Failed 56.90 TURN OVER FOR NEXT PAGE VOTE ALL PAGES TO CONTINUE YOUR VOTING TO NEXT PAGE RESOLUTION NO. 1-79 A resolution of the Board of Directors of Ferndale School District No. 502, Whatcom County, Washington, providing for the submission to the qualified electors of the District at a special election to be held therein on March 13, 1979, of the proposi- tion of whether or not there should be levied an excess tax of approximately s1.55 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $794,102 for the District's General Fund to pay part of the general expenses of maintenance and operation of the District, such levy to be made in 1979 for collection in 1980. WHEREAS, the money in and to be paid into the General Fund of Ferndale School District No. 502, Whatcom County, Washington, during the 1979-1980 and 1980-1981 school years will be insuf- ficient to enable the District to take care of all of its necessary financial obligations and to properly meet the educa- tional needs of students attending District schools; and WHEREAS, in order to properly provide for said financial obligations and educational needs, it is deemed necessary that a tax of approximately $ 1.55 per thousand dollars of assessed valuation (based on 100% of true and fair value) to provide $ 794,102 for the District's General Fund be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1979 for collection in 1980; and WHEREAS, the Constitution and laws of the State of Washington require that the question of whether or not such excess tax may be levied must be submitted to the qualified electors of the District for their ratification or rejection, NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Ferndale School District No. 502, Whatcom County, Washington, as follows: Section 1. It is hereby found and declared that the welfare of the students and other residents of the district requires the District to carry out the plans hereinafter provided. Section 2. In order to provide $ 794,102 for the General Fund of the District, a tax of approximately $ 1.55 per thousand dollars of assessed valuation (based on 100% of true and fair value) should be levied in 1979 for collection in 1980 upon all the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors. Upon approval by the voters of Proposition No. 1 herein- after set forth, the District may use the proceeds of such levy during the 1979-1980 and 1980-1981 school years by incur- ring an indebtedness by the issuance of warrants against the General Fund of the District, and may expend the proceeds of said levy to pay part of the general expenses of maintenance and operations of the District as may be authorized or allowed by law for the use of excess levy funds. Section 3. It is hereby found and declared that an emer- gency exists requiring the submission to the qualified electors of -the District of the proposition of whether or not such excess tax should be levied for their ratification or rejection at a special election to be held therein on March 13, 1979. The Whatcom County Auditor as ex officio supervisor of elections in Whatcom County is hereby requested to also find the existence of such emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth. The Secretary of the Board of Directors is hereby author- ized and directed to certify said proposition in the following form: PROPOSITION NO. 1 SCHOOL PROGRAM LEVY Shall a tax, in excess of limitations applicable without the vote of District electors, of approxi- mately $ 1.55 per $1,000 of assessed value (based on 100% of true and fair value) to provide $ 794,102 for operation and maintenance purposes be levied for the Ferndale School District General Fund in 1979 for collection in 1980 upon all tax- able property within the District, all as specified in School Board Resolution No. 1-79. LEVY . . . . . YES LEVY . . . . . NO The Secretary of the Board of Directors of the District is hereby directed to deliver a certified copy of this reso- lution to the Whatcom County Auditor. ADOPTED by the Board of Directors of Ferndale School District No. 502, Whatcom County, Washington, at a special open public meeting thereof, notice of which was given as required by law, held January 25, 1979, the following Directors being present and voting therefor.
