Mc Eachran, Prosecuting Attorney of said County, now meet with Joan Ogden, County Auditor of "said County, at the -County seat of said County on the 12th day of November, 1982 for the purpose of canvassing the votes cast in all the voting precincts in the Citv of Nooksack, Whatcom County, at the General and Special Election held on Tuesday, November 2, 1982, as shown on the poll books. Disend, Deputy Prosecuting Attorney DATE: September 7, 1982 RE: Annexation of the City of Nooksack into the Whatcom County Rural Library District CHIEF CIVIL DEPUTY Eugene R. Moses CIVIL DEPUTY Bruce L. Disend This is in response to your memo of August 19, 1982 concerning the above -referenced matter. The pertinent statute is RCW 27.12.370. That pro- vision requires the County's legislative authority to call a special election, by resolution, to be held in the City at the next date provided in RCW 29.13.010, but not less than 45 days from the date of the declaration of such finding. Notice.of the election is to be given as provided for in RCW 29.27.080. The election on the annexation is conducted by the auditor in accordance with the general election laws of the state. No person is entitled to vote at the election unless he or she is registered to vote in the City for at least thirty days preceding the date of the election. The ballot proposition must be in substantially the following form: Shall the City of Nooksack be annexed to and be a part of the Whatcom County Rural Library District? YES / _7 NO /� If the majority of the persons voting on the proposi- tion vote in favor of it, the city shall thereupon be annexed Memo to William P. WHEREAS, the City of Nooksack has passed an ordinance, designated as Ordinance No. 222, declaring the intent of the City to join the Whatcom County Rural Library District; and, WHEREAS, said Ordinance states that the City Council of the City of Nooksack finds that it is in the public interest of the residents of the City to be included into the Whatcom County Rural Library District; and, WHEREAS, the Whatcom County Rural Library District Board of Trustees has conferred upon the matter and approved the annexatio of the City of Nooksack into the Library District. NOW, THEREFORE, BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL that a special election shall be held in the City of Nooksack at the next date provided in RCW 29.13.010 and the County Auditor shall cause notice of such election to be given as provided for in RCW 29.27.080, all as provided for in RCW 27.12.370.
