Pursuant to a notice given by Wella Hansen, County Auditor of Whatcom
County, Washington, the undersigned, C. J. Johnson, Chairman of the Board
of County Commissioners of said County, and David S. McEachran, Prosecuting
Attorney of said County, now meet with Wella Hansen, County Auditor of said
County at the seat of said County on the 26th day of September, 1977, for the
purpose of canvassing the votes cast in the Whatcom County Water District
No. 15 Formation Election held within the voting precinct comprising said
District in the County of Whatcom, State of Washington, on the 20th day of
September, 1977.

'WATER DISTRICT NO. 15 ) R E S O L U T I O N
WHEREAS, the returns of the election for the formation
of a water district in the Lummi Reservation area have been
duly canvassed, and
WHEREAS, of the votes cast on the proposition for the
formation of the water district, one hundred and seventy
(170) votes were cast in favor of the organization of said
district and six (6) votes were cast against the same; that
of the votes cast on the proposition authorizing the water
district to levy a general tax of one dollar and twenty-
five cents ($1.25) per thousand dollars of assessed value
for general preliminary expenses of the district, one hundred
and sixty-four (164) votes were cast in favor of the levy
and eight (S) votes were cast against the levy, said vote
being a majority of three -fifths of the electors thereof
voting on the proposition and being not less than forty percent
of the total number of votes cast in the district at the
last preceding general State election held therein, as provided
in RCW 57.04.050.
NOW, THEREFORE, BE IT RESOLVED that Whatcom County [dater
District No. 15, is now a duly organized Water District
under the laws of the State of Washington, with boundaries
established and defined as follows:
Beginning at a point at the NW corner of Government Lot
1 in Section 23, T38N, RIE, W.M.; thence East to the
center of Haxton Way; thence in a southwesterly direction
along the centerline of Haxton Way to the NW corner of
the SW 1/4 of the SE 1/4 of Sec. 23, T38N, RIE, thence
south along the North south 1/4 section line to the
center of Section 26, T3$N, R1E; thence west along
east west 1/4 section line of said section to the center
of Haxton Way; thence Southwesterly along the centerline
of Haxton Way to a point on the west line of said
section; thence south along said section line to the
SW corner of said section; thence west to the NE
boundary of the Plat of GEORGIA MANOR; thence South-
westerly along the east boundary of said plat and

The above entitled matter having come on for hearing before
the Board of County Commissioners of Whatcom County, Washington,
on the 13th day of July, 1977 at 10:00 a.m., in the public hearing
room, Courthouse, Bellingham, Washington, upon the petition of
residents in the Lummi Reservation area for the for tion of a
water district, pursuant to due notice of the hearing, and all
persons appearing having been heard and no objections being offered
to the establishment of said district or to the proposed boundary
lines thereof and the matter having been fully and finally heard,
the said Board of County Commissioners now enters its findings
as follows:
1. That the petition was heretofore duly filed with the County
Auditor and within ten days after said filing, the petition was
transmitted to this Board by the County Auditor with the Auditor's
certificate attached thereto certifying to the sufficiency of the
signatures as required by law, and the Board now finds that the
petition was duly signed by more than 250 of the qualified electors
residing within the district described therein.
2. That at a regular meeting of this Board held on the 27th
day of June, 1977, the Board, by Resolution fixed a time and place
for holding a public hearing on said petition and, pursuant to
said Resolution caused to be published for two successive weeks
in the Bellingham Herald a notice of such hearing.
3. That at the said time and place the petition was duly
and finally heard as set forth in the findings above.
4. That the boundaries of the said proposed water district
are hereby established and defined as follows:

Haxton Way; thence in a southwesterly direction along the

5. That the proposed water district will be conducive to the
public health, welfare and convenience and be of special benefit
to all land included within the foregoing boundaries of -the proposed
district.
NOW, THEREFORE, BE IT RESOLVED that a special election is
hereby called to be held in the proposed water district, the
boundaries of which are hereinabove described in the foregoing
findings, on the 20th day of September, 1977, and the County
Election Board of the County Election Board of the County of
Whatcom is hereby requested to give notice of the election as
provided by law by publishing said notice in the Bellingham
Herald for four successive weeks and by posting a like notice
in ten public places in the proposed water district, in which
notices the boundaries of the water district and the object of
the election shall be set forth;
That the name of the proposed water district is hereby fixed
as WHATCOM COUNTY WATER DISTRICT NO. 15.
That a proposition shall be presented to the voters for their
approval or rejection authorizing the water district, after formation,
to levy at their easliest time permitted by law a general tax of
not to exceed one dollar and twenty five cents ($1.25) per thousand
dollars of assessed value, for general preliminary expenses of the
district.

WHEREAS, a pdition has been presented to the Board of County
Commissioners of Whatcom County, Washington, petitioning this
Board for the formation of a water district in the Lummi Reservation
area, and
WHEREAS, the said petition set forth the object for the creation
of the district, designated the boundaries thereof, set forth the
fact that the establishment of said district will be conducive to
the public health, convenience and welfare and will be of benefit
to the property included therein, and
WHEREAS, in compliance with RCW 57.04.030, the petition was
duly filed with the Whatcom County Auditor, who, within ten days
after the filing of said petition, examined the signatures thereon,
found that the petition was signed by more than 250 of the qualified
electors of said proposed district, and certified to the sufficiency
of such signatures to this Board.
NOW, THEREFORE, BE IT RESOLVED that a hearing on said petition
shall be held on Wednesday, July 13, 1977 at 10:00 a.m., in the
public hearing room, Courthouse, Bellingham, Washington, at which
time any person, firm or corporation may appear before the Board
and make objections to the establishment of the said district or
the proposed boundaries thereof.
