Pursuant to a notice given by Joan Ogden, County Auditor of
Whatcom County, Washington, we the undersigned, Shirley VanZanten,
Chairperson of the County Council of said County, and David S. Mc
Eachran, Prosecuting Attorney of said County, now meet with Joan Ogden,
County Auditor of said County, at the County seat of said County on
the 19th day of November, 1980 for the purpose of canvassing the votes
cast in the County of Whatcom at the General and Special Election held
on Tuesday, November 4, 1980, as shown on the poll books. Joan Ogden,
County Auditor as aforesaid, now makes oath as follows:

The Whatcom County Council in their meeting of September
18, 1980, duly called by the Chair and announced to the
public, adopted by Resolution in the matter of submitting
to the voters of Whatcom County at the November 4, 1980
General Election the following proposals:
1. A Resolution in the matter of sumitting to the
voters a proposal to create Whatcom County
Water District No. 17
2. A Resolution in the matter of submitting to the
voters a proposal to annex the City of Ferndale
into the Whatcom County Rural Library District
As the Ex-officio Supervisor of Elections the Whatcom
County Auditor is directed to proceed with the necessary
arrangements for the conduct of such election, and is autho-
rized to prepare and have printed ballots in substantially
the form indicated in the Resolution, and to hold such
election, canvass and return the results thereof, all in such
manner and form provided by Law.

A RESOLUTION IN THE MATTER OF SUB-
MITTING TO THE VOTERS A PROPOSAL TO
ANNEX THE CITY OF FERNDALE INTO THE
WHATCOM COUNTY RURAL LIBRARY-DT$TRICT
WHEREAS, the Whatcom County Council has received City
of Ferndale Ordinance No. 605 requesting initiation of the process
of calling an election on the question of whether the City of.
Ferndale should be annexed to and be a part of the Whatcom County
Rural Library District by declaring the requisite intent to do
so and public interest to be served thereby; and,
WHEREAS, the Whatcom County Library Board of Trustees
on August 12, 1980, passed a motion concurring in placing Ordinan
No. 605, to annex the City of Ferndale to the Whatcom County
Rural-Library'District_on.t e ballot.
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
Section 1.
The Whatcom County Council shall present to the County
Auditor's Office a proposition to be placed on the ballot for
the general election to be held November 4, 1980; said proposition
shall state as follows:

RESOLUTION NO. "l Z
CITY OF FERNDALE, WASHINGTON
A RESOLUTION ORDERING AN ELECTION FOR
THE SELECTION OF NEW MEMBERS OF THE CITY
COUNCIL PURSUANT TO THE VOTER APPROVED
COUNCIL-MANAGER PLAN OF GOVERNMENT.
WHEREAS, an election was held in the City of
Ferndale on November 6, 1979, for the submission of a proposi-
tion to the voters, as follows:
"Shall the City of Ferndale abandon its
present plan of government and adopt the
Council -Manager plan of government?"
WHEREAS, the results of said election have been
certified on November 21, 1979, and the proposition carried;
and
WHEREAS, it is necessary that the City of Ferndale
proceed with an election of seven (7) council members so that
it may effectively adopt the voter -approved Council -Manager
plan of government; and
WHEREAS, the requisites and details of said elec-
tion to be held for said purpose in accordance with Section
7, Ch.18, Laws of 1979, 1st Ex.Sess. (RCW 35A.02.050 as
amended) have, since passage of Resolution No. 79-917, been
concluded to involve a primary election to be held at a
special election on a date specified in RCW 29.13.020 and
within a reasonable period of time for nomination to those
positions to be filled for which, after the last day allowed
for candidates to withdraw, there are more than two (2) candi-
dates filed, followed by an election of the seven (7) council -
members at the next succeeding special election authorized
in RCW 29.13.020; and
WHEREAS, the City Council deems the following time-
table to be a reasonable period of time to proceed with the
requisite special election of seven (7) councilmembers to
effectively adopt the voter -approved Council -Manager plan
of government: Filing period: July 28, 1980 thru August 1,
1980, unless otherwise prescribed by law; Primary election
for nomination to those positions for which, after the last
day allowed for candidates to withdraw, there are more than
two (2) candidates filed: September 16, 1980 (the third Tues-
day of Sept., 1980, as presently provided by RCW 29.13.020(e)
and RCW 29.13.070); Special election of seven (7) council -
members: November 4, 1980 (the first Tuesday after the first
Monday in November, 1980, as presently provided by RCW
29.13.020(f)); and
WHEREAS, Section 7, Ch.18, Laws of 1979, 1st Ex.
Sess. (RCW 35A.02.050 as amended) presently provides that
the duration of initial terms for positions one (1) through
three (3) for a seven (7) member council shall be until the
second Monday in January in the first even -numbered year that
follows the next general municipal election and the duration
of the initial term attaching to the remaining councilmanic
positions shall be until the second Monday in January two
(2) years next thereafter, so that staggered regular four
(4) year terms will ultimately result;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
FERNDALE RESOLVES AS FOLLOWS:
SECTION 1. The City Council hereby orders a primary elec-
tion to be held at a special election on September 16, 1980,
for nominations to those councilmanic positions to be filled
for which, after the last day allowed for candidates to with-
draw, there are more than two (2) candidates filed.
SECTION 2. The City Council hereby further orders the
election for the selection of all seven (7) members of the
Ferndale City Council required to effectively adopt the voter -
approved Council -Manager plan of government to be held at
a special election on November 4, 1980.
SECTION 3. The conduct and effect of said elections shall
be as prescribed by applicable state laws as they now exist
or may be hereafter amended.
PASSED by the City Council of the City of Ferndale,
Washington, at a regular meeting thereof, and APPROVED by
the Mayor this 3rd day of December, 1980.

We are the city attorneys for Ferndale, Washington, and
are enclosing certified copies of Ordinance No. 532 and
Resolution No. 7912-3 for filing pursuant to RCW 35A.02.040.
By way of background, the City of Ferndale became a
noncharter code city retaining its existing plan of govern-
ment (five councilpersons and mayor) by virtue of Ordinance
No. 532 passed November 1, 1976. We expect that a certified
copy of that ordinance was already filed with you by the
city clerk, but are enclosing another copy just in case it
was not.
By vote of the people on November 6, 1979, the code city
Council -Manager plan was approved in lieu of the existing
plan of government, so Resolution No. 7912-3 was adopted
December 3, 1979, ordering a primary nomination election for
September 6, 1980, and a special election for November 4,
1980, to select the persons to fill the seven council positions
in accordance with RCW 35A.02.050.
The Whatcom County Auditor's office would like confirmation
of the City's filing of its ordinances as a part of setting up
the election for council positions. If there are any questions,
