It is hereby found and declared that an emergency exists regarding the submission to the qualified electors of the district of the proposition of whether or not the district shall issue said general obligation bonds for their ratification or rejection at a special election to be held thereon on February 7, 1984. The Whatcom County Auditor as ex officio supervisor of elections is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the school district on said date and to submit to the qualified electors of the district the proposition hereinafter set forth.
