ORDINANCE NO. 2024-073
ORDINANCE ESTABLISHING THE CENTRAL SHOP UNDERGROUND STORAGE TANK
REMOVAL PROJECT BASED BUDGET
WHEREAS, Whatcom County Public Works owns a previously operational
underground storage tank (UST) is subject to WAC 173-36OA-0110 and the Resource
Conservation and Recovery Act, 42 USC Sec. 6901 et seq; and
WHEREAS, as to be in compliance with WAC 173-360A-0750, Whatcom County
reported a release in February 2020 to the Department of Ecology; and
WHEREAS, the Department of Ecology assigned the Cleanup Site ID #12308 to the
release; and
WHEREAS, as to be in compliance with WAC 173-36OA-0750 Whatcom County is
required to investigate and clean up the site in accordance with WAC 173-340 also
as known as the Model Toxics Control Act (MTCA); and
WHEREAS, to be in compliance with MTCA, Whatcom County shall remove the
underground storage tanks, clean up and remediate contaminated soils near 901
West Smith Road, Bellingham, WA 98226; and
WHEREAS, the Department of Ecology requires the County to achieve these
mandated water quality improvements as soon as feasibly possible; and
WHEREAS, this request includes costs associated with contracted professional
engineering services, county survey and permit assistance, permit fees, county staff
time for project management and the construction contract; and
WHEREAS, all local funding for this request will come from the Road Fund,
Equipment Revolving & Replacement Fund, Flood Fund, Stormwater Fund, REET I
Fund and General Fund; and
WHEREAS, Section 6.80 of the Whatcom County Home Rule Charter allows for
project based capital budget appropriation ordinances that lapse when the project
has been completed or abandoned or when no expenditure or encumbrance has been
made for three (3) years,

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that a new
fund is hereby established, effective immediately, known as the Central Shop
Underground Storage Tank Removal Project Fund. This fund shall be used to account
for the revenues and expenditures related to the project listed above; and
BE IT FURTHER ORDAINED by the Whatcom County Council that the Central Shop
Underground Storage Tank Removal Project Fund is approved with an initial project
budget, as described in Exhibit A, of $2,241,000.
