THE PROPOSITION TO ISSUE GENERAL OBLIGATION BONDS IN THE AMOUNT OF
$4,900,000 TO CONSTRUCT AND EQUIP A NEW HIGH SCHOOL, TO CONSTRUCT AND
EQUIP CLASSROOM ADDITIONS AND COVERED PLAY AREA AT FISHER ELEMENTARY
SCHOOL AND MAKE OTHER CAPITAL IMPROVEMENTS.

Pursuant to a notice given by Joan Ogden, County Auditor of Whatcom
County, Washington, we the undersigned, C. J. Johnson, Chairman of the Board
of County Commissioners of said County, and David S. Mc Eachran, Prosecuting
Attorney of said County, now meet with Joan Ogden, County Auditor of said
County, at the County seat of said County on the 25th day of September, 1978
for the purpose of canvassing the votes cast in all of the precincts compris-
ing the Lynden School District No.504, as shown on the poll books in Whatcom
County, Washington. Joan Ogden, County Auditor, as aforesaid, now makes oath
as follows:

Immediately after the oath by the County Auditor, the said Joan Ogden,
C. J. Johnson and David S. Mc Eachran proceed as a Canvassing Board in and
for Whatcom County to canvass the votes cast in the precincts comprising
the Lynden School District No. 504, Whatcom County, Washington on the 29th
day of September, 1978.

stituting the Canvassing Board in and for Lynden School District No. 504,
Whatcom County, having met for the purpose of canvassing the votes concerning
the following proposition:

GENERAL OBLIGATION BONDS - $4,900,000
Shall Lynden School District No. 504, Whatcom County,
Washington, issue its general obligation bonds in the amount of
$4,900,000, payable, both principal and interest, out of annual
property tax levies in excess of regular levies, maturing within
twenty years from date of issue, to construct and equip classroom
additions and covered play area at Fisher Elementary School, to
renovate the existing high school for use as a middle school,
including a gymnasium, to construct and equip a new high school,
and make other capital improvements?

RESOLUTION NO. 7-78
A RESOLUTION of the Board of Directors of Lynden
School District No. 504, Whatcom County, Washing-
ton, providing for the submission to the qualified
electors of the district at a special election to
be held therein on September 19, 1978, of a proposition
for the issuance of its general obligation bonds in
the aggregate principal amount of $ 4,900,000 , or so
much thereof as may be issued under the laws governing
the indebtedness of school districts for the purpose
of providing funds to acquire, construct, equip and
make certain capital imarovements to the facilities
of the school district.
WHEREAS, additional -school facilities are needed in
Lynden School District No. 504, Whatcom County, Washington
(hereinafter_ called the "District"), in order to provide the
students attending and using the same with Mequate, proper and
safe educational facilities; and
WHEREAS, in order to provide part of the funds to enable the
District to acquire, construct, equip and make such necessa.ry
capital'improvements to its existing facilities., it is deemed
necessary and advisable that the District issue and sell its
unlimited tax 'levy gene_. al obligation bonds in the principal
amount of $ 4;900,000 ; and
WHEREAS, the Constitution and laws of the State of Washington
provide that the question of whether or not such 'ponds Pay be
issued and sold for such purposes must be submitted to the quali-
fied electc::rs of the District for their ratification or reflection;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
Lynden School District No. 504, Whatcam County, Washington, as
follows:
Section 1. This Board of Directors (hereinafter_ called the
"Board") hereby finds and declares that the best merest of the
students and othei inhabitants of the District requires the
District to carry out the olans hereinafter provided at the time
or times and in the order deemed most necessary and advisable by
the Board.
Section 2.
The District shall:
(1) Construct and equip classroom additions
play area at Fisher Elementary School;
and covered
(2) renovate the existing high school for use as a middle
school, including improvements to the gymnasiun and;
(3) construct and equip a new high school.
If available funds are sufficient, the District shall acquire,
construct, equip and make other_ capital improvements to the facilities
of the District, all as found necessary by the Board of Directors.
Section 3. For the purpose of providing part of the funds
necessary to pay the cost of the improvements descr4bed in Section
2 hereof, the District shall issue and sell its un imited tax
levy general obligation bonds in :'e principal amount of not to
exceed $ 4,900,000. The balance of the cost of said improvements
shall be paid out of any moneys whica the District now has or may
later have on hard which are legally available for such purposes
and out of possible State of Washington grants of money. None of
said bond proceeds shall be used for the replacement of equipment -
or for any other than a capital purpose. Such bonds shall be
issued in an amount not exceeding the amount amDroved by the
qualified electors of the District a7 required by the Constitution
and laws of the State of Washington.
Section 4. The bonds provided for in Section 3 hereof shall
be sold in such amounts and at such time or times as deemed
necessary and advisable by this Board and as permitted by law,
shall bear interest at a rate of not to exceed the maximum rate
permitted. by law at the time the bonds are sold, and shall mature

serially in such amounts and at such times within 20 years from
date of issue as authorized by this Board and as provided by law.
Said bonds shall be general obligations of the District and,
unless paid from other sources, both principal and interest
thereon shall be payable out of annual tax levies to be made upon
all the taxable property within the District without limitation
as to rate or amount. the exact date, form, terms, and maturities
of said bonds shall be as hereafter_ fixed by resolution of the
Board of Directors.
In the event the proceeds of the sale of said bonds, plus
any or all of the other moneys above -described, are insufficient
to make all of the capital improvements hereinbefore provided
for, the District shall use the available funds for paying the cost
of those improvements for which bonds were approved deemed most nec-
essary and to the best interests of the District by the Board of
Directors.
Section 5. it is hereby _founj and declared that an emergency
exists requiring: the submission to the qualified electors of the
District of the proposition of whether or not the District shall
issue such bonds for such purposes at a special election to be
held therein on the 19th day of September, 197S .
The Whatcom County Auditor as ex officio supervisor of elec-
tions is hereby requested to also fines: the existence of such
emergency and to call and conduct said special election to be
held within the school district on said date and to submit to the
qualified electors of the District the proposition hereinafter
set forth. The Secretary of the Board of Directors is hereby
authorized and directed to certify said proposition to the
county auditor in the following form

The polls for such special election shall be open from
7:00 o'clock a.m. to 8:00 o'clock p.m.
The Secretary of the Board of Directors is hereby authorized
to deliver a certified copy of this resolution to the Whatcom
County Auditor.

No. 504, Whatcom County, Washington , at a special meeting thereof
held the 31st day of July, 1978.
