J. Johnson, Chairman of the Board of County Commissioners of said County, and David S. McEachran, Prosecuting Attorney of said County, now meet with Wella Hansen, County Auditor of said County for the purpose of canvassing the votes cast in all of the precincts comprising the Whatcom County Water District No. 4, as shown on the Poll Books in Whatcom County, Washington. Section 4 of Resolution No. 234 adopted ctio May 25, 1976, is hereby amended to read as follows: It is hereby found and declared that an emergency exists and a special election is hereby called to be held within the District on the 13th day of July, 1976, to submit the proposition hereinafter set forth to the qualified electors of the District. The Auditor of Whatcom County, as Superviser of Elections, is hereby requested also to find the existence of such an·emergency and to call such a special election to be held within the District at such time. The Secretary of the Board of Commis­sioners of the District is hereby authorized and directed to certify and deliver the following proposition to the Auditor of Whatcom County: PROPOSITION NO. 1 Sewer Revenue Bonds, $3,100,000 Shall Water District No. 4, Whatcom County, Washington, issue $3,100,000 sewer revenue bonds payable from revenues and from assessments, if levied, to acquire and co nstruct a treatment plant and trunk lines and, if funds are available, col­lection lines, as provided in Resolution No. 234 of the District? RESOLUTION NO. 234 A RESOLUTION of the Commissioners of Water District No. 4, Whatcom County, Washington, adopting a general comprehensive plan for a system of sewers for the district, declaring the estimated cost thereof, providing the method of financing a portion of the same by the issuance and sale of not to exceed $3,100,000 of sewer revenue bonds; providing for the submission to the qualified electors of the district for their ratification or rejection at a special election to be held thereon on July 13, 1976 of the question of the issuance and sale of said sewer revenue bonds; and repealing Resolution No. 105. WHEREAS, the Board of Commissioners of Water District No. 4, Whatcom County, Washington (the "District") has, as required by law, investigated all portions and sections of the District for the purpose of determining the present and reasonably foreseeable future needs of the District in regard to the collection and disposal of sewage and have examined, investigated, considered and determined a general plan for installing and constructing trunk lines, laterals, pumping stations, force mains, treatment plants and appurtenances for the disposal of sewage and industrial and other liquid wastes now produced or which may reasonably be expected to be produced within the District and for acquiring the lands, easements, permits and rights therefor and have determined the method of distributing the cost and expense thereof against the District and against utility local improvement districts, if formed, within the District for the purposes authorized by law and have determined that the whole of the cost and expense thereof not paid from state or federal grants shall be paid from sewer revenue bonds as provided by law; NOW, THEREFORE, BE IT RESOLVED by the Board of Commis­ sioners of Water District No. 4 as follows: Section 1. The general comprehensive plan for a system of sewage collection 'and treatment facilities for the District, as more particularly set forth in Exhibit A attached hereto and by this reference made a part hereof, be and the same is hereby adopted. The Board of Commissioners shall take such action and do such things as may be proper and necessary in the execution of this general comprehensive plan for the acquisition of such easements, franchises, rights of way, licenses and permits, as may be required and for the acquisition by purchase, condemnation or otherwise or for leasing or renting of such property as may be necessary for the fulfillment of said general comprehensive plan. The Board of Commissioners may make such changes in the items listed as part of the general comprehensive plan where such changes will not substantially alter the general comprehensive plan, such as to make reasonable modifications in locations and sizes of sewer lines, changes in loca�ion and type of sewage disposal facilities, or substitution of methods of sewage disposal, which would, in the opinion of the Commissioners, be in the best interest of the District, and may proceed with the construction and installation of improvements to the sewage system in successive parts or units from time to time as may be advisable and as funds for the same become available. Without limiting the generality of the foregoing, the Board of Commissioners may, if funds are not available for the construction of a permanent sewage treat­ ment facility, construct an interim treatment plant to provide sewer service on a temporary basis for those areas of the District in which such temporary treatment facilities may feasibly be provided. Section 2. The estimated cost to the District of the acquisition, construction, and installation of the improvements of the general comprehensive plan, include general engineering, legal and other incidental expenses, is hereby estimated to be, as near as may be, the sum of $11,100,000, as more particularly shown on Exhibit B atached hereto and incorporated by reference herein. -2- Section 3. For the purpose of providing the necessary funds to acquire, construct and install that portion of the above comprehensive plan described on Exhibit C attached hereto and incorporated by reference herein (hereinafte r referred to as the General Facilities) and, if funds are available after the acquisition, construction and installation of the General Facilities, for collection lines, the District shall issue and sell its sewer revenue bonds from time to time in the total principal sum of $3,100,000 or as much thereof as may be found to be necessary. Such bonds shall bear interest at a rate not to exceed the maximum rate permitted by law at the time of sale, be payable, be issued in such amounts and at such time or times, and have a maturity not to exceed 30 years, all as may be determined by the Board of Commissioners, ·and shall have such date or dates, form, terms, maturities and covenants as may hereafter be fixed from time to time by resolution or resolutions of the Board of Commissioners. Both the principal of and interest on such bonds shall be paid from the revenue of the sewer system of the District and from assessments, if any, levied within the District. ·section 4. It is hereby found and declared that an emergency exists and a special election is hereby called to be held within the District on the 13th day of July, 1976 to submit the proposition hereinafter set forth to the qualified electors of the District. Section 6. Resolution No. 105, adopted May 8, 1969, is hereby repealed.
