Pursuant to a notice given by Joan Ogden, County Auditor of Whatcom
County, Washington, we the undersigned, Shirley Van Zanten, Chairperson
of the Whatcom County Council and David S. Mc Eachran, Prosecuting
Attorney of said County, now meet with Joan Ogden, County Auditor of said
County for the purpose of canvassing the votes cast in Fire Protection
District No. 13 at the Special Election held on Tuesday, February 5, 1980
as shown on the poll books. Joan Ogden, County Auditor as aforesaid, now
makes oath as follows.

FIRE PROTECTION DISTRICT NO. 13
WHATCOM COUNTY, WASHINGTON
RESOLUTION NO. 80-1
A RESOLUTION of the Board of Fire Commissioners
of Fire Protection District No. 13, Whatcom County,
Washington, relating to the finances of the District
and amending Sections 2 and 3 of Resolution No. 79-15.
BE IT RESOLVED BY THE BOARD OF FIRE COMMISSIONERS OF FIRE
PROTECTION DISTRICT NO. 13, WHATCOM COUNTY, WASHINGTON, as follows:
Section 1. Section 2 of Resolution No. 79-15 should be
and the same hereby is amended to read as follows:
"Section 2. For the purpose of providing the funds
to do those things described in Section 1 hereof, and con-
ditioned as provided in such Section 1, the District shall
incur a general indebtedness and issue its general obliga-
tion bonds evidencing such indebtedness in an amount not to
exceed $500,000 (the 'Bonds') and in no event to exceed an
amount, together with any outstanding general obligation
indebtedness, equal to three -fourths of one percent of the
value of the taxable property within the District as provided
in Section 50, Chapter 195, Laws of Washington, 1973, lst
Ex. Sess. The Bonds shall be serial in form and maturity;
shall be numbered from '1' upward consecutively; shall bear
interest at such rate or rates not to exceed nine percent
(9%) per annum as the Board of Fire Commissioners of the
District shall hereafter determine by resolution, payable
semiannually from the date of the Bonds until their principal
is paid (except that the first interest payment may be at such
time up to twelve months from the date of issue as such
Commissioners may hereafter determine by resolution), with
interest coupons evidencing such interest to maturity to be
attached thereto, and with full obligation on the part of
the District to pay interest at the bond rate or rates from
and after the maturity dates until the Bonds with interest
are paid in full; shall mature serially, annually, in from
two to twenty years from the date of issue, the various annual
maturities to be, as nearly as practicable, in such amounts
as will, together with interest on all outstanding bonds,
be met by equal annual tax levies for the payment of the
principal and interest of such bonds; shall be issued in deno-
minations of $100.00 or some multiple thereof; and shall bear
such date or dates, shall be in such form, and shall contain
such covenants as the Board of Fire Commissioners of the
District shall hereafter determine by resolution. Both
principal of and interest on the Bonds shall be payable from
annual property tax levies to be made without limitation as
to rate or amount. The Bonds shall be sold in such manner
as the Board of Fire Commissioners of the District shall deem
to be for the best interest of the District and at a price
not less than par. The Bonds shall be issued from time to time
(in one or more series) as funds are needed. The proceeds
of the sale of such bonds shall be used only to defray the
cost of doing those things described in Section 1 hereof and
the cost of issuance of such bonds and not for the replacement
of equipment. Such constructing and equipping are declared
to be for capital purposes only."
Section 2. Section 3 of Resolution No. 79-15 should be
and the same hereby is amended to read as follows:
"Section 3. There shall be submitted to the quali-
fied electors of the District for their ratification or
rejection, at a special election to be held thereon on

February 5, 1980, the question of whether or not such indebt-
edness shall be incurred and such bonds issued, and the
Board of Fire Commissioners hereby declares that an emergency
exists and the Auditor of Whatcom County, Washington, as
ex-officio Supervisor of Elections for such County, is hereby
requested to find that an emergency exists, to call such spe-
cial election and to submit such proposition to the qualified
electors of the District at such special election, as afore-
said, in the form of a ballot title substantially as follows:

GENERAL OBLIGATION BONDS - $500,000
Shall Whatcom County Fire Protection District
No. 13 issue its general obligation bonds in the
amount of not to exceed $500,000, bearing interest
not to exceed nine percent (90) per annum, to mature
in from two to twenty years from date of issue and
to be payable, both principal and interest, from
annual property tax levies to be made without limi-
tation as to rate or amount to pay the cost of
constructing and equipping a headquarters fire
station in the Birch Bay area, as provided in
Resolution No. 79-15 of the District, as amended?

Section 3. The other provisions of Resolution No. 79-15,
and all actions heretofore taken to accomplish the submission
to the qualified electors of the District for their ratification
or rejection, at a special election to be held therein on February 5,

hereof, should be and the same hereby are ratified and confirmed.
ADOPTED by the Board of Fire Commissioners of Fire Protec-
tion District No. 13, Whatcom County, Washington, at a regular open

RESOLUTION NO. 79-15
A RESOLUTION of the Board of Fire Commission-
ers of Fire Protection District No. 13, Whatcom
County, Washington, providing for the submis-
sion to the qualified electors of the District
at a special election to be held therein on
February 5, 1980, of a proposition authorizing
the incurring of a general indebtedness in the
sum of not to exceed $500,000 for capital pur-
poses only, for the purpose of constructing
and equipping a headquarters fire station in
the Birch Bay area, and authorizing the issu-
ance of general obligation bonds evidencing
such indebtedness, the principal of and inter-
est thereon to be payable from annual property
tax levies to be made without limitation as to
rate or amount.
WHEREAS, in the judgement of the Board of Fire Commis-
sioners of the District, it is essential and necessary for the
protection of the public health, life and property that the Dis-
trict construct and equip a headquarters fire station in the Birch
Bay area, the cost of which is estimated, as near as may be, to be
the sum of $500,000; NOW, THEREFORE,
BE IT RESOLVED BY THE BOARD OF FIRE COMMISSIONERS OF FIRE
PROTECTION DISTRICT NO. 13, WHATCOM COUNTY, WASHINGTON, as follows:
Section 1. The District shall construct and equip a
headquarters fire station in the Birch Bay area, the cost of which
is estimated, as near as may be, to be the sum of $500,000, condi-
tioned upon the ratification by the qualified electors of the
District of the proposition described in Section 3 of this resolu-
tion.
Section 2. For the purpose of providing the funds to do
those things described in Section 1 hereof, and conditioned as
provided in such Section. 1, the District shall incur a general
indebtedness and issue its general obligation bonds evidencing such
indebtedness in an amount not to exceed $500,000 (the "Bonds") and
in no event to exceed an amount, together with any outstanding
general obligation indebtedness, equal to three -fourths of one
percent of the value of the taxable property within the District as
provided in Section 50, Chapter 195, Laws of Washington, 1973, 1st
Ex. Sess. The Bonds shall be serial in form and maturity; shall be
numbered from "1" upward consecutively; shall bear interest at such
rate or rates as the Board of Fire Commissioners of the District
shall hereafter determine by resolution, payable semiannually from
the date of the Bonds until their principal is paid (except that
the first interest payment may be at such time up to twelve months

property tax levies to be made without limitation as to rate or
amount. The Bonds shall be sold in such manner as the Board of
Fire Commissioners of the District shall deem to be for the best
