C. J. Johnson, Chairman of the Board of County Commissioners of said County, and David S. Mc EAchran, Prosecuting Attorney of said County, now meet with Wella Hansen, County Auditor of said County, at the County seat of said County on the 22nd day of November, 1976 for they purpose of canvassing the votes cast in all of the precincts comprising the Port Of Bellingham, Washington, as shown on the Poll Books in Whatcom County, Washington. COUNTY OF WHATCOM } The undersigned, being the officers designated by the law and con- stituting the Canvassing Board in and for Fort of Bellingham, Washington, Whatcom County, having met for the purpose of canvassing the votes con- cerning the following proposition: PORT OF BELLINGHAM PROPOSITION NO. 1 Shall the Port of Bellingham, Washington, for the purpose of acquiring, constructing and installing the first phase of new small boat'--and-'.related facilities at Squalicum Harbor and improvements to and extensions of such facilities at Blaine Harbor, issue its general obligation bonds in the principal amount of $4,000,000 , payable from annual levies of property taxes and maturing in from two to fifteen years from date of issue and increase the aggregate limitation on all port property tax levies from the present rate of $.64204 per $1,000 to $.89204 per $1,000 in accordance with Chapter 84.55 RCW all as more specifically provided in Resolution No. 625 of the Port adopted September 14, 1976? Auditor of Whatcom County !1 Prosecuting Attorney of Whatcom Co, PORT OF BELLINGHAM, WASHINGTON RESOLUTION NO. Z- Zr A RESOLUTION of the Port Commission of the Port of Bellingham, Washington providing for the submission to the qualified voters of the Port District at a special election to be held therein on November 2, 1976 in conjunction with the State general election to be held on the same date, of a proposition authorizing the Port District to issue its general obligation bonds in the aggregate principal amount of $4,000,000 to provide part of the funds necessary to acquire, construct, install and improve small boat harbor facilities at Squalicum and Blaine Harbors and to increase annual property tax pursuant to RCW 84.55.050 to pay such bonds and make such improvements. WHEREAS, it is deemed necessary for the general welfare and benefit of the inhabitants of the Port of Bellingham (the "Port") that the Port provide additional small boat and related facilities and improvements by constructing a new small boat harbor at Squalicum Harbor and by improving and extending the existing small boat facilities at Blaine Harbor; and WHEREAS, in order to provide part of the funds required to acquire, construct and install such facilities and improvements it is necessary that the Port issue its general obligation bonds in the aggregate principal sum of $4,000,000; and WHEREAS, the present tax levy permitted the district by RCW 84.55.010 et sec. is insufficient to provide funds for such improvements and for the payment of the principal of interest on such bonds and it is necessary in order to accomplish the purposes set forth in this resolution that the Port's annual property tax be increased in the manner authorized by RCW 84.55.040; and WHEREAS, the laws of the State of Washington require that the question of whether the Port may issue such bonds and increase such annual property tax levy be submitted to the qualified electors of the Port for their ratification or rejection at a special Port election. NOW, THEREFORE, BE IT RESOLVED BY THE PORT COMMISSION OF THE PORT OF BELLINGHAM, WASHINGTON AS FOLLOWS: Section 1. It is hereby found and declared that it is necessary for the public welfare and benefit of the inhabitants of the Port of Bellingham that the Port proceed with the first phase of plans for acquiring, constructing and installing new small boat facilities'at Squalicum Harbor and improving and extending the small boat facilities at Blaine Harbor. Such improvements shall include but not be limited to construction and renewal of earth retaining bulkheads, dredging, installation and extension of utilities, site improvements and payments for the Port's share of improvements made and installed by the United States Corps -of Army Engineers. Section 2. The Port shall issue its general obligation bonds in the aggregate principal amount of $4,000,000 (the "Bonds"). to.provide part of the funds required to pay the cost of the facilities and improvements set forth in Section 1 together with necessary and proper related facilities, appurtenances, and improvements and the costs of engineering and architectural planning, financial, appraisal, legal and other services which are lawfully incurred incident thereto and to the issuance of the Bonds. Interest earned on and profits derived from the investment of Bond proceeds shall be used for the purposes for which the Bonds are issued. The Bonds shall bear interest at an effective rate not to exceed the maximum rate permitted by law which, except possibly for the first interest payment, shall be payable semiannually. -2- The bonds shall mature as provided by law and the resolution authorizing their sale in from two to fifteen years from their date of issue. The life of the improvements to be acquired, constructed and installed from the proceeds of the Bonds is hereby found and declared to be at least fifteen years. The date, interest rate or rates, denominations, maturities, options of redemption, form and covenants of such bonds shall be as hereafter fixed by resolution of the Port Commission in the manner provided by law. Both principal of and interest on the Bonds shall be payable out of annual tax levies to be made upon all of the taxable property within the Port sufficient to pay such principal and interest as the same shall become due. Section 3. For the purposes provided in Sections 1 and 2 of this resolution the Port shall increase its aggregate property tax levies pursuant to the provisions of RC;-7 84.55.040. For the tax levy year next succeeding the election herein provided &9� 2 v'l for, such increases shall be from the present rate of $.194-2-1 per $1.,000 of assessed valuation of such taxable property to $.-4+ per, $1,000. Section 4. honeys provided for the cost of the improvements herein authorized (except for engineering and other incidental costs) shall be expended only after compliance with applicable State of Washington and United States statutes and regulations, if any, relating to the acquisition, construction and installation of such improvements including but not limited to statutes and regulations relating to comprehensive schemes of harbor improvement, environmental protection and shorelines management. -3- Section 5. The Whatcom County Auditor and ex officio Supervisor of Elections is hereby requested to call and conduct a special Port election on November 2, 1976 in the manner provided by law to be held in conjunction with the State general election_ on the same date between the hours of 7:00 a.m. and 8:00 p.m. for the purpose of submitting to the qualified voters of'the Port for their ratification or rejection a proposition substantially in the following form: PORT OF BELLINGHAM PROPOSITION Shall the Port of Bellingham, Washington, for the purpose of acquiring, constructing and installing the first phase of plans --fir new small boat and related facilities at Squalicum Harbor and improvements to and extensions of such facilities at Blaine Harbor, issue its general obligation bonds in the principal amount of $4,000,000 payable from annual levies of property taxes and maturing in from two to fifteen years from date of issue and increase the aggregate limitation on all pore pZoperty tax levies from the present rate �^ of $ .+94--2-1"iT6r ' $1, 000 to $ .-4-4'Np'e¢ 81 , 000 in accordance with Chapter 84.55 RCV, all as more specifically provided in Resolution No. 1976? �� of the Port adopted September 14, BONDS, YES . . . . . . . . . . . . . / / BONDS, NO . . . . . . . . . . . . . / / Such Port special election shall be noticed and conducted in the manner provided by law. Because the statutes of the State of Washington require that special port elections be held on certain dates and that this resolution be certified to the ex officio Supervisor of Elections of Whatcom County not less than 45 days prior to the election date, it is hereby found and declared that an emergency exists and that said special election shall be held on November 2, 1976. - 4- Section 6. This resolution shall be effective immediately upon its adoption: ADOPTED by the Port Commission of the Port of Bellingham, Washington at a regular meeting thereof held this 14th day of September, 1976 and duly authenticated in open session by the signatures of the commissioners present and voting in favor thereof and the seal of the Commission.
