ORDINANCE NO. 2024-074
ORDINANCE AMENDING THE PROJECT BASED BUDGET FOR THE NORTH
FORK ROAD/KENNEY CREEK FISH PASSAGE FUND 391, REQUEST NO. 1
WHEREAS, ordinance 2021-080 established the North Fork Road/Kenney
Creek Fish Passage fund 391 with an initial budget of $425,000 in local funds for
work on preliminary engineering, environmental permitting and real estate
acquisition for the multi -year project; and
WHEREAS, preliminary engineering, environmental permitting, and real
estate work on this project are nearing completion and construction activities are
scheduled to begin in 2025; and
WHEREAS, Whatcom County has been awarded $2,975,000 in state funding
from the Brian Abbott Fish Barrier Removal Board for the construction phase of this
project, with a local cost share from the Road Fund; and
WHEREAS, additional funds are required to fully fund the construction phase
of this project; and
WHEREAS, it is appropriate to include a contingency amount in the project,
knowing that any unused local funds will flow back into the road fund; and
WHEREAS, this is a multi -year capital project requiring budget approval,

1 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
2 Ordinance No. 2021-080, associated with establishing a project based budget for
3 the North Fork Road/Kenney Creek Fish Passage Fund, is hereby further amended
4 adding $5,075,000 of expenditure authority, as described in Exhibit A, to the
5 project budget total of $425,000 for a new total of $5,500,000.
