J. Johnson, Chairman of the Board of County Commissioners of said County, and David S. Mc EAchran, Prosecuting Attorney of said County, now meet with Joan Ogden, for the purpose of canvassing the, votes cast in all the precincts comprising Whatcom County Fire Protection District No. 11, in Whatcom County, State of Washington, as shown on the poll books at the Special Election held on Tuesday, the 19th day of September, 1978. Joan Ogden, County Auditor as aforesaid, now makes oath as follows: OATH OF AUDITOR STATE OF WASHINGTON) Ss. COUNTY OF WHATCOM ) I, Joan Ogden, County Auditor of Whatcom County, State of Washington, do solemnly swear that the returns purporting to be the election returns of Fire Protection District No. 11, Whatcom County, Washington, held on the 19th day of September, 1978, have in no wise been altered by additions or erasures, and that they are the same as when I received them, except that the votes of the absentee voters have been added, SO HELP ME GOD. Mc Eachran proceeded as a Canvassing Board in and for Whatcom County to canvass the votes cast in all of the precincts of Whatcom County Fire Protection District No. 11, on the 19th day of September, 1978. COUNTY OF WHATCOM ) The undersigned, being the officers designated by the law and constituting the canvassing board in and for the Whatcom County Fire Protection District No. 11, Whatcom County, Washington, having met for the purpose of canvassing the votes concerning the following proposition: PROPOSITION NO. 1 Submitted by Fire Protection Dist. No. 11 GENERAL OBLIGATION BONDS -- $43,000 Shall Fire --District No. 11, Whatcom County, Washington, issue $43,000.00 in General Obligation Bonds at an interest rate not to exceed the maximum legal limit to purchase a new fire truck and fire fighting equipment; and repay principal and interest by excess annual tax levies over a seven (7) year period? Fr !�az.2 Prosecuting Attor6r atcom Co��nty Auditor FIRE PROTECTION DISTRICT NO. 11 Whatcom County, Washington Resolution No. A RESOLUTION of the Board of Commissioners of Fire Protection District No. 11, Whatcom County, Washington, providing for the submission to the qualified electors of the District at a special election to be held in conjunction with the State primary election on September 1, 1978, of a proposition authorizing the incurring of a general indebtedness in the sum of not to exceed $43,000.00, said indebtedness to be evidenced by general obligation bonds which shall mature serially, annually, in from two to seven years from date of issue, said bonds tc)A interest at a rate which shall be within the maximum���imits, for capital purposes; to -wit, acquire a fire truck and other fire fighting equipment; and authorizing the issuance of general obligation bonds evidencing such indebtedness, the principal and interest thereof to be payable from annual tax levies in excess of the constitutional and/or statutory tax limitations. WHEREAS, in the judgment of the Board of Fire Commissioners of the District, it is essential and necessary for the protection of the public health, life and property that the District acquire a new fire truck and other fire fighting equipment, the cost of which is estima- ted, as near as may be, to be the sum of $43,000.00; now, therefore, BE IT RESOLVED THE BOARD OF COMMISSIONERS OF FIRE PROTECTION DISTRICT NO. 11, WHATCOM COUNTY, WASHINGTON, as follows: Section 1. For the purpose of providing funds to defray the cost of acquiring a new fire truck and other fire fighting equipment, the District shall incur a general indebtedness and issue general obligation bonds evidencing such indebtedness in an amount not to exceed $43,000.00, and in no event, to exceed an amount, together with any outstanding general obligation indebtedness, equal to three -fourths of one percent of the value of the taxable property within such District, as the term "value of the taxable property" is defined in R.C.W. 39.36.015. The bonds shall be serial in form and maturity; shall be number from "one" unpward consecutively; shall bear interest payable semi-annually from the date of the bonds until their principal is paid, with interest coupons evidencing such interest to maturity to be attached thereto, and with full obligation on the part of the District to pay interest at the same rate or rates from and after the maturity dates until the bonds with interest are paid in full; shall mature serially, annually, in from two to seven years from date of issue, the various annual maturities to be, as nearly practicable, in such amounts as will, together with interest on all outstanding bonds, be met by equal annual tax levies for the payment of the principal and interest on said bonds; shall be issued in denominations of ONE HUNDRED ($100.00) DOLLARS or some multiple thereof; and shall bear such date, shall be in such form, and shall contain such covenants as the Board of Fire Commissioners of the District shall hereafter determine by resolution. The prin- cipal and interest on the bonds shall be payable from annual tax levies to be made in excess of the constitutional and/or statutory tax limitations. The bonds shall be sold in such manner as the Board of Fire Commissioners of the District shall deem to be for the best interest of the District and at a price not less than par. The bonds may be issued from time to time (in one or more series) as funds are needed. The proceeds of the sale of said bonds shall be used only to defray the cost of acquiring a new fire truck and other fire fighting equipment. Such acquisitions are declared to be for capital purposes only. Section 2. There shall be submitted to the qualified electors of the District for their ratification or rejection, at a special -2- V fle 5C) l u t�^Pi _� q election on September 17 , 1978, to be held in conjunction with the State primary election, the question of whether or not such indebt- edness shall be incurred and such bonds issued, and the Board of Fire Commissioners hereby declares that an emergency exists and the Auditor of Whatcom County, as ex-officio County Supervisor of Elections, is hereby requested to find that an emergency exists, to call said special election, and to submit such proposition at said special election, as aforesaid, in the form of a ballot title sub- stantially as follows: GENERAL OBLIGATION BONDS- $43,000 Shall Fire District No. 11, Whatcom County, Washington, issue $43,000.00 in General dligation Bonds at an interest rate not to exceed the maximum legal limit to purchase a new fire truck and fire fighting equipment; and repay principal and interest by excess annual tax levies over a seven (7) year period?
