Pursuant to a notice given by Wella Hansen, County Auditor of Whatcom
County, Washington, we the undersigned, C. J. Johnson, Chairman of the
Board of County Commissioners of said County, and David S. Mc Eachran
Prosecuting Attorney of said County, now meet with-Wella Hansen, County
Auditor of said County, at the County seat of said County on the_ 22nd
day of November, 1976 for the purpose of canvassing the votes cast in
all of the precincts of Whatcom County, as shown on the Poll Books in
Whatcom County, Washington. Wella Hansen, County Auditor, as aforesaid,
now makes oath- as follows:

I, Wella Hansen, County Auditor of Whatcom County, State of Washington,
do solemnly swear that the returns purporting to be the election returns
of Whatcom County, Washington, held on the 2nd day of November, 1976, have
been in no wise altered by additions=or erasures, and that they are the same
as when I received them, SO HELP ME GOD.

Hansen, C. J. Johnson and David S. Mc Eachran proceed as a Canvassing
Board in and for Whatcom County to canvass the votes cast in all -of' -

The undersigned, being the officers designated by the law and con-
stituting the Canvassing Board in and for Whatcom County, State of Wash-
ington, having met for the purpose of canvassing the votes concerning
the following proposition:
PROPOSITION NO. 1
COUNTY PARK. BONDS - $5,950,000
Shall Whatcom County issue $5,950,000 of general obligation
bonds bearing interest at a rate not to exceed the maximum
rate permitted by law at the time of sale, maturing serially
in twenty years from date of issue, and payable both principal
and interest out of annual levies of taxes to be made without
limitation as to rate or amount, for the purpose of providing
funds to pay costs of acquiring and developing indoor and out-
door county park and recreation facilities, all as provided in
Resolution, passed September 16, 1976?

NOTICE OF SPECIAL ELECTION
WHATCOM COUNTY, WASHINGTON
November 2, 1976
NOTICE IS HEREBY GIVEN that on Tuesday, November 2, 1976, a special
election will be held in all of Whatcom County for the submission to the
qualified electors of Whatcom County, the following proposition:
PROPOSITION NO. 1
COUNTY PARK BONDS - $5,950,000
Shall Whatcom County issue $5,950,000 of general obligation
bonds bearing interest at a rate not to exceed the maximum rate
permitted by law at the time of sale, maturing serially in twenty
years from date of issue, and payable both principal and interest
out of annual levies of taxes to be made without limitation as to
rate or amount, for the purpose of providing funds to pay costs of
acquiring and developing indoor and outdoor county park and rec-
reation facilities, all as provided in Resolution, passed September
16, 1976?

WHEREAS, the undersigned as the duly elected, qualified
and acting Auditor of Whatcom County, Washington, has juridsiction of
and is required by law to conduct all special elections within the
county; and
WHEREAS, the Board of County Commissioners of Whatcom
County by Resolution No. , adopted September 16, 1976, a certified
copy of which has been delivered to the undersigned, has found that
an emergency exists requiring the holding of a special election on
November 2, 1976, in conjunction with the state general election; and
WHEREAS, said resolution requests the undersigned to
assume jurisdiction of and conduct said special election;
NOW, THEREFORE, it is hereby authorized and ordered as
follows:
The undersigned concurs in the finding of an emergency
and does hereby assume jurisdiction of the above -mentioned special
election of Whatcom County, Washington, authorized and ordered by
Resolution No. of the Board of County Commissioners, adopted
on September 16, 1976, and will conduct said special election to
be held November 2, 1976.

RESOLUTION NO.
A RESOLUTION providing for the submission to
the qualified electors of Whatcom County at
a special election to be held therein on
November 2, 1976 of a proposition of whether
or not the county should issue its unlimited
tax levy general obligation bonds in the
principal amount of $5,950,000 for the
purpose of providing funds to pay part or
all of the cost of acquisition and development
of public park and recreation facilities.
WHEREAS, existing public part and recreation facilities
of Whatcom County (hereinafter called the "County") are not adequate
for the present and future needs of its residents; and
WHEREAS, the County Park Board has prepared a plan for
the financing, acquisition, development and improvement of public
park and recreation facilities of the County which, together with
existing facilities, will provide a public park and recreation
system available to and for the general benefit of the residents
of the County; and
WHEREAS, to provide funds to carry out such plan it is
deemed necessary and advisable that the County issue and sell its
unlimited tax levy general obligation bonds in the aggregate principal
amount of $5,950,000; and
WHEREAS, the Constitution and laws of the State of Washington
provide that the question of whether or not such bonds may be issued
and sold for such purposes must be submitted to the qualified electors
of the County for their ratification or rejection; and
WHEREAS, it is further deemed necessary and advisable that
said proposition be submitted to such qualified electors at a special
election to be held at the time of the county and state general
election on November 2, 1976,
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Whatcom County, Washington, as follows:
Section 1. It is hereby found and declared that it is
necessary for the public welfare and benefit of the residents of
the County that it carry out the plans hereinafter provided in
the manner provided by law upon the authorization by the electors
of the issuance of the bonds provided for herein.
Section 2. The County shall acquire property for park
and recreation purposes and shall acquire, construct, install and
make both indoor and outdoor capital improvements to and equip
the same and existing park and recreational facilities (including
but not limited to playgrounds, swimming pools, trail and senior
citizen facilities and community centers) all as found necessary
and desirable by the County Commissioners.
Section 3. For the purpose of providing part or all of
the funds necessary to acquire, construct, make and equip the above -
described capital improvements to the County's park and recreational
facilities, the County shall issue and sell its unlimited tax levy
general obligation bonds in the principal amount of $5,950,000. In
the event the proceeds of sale of said bonds plus any other moneys
available therefor are insufficient to make all of the improvements
hereby authorized, the County shall use the available funds for
paying the cost of those improvements deemed most necessary by the
County Commissioners. '
Section 4. Said bonds may be sold in such amounts and at
such time or times as deemed necessary by the County Commissioners
and as permitted by law, shall bear interest at a rate of not to
exceed the maximum rate permitted by law at the time of sale, shall
mature serially in twenty years from date of issue as provided by
law and shall be paid both principal and interest out of annual
tax levies to be made upon all the taxable property within the
County without limitation as to rate or amount. The exact date,

form, terms and maturities of said bonds shall be hereafter fixed
by resolution or resolutions.
All of the moneys derived from the sale of said bonds,
exclusive of accrued interest, shall be expended solely for the
purposes specified in Section 2 hereof and for the payment of expenses
incidental thereto and to the issuance of the bonds and none of
said moneys shall be used for the replacement of equipment or for
any other than a capital purpose.
Section 5. It is hereby found and declared that an
emergency exists requiring the submission to the qualified electors
of the County of the proposition of whether or not the County shall
issue such bonds for such purposes, at a special election to be
held therein on November 2, 1976 in conjunction with the county and
state general election to be held on said date.
The Whatcom County Auditor, as ex officio supervisor of
elections, is hereby requested to also find the existence of such
emergency, to call and conduct said special election, and to submit
to the qualified electors of the County the proposition hereinafter
set forth.

IN THE MATTER OF A PROPOSITION TO )
ISSUE $5.95 MILLION GENERAL OBLIGA-) RESOLUTION TO SUBMIT
TION BONDS FOR PARKS AND SENIOR ) PROPOSITION AND TO
CITIZEN FACILITIES ) RETAIN BOND COUNSEL
WHEREAS, it is in the public interest, necessary and
advisable that Whatcom County develop recreation facilities
and areas (swimming pools, athletic fields, trails, school
recreation facilities), develop and improve senior citizen
facilities, acquire land and develop parks and community centers;
and,
WHEREAS, to accomplish these purposes, it is proposed
that Whatcom County issue and sell its unlimited tax levy general
obligation bonds in the aggregate principal amount of not to ex-
ceed 5.95 million dollars; and,
WHEREAS, the question of issuance of such bonds must
be submitted tothe qualified electors for ratification or re-
jection as required by the Washington State Constitution and
statutes; and,
WHEREAS, it:is advisable that such proposition be
submitted to the electors at a special election to be held in
conjunction with the state general election on November 2, 1976;
and,
WHEREAS, bond counsel should be retained to draft the
appropriate resolutions, notices, and other appropriate documents
for the authorization, issuance, sale, and delivery of such bonds,
and to issue the necessary bond attorney opinion on the validity
of such bonds and procedures;
NOW, THEREFORE, IT IS RESOLVED that the County Auditor
is authorized and directed to engage Foster and Marshall, Inc.,
financial consultants, and Preston, Thorgrimson, Starin, Ellis &
Holman, bond attorneys for these purposes, and to furnish such
counsel with complete certified copies of all proceedings taken
relative to the issuance of such bonds.
