ORDINANCE NO. 2025-022
ORDINANCE AMENDING THE PROJECT BASED BUDGET FOR THE NORTH
FORK ROAD/KENNEY CREEK FISH PASSAGE FUND, REQUEST NO. 2
WHEREAS, ordinance 2021-080 established the North Fork Road/Kenney
Creek Fish Passage fund with an initial budget of $425,000 in local funds for work
on preliminary engineering, environmental permitting and real estate acquisition for
the multi -year project; and
WHEREAS, Whatcom County was awarded $2,975,000 in state funding from
the Brian Abbott Fish Barrier Removal Board to fund construction of this project,
with a local cost share from the Road Fund; and
WHEREAS, ordinance 2024-074 amended this project based budget to bring
in an additional $5,075,000 in both state and local funds to complete preliminary
engineering and to fund the construction phase of the project; and
WHEREAS, Whatcom County has been awarded an additional $453,200 in
state funding from the Brian Abbott Fish Barrier Removal Board for the construction
phase of this project bringing the total state funds secured for this project to
$3,428,200; and
WHEREAS, these additional project revenues in state Brian Abbott Fish
Barrier Removal Board funds, which are not included in the current project base
budget, need to be included; and
WHEREAS, this project was competitively advertised for bids in the first
quarter of 2025 and received five (5) bids with the awarded low bid coming in
$484,611 lower than the Engineers Estimate; and
WHEREAS, due to the additional state funds and favorable awarded bid
amount, the local funding portion of the project from the Road Fund can be reduced
by $937,811; and
WHEREAS, this is a multi -year capital project requiring budget approval,

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
Ordinance No 2024-074, is hereby further amended adding additional state funding,
reducing local funding, and reducing expenditure authority as described in Exhibit
A, to the amended project budget total of $5,500,000 for a new total of
$5,015,389.

1a. Description of request:
This project is located on North Fork Road crossing Kenney Creek in Section 22, T39N, R5E of Whatcom
County. This project will replace the existing 5-foot diameter culvert that has been identified as a barrier to
fish passage with a new 115-foot span bridge structure and removal of a poorly functioning fishway. This
project is listed as Item No. B12 on the 2025-2030 Six Year Transportation Improvement Program.
1b. Primary customers:
General public, emergency services and residents of this area of Whatcom County.
2. Problem to be solved:
This project will replace the existing culvert which has been identified as a barrier to fish passage and
poorly functioning fishway with a new bridge structure which will allow for unrestricted fish passage.
Whatcom County has a legal commitment to address fish passage barriers within our existing road
network.
3a. Options /Advantages:

3b. Cost savings:
Transfer $937,811 back to the road fund due in part to a competitive bid being submitted for construction
below the engineer's estimate and additional state funding that has been secured for the project.
