Office of the Auditor of Whatcom County Bellingham, Washington November 21, 1979 Pursuant to a notice given by Joan Ogden, County Auditor of Whatcom County, Washington, we the undersigned, Shirley Van Zanten, Chairman of the County Council of said County, and David S. Mc EAchran, Prosecuting Attorney of said County, now meet with Joan Ogden, County Auditor of said County, at the County seat of said County on the 21st day of November, 1979 for the purpose of canvassing the votes cast in the County of Whatcom at the General and Special Election held on Tuesday, November 6, 1979, as shown on the poll books. Joan Ogden, County Auditor as aforesaid, now makes oath as follows: STATE OF WASHINGTON ss. CITY OF FERNDALE, WASHINGTON A RESOLUTION ORDERING AN ELECTION ON THE PROPOSAL TO ABANDON THE PRESENT PLAN OF GOVERNMENT UNDER WHICH THE CITY OF FERNDALE IS PRESENTLY OPERATING AND TO ADOPT THE COUNCIL-MANAGER PLAN OF GOVERNMENT. WHEREAS, the City of Ferndale is classified as a non -charter code city operating under the general mayor/ council plan of government for a town of the fourth class; and WHEREAS, the council-manager plan of government authorized by Chapter 34A.13 of the Revised Code of Wash- ington, is an optional plan of government for non -charter code cities; and WHEREAS, Chapter 35A.06 of the Revised Code of Washington provides that the legislative body of a non -charter code city may, by resolution, propose the abandonment of the present plan of government and adoption of another plan by resolution for election. WHEREAS, the City council of the City of Ferndale feels that it is in the best interest and general welfare of the citizens of the City of Ferndale to abandon the present form of government and adopt the council-manager plan of government authorized by Chapter 35A.13 Revised Code of Washington. -1- NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FERNDALE RESOLVES AS FOLLOWS: SECTION 1. The City council hereby proposes the abandonment of the present plan of government and the adoption of the council-manager plan of government authorized by Chapter 35A.13 Revised Code of Washington. SECTION 2. The City council hereby authorizes the city attorney to prepare a ballot title and statement of the proposition in accordance with R.C.W. 29.27.060 and 35A.29.12O in order that the proposition may be voted on at the next general election. Section 3. The City council hereby proposes that the first election of officers under the council-manager plan of government, if the proposition receives favorable approval at the general municipal'election, to be at the next general municipal election in November of 1981. Box 1126 Ferndale, Washington 98248 to be submitted to the voters of the general municipal election on As the city attorney for the City of Ferndale, I am giving notice of the question of the adoption of a council-manager form of government for the City of Ferndale, which is to be submitted to the voters of the City of Ferndale on November 6, 1979. In accordance with RCW 35A.29.120 and 29.27.060, I am submitting a ballot title consisting of a concise statement posed as a question in twenty words or less. I believe this concise statement to clearly identify the proposition to be voted on. In addition, I am submitting you a copy of Resolution No. 79-917 as adopted by the City Council of the City of Ferndale at its regular council meeting on September 17, 1979. This resolution proposes the abandonment of the present plan of government, adoption of a council-manager plan of government and authorizes and directs me to prepare a ballot title and statement of the proposition to be submitted to the voters. Also, I am enclosing a copy of the resolution for your information and records. If for any reason the enclosed information is not sufficient to submit this matter to the voters of the City of Ferndale at the general election on November 6, 1979, please do not hesitate to contact me and I will immediately make any correction or changes as you may deem necessary. Lamgabeer RJL/mkv Enclosures cc: Mayor Council Members STATEMENT OF PROPOSITION The City of Ferndale is an incorporated municipality classified as a non -charter code city having elected to be governed under the provisions of the optional municipal code, Title 35A of the Revised Code of Washington. The City Council, by resolution, changed the classification of the City of Ferndale to that of a non -charter code city retaining the plan of govern- ment for a town of the fourth class, which is the present plan of government. The government of a town is vested in a mayor and a council consisting of five members, all elective; and the mayor is the chief administrative and appointive officer for the municipality. By Resolution No. 79-917, adopted at the regular meeting of the City Council of the City of Ferndale on September 17, 1979, the Council proposed the abandonment of the present plan of government and adoption of the council-manager plan of govern- ment and ordered an election thereon. The council-manager form of government as provided for in the optional municipal code, Title 35A of the Revised Code of Washington, is one of the op- tional forms of government. The council-manager plan of govern- ment consists of a seven -member council as the elective officers of the city, and the council appoints an officer whose title is "City Manager", who is the chief executive officer and adminis- trative head of the city government. The council elects biannually from their number a chairman who has the title of mayor and is recognized as the head of the city for ceremonial purposes only with no regular administrative duties.
