RESOLUTION NO. 9
A RESOLUTION of the Board of Directors of Nooksack
Valley School District No. 506, Whatcom County,
Washington, providing for the submission to the qual-
ified electors of the district at a special election to
be held therein on May 9, 1978, of a proposition auth-
orizing the levy of an excess tax of approximately $3.76
per $1, 000 of as ses sed value (100% of true and fair value
unless specifically otherwise provided by lath) to raise the
sum of $320,000 for the district General Fund.
WHEREAS, the money to be paid into the General Fund of the
district will be insufficient during the fiscal year 1978-79 to enable the district
to operate properly and to take care of all financial obligations, it is deemed
necessary in order to prevent the impairment of the district's contracts that the
district levy a tax of $320, 000 or approximately $3. 76 per $1, 000 of assessed
value (100% of true and fair value unless specifically otherwise provided by law)
upon all taxable property within the district in 1978 for collection in excess of
the annual tax levy limitation the district is permitted by law to levy without a
vote of the people; and
WHEREAS, the Constitution and laws of the State of Washing-
ton provide that the question of whether or not such excess tax may be levied for
such purpose must be submitted to the qualified voters of the district for their
approval or rejection;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
of Nooksack Valley School District No. 506, Whatcom County, Washington, as
follows:
Section 1: It is hereby found and declared that the welfare
of the children of the district requires it to carry out the plans hereinafter provided.
Section 2: That for the purpose of providing part of the funds
required to secure proper textbooks, instructional supplies and teaching materials,
to make necessary repairs and replacements to school district facilities, to pay
adequate salaries, to prevent the impairment of the obligation of the district's
contracts and to properly carry on the functions of the schools within the dis-
trict, the district authorizes the County Commissioners of Whatcom County to
levy a tax of approximately $3.76 per $1 , 000 of assessed value (100% of true
and fair value unless specifically otherwise provided by law) upon all taxable
property within the district in 1978 for collection in 1979 in excess of the an-
nual tax levy permitted the district without a vote of the people for the purpose
of providing $320, 000 for the district General Fund.
Section 3: It is hereby found and declared that an emergency
exists requiring the suasion to the qualified voters of the district of the Tpro-
position of whether or not there should be levied such excess tax for the purposes
described herein at a special election to be held within the district on May 9, 1978.
The Whatcom County Auditor as ex-officio supervisor of elections in Whatcom
County is hereby requested to also find the existence of such emergency and to
call and conduct said special election to be held within the district on that date
and submit to the qualified voters of the district at said special election the pro-
position hereinafter set forth. The Secretary of the Board of Directors is hereby
authorized and directed 'to certify said proposition to the Whatcom County Auditor
in the following form:

in 1979 for maintenance and operation?

The polls for such special election shall be open from 7:00
o'clock a.m. to 8:00 o'clock p.m.
The secretary of the Board of Directors is hereby authorized
and directed to deliver a certified copy of this Resolution to the Whatcom County
Auditor.
PASSED by the Board of Directors of the Nooksack Valley School
District No. 506, Whatcom County, Washington, at a special meeting thereof held
this 20th day of March, 1978.
