Directors, duly adopted at a regular meeting thereof held on the 13th day of January, 1977.

WHEREAS, the undersigned as the duly elected, qualified and
acting Auditor of Whatcom County, Washington, has jurisdiction of and is required
by law to conduct all special elections for school districts within the county; and
WHEREAS, Nooksack Valley School District No. 506, Whatcom
County, Washington, lies entirely within the boundaries of said county; and
WHEREAS, the Board of Directors of said district by resolution
adopted January 13, 1977, a certified copy of which has been delivered to the under-
signed, has found that an emergency exists requiring the holding of a special election
on March 8, 1977; and
WHEREAS, said district by said resolution has authorized and dir-
ected the undersigned to assume jurisdiction of and conduct said special election;
NOW, THEREFORE, it is hereby authorized and ordered as follows:
The undersigned concurs in the finding of an emergency and does
hereby assume jurisdiction of the above mentioned special election of Nooksack
Va1Ley School District No. 506, Whatcom County, Washingtcn , authorized and
ordered by resolution of its Board of Directors adopted January 13, 1977, and will
conduct said special election to be held March 8, 1977.

RESOLUTION NO. 5
A RESOLUTION of the Board of Directors of Nooksack
Valley School District No. 506, Whatcom County,
Washington, providing for the submission to the qual-
ified electors of the district at a special election to
be held therein on March 8, 1977, of a proposition
authorizing the levy of an excess tax of approximately
_4__�L47 ___per $1,000 of assessed value (100% of
true and fair value unless specifically otherwise pro-
vided by law) to raise the sum of $550, 000.00
for the district General Fund.
WHEREAS, the money to be paid into the General Fund of the dis-
trict will be insufficient during the fiscal year 1977-78 to enable the district to op-
erate properly and to take care of all financial obligations, it is deemed necessary
in order to prevent the impairment of the district's contracts that the district levy
a tax of $550,000.00 --or approximately _ $6.47 per
$1,000 of assessed value (100% of true and fair value unless specifically otherwise
provided by law) upon all taxable property within the district in 1977 for collection
in excess of the annual tax levy limitation the district is permitted by law to levy
without a vote of the people; and
WHEREAS, the Constitution and laws of the State of Washington
provide that the question of whether or not such excess tax may be levied for such
purpose must be submitted to the qualified voters of the district for their approval
or rejection;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
Nooksack Valley School District No. 506, Whatcom County, Washington, as follows:
Section 1: It is hereby found and declared that the welfare of the
children of the district requires it to carry out the plans hereinafter provided.
Section 2: That for the purpose of providing part of the funds re-
quired to secure proper textbooks, instructional supplies and teaching materials, to
make necessary repairs and replacements to school district facilities, to pay adequate
salaries, to prevent the impairment of the obligation of the district's contracts and to
properly carry on the functions of the schools within the district, the district author-
izes the County Commissioners of Whatcom County to levy a tax of approximately
$6.47 _ pe- $1,000 of assessed value (100% of true and fair value unless
specifically otherwise provided by law) upon all taxable property within the district
in 1977 for collection in 1978 in excess of the annual tax levy ermitted the district
without a vote of the people for the purpose of providing_ $550,000.00 for the district General Fund.
Section 3: It is hereby found and declared that an emergency exists
requiring the submission to the qualified voters of the district of the proposition of
whether or not there should be levied such excess tax for the purposes described here-
in at a special election to be held within the district on March 8, 1977. The Whatcom
County Auditor as ex-officio supervisor of elections in Whatcom County is hereby re-
quested to also find the existence of such emergency and to call and conduct said
special election to be held within the district on that date and submit to the qualified
voters of the district at said special election the proposition hereinafter set forth.
The Secretary of the Board of Directors is hereby authorized and directed to certify
said proposition to the Whatcom County Auditor in the following form:
