SUBJECT: Clerical error on Resolution no. 80-75
It has been brought to my attention that there was a dis-
crepancy between 'the legal description of Water District
17 as approved by the Boundary Review Board on September
4, 1980, and that of the County Council Resolution no.
80-75 passed by the Council on December 18, 1980.
The error was on the Council resolution, and involved the
omission of language two paragraphs at the end of the le-
gal description when the resolution was typed. As it is
clearly a clerical error, no amending resolution is nec-
essary. Please substitute the attached resolution for that
that you have already placed on file.
Thank you.

PETITION FOR WITHDRAWAL OF TERRITORY FROM
WHATCOM COUNTY WATER DISTRICT NO. 17
The undersigned, who constitute twenty-five percent of the
qualified voters residing within the limit of the territory here-
inafter described, respectfully petition the Board of Commissioners
of Water District No. 17, Whatcom County, Washington, for the with-
drawal of such territory from the limits of said water district,
upon the following showing:
I
Ther territory proposed by this petition for withdrawal from
Water District No. 17, Whatcom County, Washington is described as
follows:
;y co
0)
W C,
coo
The Northwest quarter of the Northwest quarter of
Section 9, Township 40 North, Range 4 East of W.M.,
AND
That portion of the West half of the West half of
Section 4, Township 40 North, Range 4 East of W.M.
n lying Southerly of the Chicago -Milwaukee St. Paul
a & Pacific Railroad (now Burlington Northern) right -
in ,, of -way; AND
That portion of Section 5, Township 40 North, Range
4-East of W.M., lying Southeasterly of the Chicago-
2 Milwaukee St. Paul & Pacific Railroad (now Burlington
®u Northern) right-of-way; AND
I-
= That portion of the North half of the North half of
3 Section 8, Township 40 North, Range 4 East of W.M.,
+ lying Southeasterly of the Chicago -Milwaukee St. Paul
Railroad (now Burlington Northern) right-of-way.
II
That the basis for this petition of withdrawal is that the property
is now served by Nooksack Valley Water Association. It would also be
extremely difficult to get water service across the railroad tracks
to this property.
w
III
That the withdrawal of such territory from Water District No. 17,
Whatcom County Washington, would be of benefit to such territory and
conductive to the general welfare of the balance of the water district
because it would be very expensive to cross the railroad tracks with
water lines, thus increasing the cost of water service to all persons
within the water district.
Wherefore, the undersigned, petition at the Board of Commissioners
to fix a date for the hearing of said petition and give such notice of
sai -hearing as is required by law.bo
