State law provides two means of dissolving a water district. Under RCW Chapter 57.04 proceedings for dissolution are initiated by a majority of the Board of Water District Commissioners. The final decision as to dissolution is then determined by the Superior Court. However, RCW 57.04.100 provides that a water district may be disincorporated in the same manner as is provided in RCW 35.07.110 et seq. for the disincorporation of third and fourth class cities. It is this latter method which has been chosen by the petitioners for disincorporation. Thus, under RCW 35.07 et seq. the proceedings for dissolution are initiated by the individual voters. The final decision as to dis-solution is then determined by the voters themselves at an election called especially for that purpose. Under this statute the commissioners are re- quired to hold an election pursuant to the filing of the _ petition. State etc. v. Spanaway Water District, 38 Wn.2d 393 (1951). If the vote for dissolution is a majority of the registered voters of the district voting at such election, the district shall be deemed dissolved. RCW 35.07.080. The receiver must qualify within ten days after he has been declared elected, by filing with the County Auditor a bond equal in amount to the audited indebtedness and established liabilities of the district. RCW 35.07.120. The receiver, upon qualifying, takes possession of all the property, money, vouchers, records and books of the former district and winds up the district's affairs. RCW 35.07.150. Upon the final payment of all lawful demands against the former district, the receiver files a final account with the Clerk of the Superior Court. Any funds remaining in his hands are then paid to the County Treasurer for the use of the school district in which the former district was situated. Ther4af ter, the receivership is at an end. RCW 35.07.220. Based upon the foregoing, it appears that the com- missioners are obligated to hold an election to determine the issue of dissolution. It is not the obligation of the County to prepare documents necessary to accomplish the dissolution: Therefore, you may wish to notify the water district commissioners accordingly.
