IT IS FURTHER RESOLVED that notice of said special election be published for four successive weeks in a newspaper of general circulation in Whatcom County, as provided in Revised Code of Washington, Section 57.04.050; and , IT IS FINALLY RESOLVED that the County Auditor as ex- officio County supervisor of elections, proceed to call, notice, Resolution - 1. conduct, and have convassed the special election herein pro- vided for, and to take all appropriate and necessary steps in connection therewith. FORMATION OF WHATCOM COUNTY ) WATER DISTRICT NO. 16 ) R E S O L U T I O N WHEREAS, the returns of the election for the formation of a water district within the exterior boundaries as finally adopted have been duly canvassed, and WHEREAS, of the votes cast on the proposition for the formation of the water district, nine (9) votes were cast in favor of the organization of said district and zero (0) votes were cast against the same; that the votes cast on the proposition authorizing the water district to levy a general tax of one dollar and twenty-five cents ($1.25) per thousand dollars of assessed value for general preliminary expenses of the district, nine (9) votes were cast in favor of the levy and zero (0) votes were cast against the levy, said vote being a majority of three -fifths of the electors there- of voting on the proposition and being not less than forty percent of the total number of votes cast in the district at the last preceding general state,election held therein, as provided in R.C.W. 57.04.050. NOW, THEREFORE, BE IT RESOLVED that Whatcom County Water District No. 16, is now a duly organized Water District under the laws of the State of Washington, with boundaries established and defined as follows: 14 A tract of land consisting of portions of Section 8, 16, and 17, all in Township 38 North, Range 3 East of W.M., Whatcom County, Washington, more particularly described as follows: That portion of the Southeast Quarter of the Southeast Quarter lying Southerly 'and Easterly of the Centerline of Baker Creek; the East one- half of the Southeast One Quarter of the'South- west Quarter of the Southeast Quarter; all sit- uated in Section 8, Township 38 North, Range 3 East of W.M.; the Southwest Quarter of the North- west Quarter including the C.M. ST. P. & P. Rail- road Right-of-way; the Northwest Quarter of the Northwest Quarter; the Northeast Quarter of the Northwest Quarter lying Northerly and Westerly of the C.M. ST. P. & P. Railroad Tracks Center- line, all situate in Section 16, Township 38 North, Range 3 East of W.M.; the West 130 feet of the East 160 feet of the Northeast Quarter of the Northeast Quarter of the Northwest Quarter in- cluding easement, AF Number 1124559; the South one-half of the Northeast Quarter of the North- west Quarter; the Southeast Quarter of the North- west Quarter; the entire Northeast Quarter; all situate in Section 17, Township 38 North, Range 3 East of W.M. J� �jrc / Deput BEFORE THE BOARD OF WHATCOM COUNTY COMMISSIONERS IN THE MATTER OF ESTABLISHING BOUNDARIES OF WHATCOM COUNTY WATER DISTRICT NO. 16 RESOLUTION ESTABLISHING BOUNDARIES ON APPROVAL BY BOUNDARY REVIEW BOARD AND AUTHORIZING SUBMIS- SION OF 2 PROPOSITIONS TO VOTERS. - WHEREAS, a petition has been presented to the Board of County Commissioners of Whatcom County requesting formation of water district number 16 and designating its boundaries of said proposed water district; and WHEREAS the petition recited that such a district will be conducive to the public health, convenience, and welfare and will be of benefit to the property included therein; and WHEREAS, said petition was signed by more than twenty- five percent of the qualified electors residing within the district, and the Whatcom County Auditor has certified to the sufficiency thereof, and attached his certificate to the petition; and WHEREAS, notice of the time and place of presentation of the petition to the Board of County Commissioners was duly published once a week for two successive weeks in the Bellingham Herald, the county legal newspaper, and said notice set forth the boundaries of said proposed district; and WHEREAS, the petition was duly presented before the Board of County Commissioners at public hearing, on January 31st, 1979 pursuant to notice, and all persons appearing were given opportunity to make objections to the establishment of the district and/or the proposed boundary lines thereof. And upon final hearing the County Commissioners accepted some minor changes in the proposed boundary lines which they deem proper. NOW, THEREFORE, the Board of County Commissioners finds that the proposed water district will be conducive to the public health welfare and convenience and will be of special benefit to the land included within the boundaries of said proposed district. Resolution - 1. WHEREFORE IT IS RESOLVED: 1. That the proposed water district be designated proposed Whatcom County Water District No. 16. 2. Subject to approval of the Whatcom County Boundary Review Board, the boundaries of Whatcom County Water District No. 16 are determined to he the exterior boundaries of the follow- ing described land: LEGAL DESCRIPTION A tract of land consisting of portions of Section 8, 16, and 17, all in Township 38 North, Range 3 East of W.M.; described as follows: That port -ion of the Southeast Quarter of the Southeast Quarter lying Southerly and Easterly of the Centerline of Baker Creek; the East one- half of the Southeast one Quarter of the South- west Quarter of the Southeast Quarter; all sit- uated in Section 8, Township 38 North, Range 3 East of W.M.; the Southwest Quarter of the North- west Quarter including the C.M. Upon approval of the boundaries so established by the Whatcom County Boundary Review Board, this matter shall be referred back to the Board of County Commissioners for final hearing and sub- mission to the voters within the area of a proposition to form Water District No. 16, and a proposition to levv $1.25 per thousand dollars of assessed value for one year for general preliminary expenses of the district all in the manner provided by law.
