Witness our hand and official seal this 21st day of February, 1984. ltor V Whatcom :County r rosecuting Attorney( o Whatcom County RESOLUTION NO. 6-83 A RESOLUTION of the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 7, 1984, of the proposition of whether or not the district should issue its general obligation bonds in the aggregate principal amount of $1,970,000 for the purpose of providing funds to acquire, construct, equip and make certain capital improvements to the facilities of the school district. WHEREAS, it is deemed necessary and advisable by the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, that in order to provide the students of the district with necessary and adequate educational facilities, the district should acquire, construct, equip and make certain capital improvements to its facilities; and WHEREAS, in order to provide funds to pay part of the costs of acquiring, constructing, equipping and making said improvements it is deemed necessary and advisable that the district issue and sell its general obligation bonds in the aggregate principal amount of $1,970,000 or so much thereof as may be issued under the laws of the State of Washington governing the limitation of indebtedness of school districts; and WHEREAS, the question of whether or not the district may issue and sell said bonds for such purposes must be submitted to the qualified electors of the district for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, as follows: Section 1. It is hereby found and declared that the welfare of the students and other inhabitants of the district requires the district to carry out the plans hereinafter provided at the time or times and in the order deemed most necessary and advisable by the Board of Directors of the district. Section 2. The district shall acquire, construct and equip: Classroom and gymnasium additions to the primary school; Capital improvements to the middle school; Capital improvements to the Classroom Building at Meridian High School; A new music building at Meridian High School; Shower and restroom facilities at the Meridian High School gymnasium; Capital improvements to the Meridian High School physical education and athletic facilities; An addition to the maintenance building; and Site acquisition. If bond proceeds and other available funds permit, the district shall acquire, construct and make such other capital improvements to the facilities of the district as are deemed most necessary by the Board of Directors. Such improvements shall be complete with all necessary and proper facilities, utilities and appurtenances. Section 3. For the purpose of providing funds necessary to pay part of the cost of the improvements described in Section 2 above, the district shall issue and sell its general obligation bonds in the aggregate principal amount of $1,970,000 or so much thereof as may be issued and sold under the laws of the State of Washington governing the limitation of indebtedness of school districts. The balance of the cost of said improvements shall be paid by moneys now in or to be paid into the district's Capital Projects Fund, out of the moneys which the district may now or later have on hand and available for such purposes, and by possible State of Washington and United States grants of money. Said bonds shall be sold in such amounts and at such time or times as deemed necessary and advisable by the Board of Directors and as permitted by law, shall bear interest at a rate of not to exceed the maximum rate permitted at the time said bonds are sold, and shall mature serially in such amounts and at such time or times within 15 years from the date of issue as authorized by 1ODLH/025 -2- the Board of Directors of the district and as provided by law. Said bonds shall be general obligations of the district and, unless paid from other sources, both principal thereof and interest thereon shall be payable out of annual tax levies to be made upon all the taxable property within the district without limitation as to rate or amount. The exact date, form, terms, and maturities of said bonds shall be as hereafter fixed by resolution of the Board of Directors. In the event the proceeds of the sale of said bonds, plus any or all of the other moneys above -described, are insufficient to make all of the capital improvements hereinbefore provided for, the district shall use the available funds for paying the cost of those improvements deemed most necessary and to the best interest of the district by the Board of Directors. Section 4. It is hereby found and declared that an emergency exists regarding the submission to the qualified electors of the district of the proposition of whether or not the district shall issue said general obligation bonds for their ratification or rejection at a special election to be held thereon on February 7, 1984. The Whatcom County Auditor as ex officio supervisor of elections is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the school district on said date and to submit to the qualified electors of the district the proposition hereinafter set forth. The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition to the County Auditor in the following form: PROPOSITION NO. 2 GENERAL OBLIGATION BONDS, $1,970,000 Shall Meridian School District No. 505 issue $1,970,000 of 15 year general obligation bonds payable out of annual levies in excess of regular property taxes, to acquire, construct and equip primary school classroom and gymnasium additions and a high school 1ODLH/025 -3- music building, capital improvements to the high school Classroom Building and physical education and athletic facilities and to the middle school and, if funding permits, to make other capital improvements to district facilities, all as provided in Resolution No. 6-837 BONDS, YES . . . . . . . . . . The polls for such special election shall be open from 7:00 o'clock a.m. to 8:00 o'clock p.m. The Secretary of the Board of Directors is hereby authorized to deliver a certified copy of this resolution to the Whatcom County Auditor. PROPOSITION NO. 2 GENERAL OBLIGATION BONDS, $1,970,000 Shall Meridian School District No. 505 issue $1,970,000 of 15 year general obligation bonds payable out of annual levies in excess of regular property taxes, to acquire, construct and equip primary school classroom and gymnasium additions and a high school music building, capital improvements to the high school Classroom Building and physical education and athletic facilities and to the middle school and, if funding permits, to make other capital improvements to district facilities, all as provided in Resolution No. 6-837 BONDS, YES . . . . . . . . . . / / BONDS, NO . . . . . . . . . . / / 1ODLH/026 RESOLUTION NO. 5-83 A resolution of the Board of Directors of Meridian School District No. 505, Whatcom County, Washington, providing for the submission to the qualified electors of the Dis- trict at a special election to be held therein on February 7, 1984, of the proposition of whether or not there should be levied an excess tax of approximately $1.89 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $ 310 000.00 for the District's General Fund to pay part of tie general expenses of maintenance and operation of the District, such levy to be made in 1984 for collection in 1985 and whether there should be levied a further ex- cise tax of approximately $1.88 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $325,000.00 for the District's General Fund to pay part of the general expenses of maintenance and operation of the District, such levy to be made in 1985 for collection in 1986. WHEREAS, the money in and to be paid into the General Fund of Meridian School District No. 505, Whatcom County, Washington, during the 1984-85, 1985-86 and 1986-87 school years will be insufficient to enable the District to take care of all of its necessary finan- cial obligations and to properly meet the educational needs of students attending the District schools; and WHEREAS, in order to properly provide for said financial obli- gations and educational needs of the District for the next two successive school years, it is deemed necessary that a tax of approximately $1.89 per thousand dollars of assessed valuation (based on 100% of true and fair- value) to provide $310,000.00 for the District's General Fund be levied upon all of the taxable pro- perty within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1984 for collection in 1985 and that a tax of approximately $1.88 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $325,000.00 for the District's General Fund be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1985 for collection in 1986; and WHEREAS, the Constitution and laws of the State of Washington require that the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection. - 1 - NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Merician School District No. 505, Whatcom County, Washington, as follows: Section 1. It is hereby found and declared that the welfare of the students and other residents of the District requires the District to carry out the plans hereinafter provided. Section 2. In order to provide $ 310,000.00 for the General Fund of the District, a tax of approximately $1.89 per thous- and dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1984 for collection in 1985 upon all the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors and that in order to provide $ 325,000.00 for the General Fund of the District, a tax of approxi- mately $1.88 per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1985 for collec- tion in 1986 upon allof the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors. Upon approval by the voters of Proposition No. 1 hereinafter set forth, the District may use the proceeds of such levy during the 1984-1985, 1985-1986 and 1986-1987 school years by incurring an indebtedness by the issuance of warrants against the General Fund of the District and may expend the proceeds of such levy to pay such part of the general expenses of maintenance and operation of the District as may be authorized or allowed by law for the use of excess levy funds. Section 3. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition of whether or not such excess tax should be levied for their ratification or rejection at a special election to be held thereon on February 7, 1984. The Whatcom County Auditor as ex officio supervisor of elections in Whatcom County is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition herein- after set forth. The Secretary of the Board of Directors is hereby authorized and directed to certify said proposition in the following form: - 2 -- "PROPOSITION NO. 1 TWO-YEAR SCHOOL OPERATION AND MAINTENANCE LEVEES Shall the following excess taxes for operation/mainten- ance purposes be levied for the Meridian School District's General Fund upon all taxable property within the District: approximately $1.89 per $1,000.00 assessed value (based on 100% of true and fair value) to provide $310,000.00 for 1985 collection; and approximately $1.88 per $1,000.00 assessed value (based on 100% of true and fair value) to provide $ 325,000.00 for 1986 collection, all as specified in School Board Resolution No. 5-83?
