ROLL CALL Present: 7 - Barry Buchanan, Tyler Byrd, Todd Donovan, Ben Elenbaas, Kaylee Galloway, Jon Scanlon, and Mark Stremler FLAG SALUTE ANNOUNCEMENTS COUNTY EXECUTIVE'S REPORT Satpal Sidhu, County Executive, reported on the following: • He had meetings in Olympia yesterday and discussed Point Roberts • The progressive design service request for qualifications (RFQ) will be published tomorrow for the Whatcom County justice facility and behavioral health center • Efforts to get more clarity on Lummi Island ferry funding • The change of leadership in the Health Department and temporary staffing resources from the Executive's Office to augment staffing for the Healthy Children's Fund implementation plan • They will be sending mid -biennium budget instructions to the departments this week and asking them to do an exercise to absorb all the payroll increases in 2026 • The continuation of budget prioritization work • They are working on the capital projects priorities and will bring options to the Council soon. Scanlon asked about the Administration being out of compliance with the Charter regarding reporting on the prior quarter budgets. He asked if, after they get the 2024 quarter four report at the next meeting, they will get a 2025 quarter one report in four weeks' time. Sidhu stated he cannot promise that, but they are working hard to bring that into compliance. He spoke about the finance system upgrade transition in the last quarter of 2024 and difficulties with that. AB2025-231 Ordinance adopting amendments to Whatcom County Code Section 1.14, Electoral Precincts, with newly established voting precinct boundaries for Whatcom County Galloway opened the Public Hearing and hearing no one, closed the Public Hearing. Byrd moved and Donovan seconded that the Ordinance Requiring a Public Hearing be ADOPTED. Stacy Henthorn, County Auditor, answered whether it is the districting committee or the Auditor that does this, and stated this is done yearly and is Whafcom County page 2 Printed on 51112025 Council Minutes - Final April 15, 2025 based on annexations. Byrd's motion that the Ordinance Requiring a Public Hearing be ADOPTED carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Galloway, Scanlon, and Stremler Nay: 0 Enactment No: ORD 2025-019 2. AB2025-234 Resolution to declare Whatcom County real property as surplus and approve transfer Galloway opened the Public Hearing and hearing no one, closed the Public Hearing. Donovan moved and Scanlon seconded that the Resolution Requiring a Public Hearing be APPROVED. The motion carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Galloway, Scanlon, and Stremler Nay: 0 Enactment No: RES 2025-014 3. AB2025-246 Ordinance amending Whatcom County Code Title 20 (Zoning) regarding home -based businesses Galloway opened the Public Hearing and hearing no one, closed the Public Hearing. Buchanan moved and Elenbaas seconded that the Ordinance Requiring a Public Hearing be ADOPTED. Elenbaas stated the intent of this language is not to inhibit or shut down any existing businesses. They looked at it as enabling language. He stated if someone finds something that is hindering their ability to run their farm festival which they have run for years, they should get a hold of him so he can help to get it fixed. Buchanan's motion that the Ordinance Requiring a Public Hearing be ADOPTED carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Galloway, Scanlon, and Stremler Nay: 0 Enactment No: ORD 2025-020 4. AB2025-255 Resolution to sell county tax title property by negotiation Galloway opened the Public Hearing and hearing no one, closed the Public Hearing. Steve Oliver, County Treasurer, answered whether this was the same parcel as on agenda item two (AB2025-234), and stated this is a second property in proximity to the first one. He answered a question about how it is being sold and stated they received a letter of interest from the City of Bellingham to acquire this piece of property. He answered how long it took for them to foreclose on the property, and stated they foreclosed on it in the late 1980s or early 1990s. CONSENT AGENDA (From Council Finance and Administrative Services Committee) Donovan reported for the Finance and Administrative Services Committee and moved to approve Consent Agenda items one through 14. Stremler stated he would like to consider Consent Agenda item number 1 (AB2025-283) separately. Donovan amended his motion and moved to approve Consent Agenda items two through 14. Councilmembers voted on those items (see motions and votes below). CLERK'S NOTE for AB2025-288: The dollar amount ($190,000) noted in the agenda item title was entered incorrectly. The contract clearly indicates $180,000 which is consistent with the amount budgeted for that agreement, so the amount in the title should be $180,000. 1. AB2025-283 Request authorization for the County Executive to enter into an interlocal agreement amendment between Whatcom County and Washington State Department of Health to provide funding for various public health services in the amount of $298,592, for a total amended agreement amount of $5,617,278 THIS ITEM WAS CONSIDERED SEPARATELY BELOW. 2. AB2025-284 Request authorization for the County Executive to enter into a contract amendment between Whatcom County and Bennett Engineering to monitor closed landfills in the amount of $10,629, for a total amended contract amount of $157,265 Donovan reported for the Finance and Administrative Services Committee and moved that the Contract be AUTHORIZED BY CONSENT. Stremler stated a member of the public asked that this item be considered separately and asked why a five percent increase is needed four months into the year. The following people spoke: • Kayla Schott-Bresler, Executive's Office • Satpal Sidhu, County Executive • Randy Rydel, Administrative Services Department Finance Director They discussed with councilmembers that this is revenue increase from the State, that $88,000 is from the State and the rest is Federal funding, how the funding works when it is granted to the County, and concerns about the Federal Government pulling back funds that have already been sent. AB2025-221 Discussion and motion relating to draft Countywide Planning Policy amendments Galloway reported for Committee of the Whole and moved that Donovan's proposed changes (in the "Substitute Countywide Planning Policies - Galloway & Donovan" version) and Nooksack Tribe's letter regarding potential changes go to the relevant stakeholders (City/County Planner Group) for feedback, and that Galloway's proposed change to Section I (9) (in blue in the substitute) be sent to the Surface Mining Advisory Committee for their feedback. Councilmembers discussed the motion. AB2025-280 Resolution approving a conditional use permit and development agreement for Ponderosa Estates Mobile Home Park Galloway reported for the Committee of the Whole and moved that the SUBSTITUTE Resolution be APPROVED. Byrd stated it would be nice if they could get a presentation in the future to go over the facts and include the resources. Kim Thulin, Prosecuting Attorney's Office, stated she has advised the Planning Department's counsel, on the Council's behalf, that the Council would like to be able to review the documents and hearing for similar items in the future before making a decision. Galloway stated they are acting in a quasi-judicial manner. AB2025-185 Appointment to a vacancy on the Forest Advisory Committee, commercial forest landowner position, Applicant(s): Robert Janicki Elenbaas moved and Buchanan seconded that the Council Appointment Requiring Introduction be APPOINTED. Councilmembers discussed the motion and that they can consider somebody for the commercial forestry position who resides outside of Whatcom County so long as their land is within Whatcom County. Byrd moved that they waive any requirements, in this case, that a member of the committee live in Whatcom County. The motion was seconded by Buchanan. Elenbaas withdrew his motion to appoint. Kim Thulin, Prosecuting Attorney's Office, stated they may waive the requirement under the updated code provision. Councilmembers discussed that they would be waiving the residency requirement for this particular applicant for this particular position. The motion was seconded by Stremler. Elenbaas amended his motion and moved to revoke Mr. Dill's membership on the Whatcom County Forest Advisory Committee. AB2025-286 Request confirmation of the County Executive's reappointment of Alana Pattersmann to the Whatcom County Housing Authority Board Scanlon moved and Buchanan seconded that the Executive Appointment be CONFIRMED. Councilmembers discussed whether there were any items they felt needed to go back to committee a second time, getting a budget report from Finance at the next meeting, a scrivener's error in A132025-282, and the new process for considering and scheduling introduction items. Councilmembers voted on the introduction items (see votes on individual items below). 1. AB2025-282 Ordinance adopting amendments to Whatcom County Code Chapter 16.24, Commute Trip Reduction, and adopting the 2025-2029 Commute Trip Reduction Plan for Whatcom County Buchanan moved and Donovan seconded that the Ordinance Requiring a Public Hearing be INTRODUCED FOR PUBLIC HEARING.
