APPROVING THE REVISED SAMISH WATER DISTRICT
COMPREHENSIVE SEWER PLAN
WHEREAS, the Samish Water District Comprehensive Sewer Plan was prepared in
August 2023 at the request of the Samish Water District Board of Commissioners and in
accordance with the Washington State Department of Ecology (DOE) guidelines as
presented in Washington Administrative Code (WAC) 173-240-50; and
WHEREAS, a determination of non -significance was issued by the Samish Water
District for the Comprehensive Sewer Plan on May 31, 2023, pursuant to the State
Environmental Policy Act; and
WHEREAS, RCW 57.16.010(7) requires that all comprehensive water and sewer
system plans and plan amendments be either approved, conditionally approved, or rejected
by the legislative authority of the county in which the district is located; and
WHEREAS, as required by RCW 57.16.010(7), the Whatcom County Health
Department approved the Samish Water District Comprehensive Sewer Plan on August 31,
2023; and
WHEREAS, as required by RCW 57.16.010(7), Whatcom County Public Works
approved the Samish Water District Comprehensive Sewer Plan on September 5, 2023, with
the following notations:
• The District should coordinate its planned water and sewer system facilities
construction program with the County's planned road construction program.
• All work performed in County public road right-of-way requires a Revocable
Encroachment Permit as a prerequisite.
• Depending on the scope of work of any given District planned water and sewer
system facilities project, the County might require:
o Other permits (e.g., building, conditional use, land disturbance, shoreline)
as a prerequisite to project execution, and
o Stormwater management documentation, with possible consequent
engineered stormwater management system design; and
WHEREAS, a review of the Samish Water District Comprehensive Sewer Plan by the
Whatcom County Planning and Development Services Department resulted in no comments
or concerns;
WHEREAS, on October 10, 2023, the Whatcom County Council approved the Samish
Water District Comprehensive Sewer Plan as amended; and
WHEREAS, in accordance with RCW 57.16.010(7), before becoming effective, the
plan must be approved by any state agency whose approval may be required by law; and
WHEREAS, the Samish Water District submitted the Comprehensive Sewer Plan to
the Washington State Department of Ecology on August 2, 2023 for review and comment;
and
WHEREAS, on September 25, 2024 the Washington State Department of Ecology
conditionally approved the Samish Water District Comprehensive Sewer Plan with the
following modifications and upon the Whatcom County Council's approval of the Plan:

• Added Section 2.1.3 2) District Policy for Privately Owned Grinder Pump
Connections
• Added Section 5.3.4 Estimated Cost Per Service
Exhibit Modifications
• Exhibit ] - Asset Inventory replaced with Estimate of Cost Per LUE
• Exhibit L - Updated to include District Policy for Private Grinder Pump
Connections
• Exhibit M - Washington State and Whatcom County Approvals was renamed from
Exhibit L
WHEREAS, per RCW 57.16.010(7), "before becoming effective, any amendment to,
alteration of, or addition to, a general comprehensive plan shall also be subject to such
approval as if it were a new general comprehensive plan;" and
WHEREAS, the Whatcom County Health Department, the Whatcom County Public
Works Department, and the Whatcom County Planning and Development Services
Department determined that they had no comments or concerns related to the modifications
made by the Washington State Department of Ecology; and
WHEREAS, Whatcom County has reviewed the updated Samish Water District
Comprehensive Sewer Plan for compliance with the approval criteria set forth in RCW
57.16.010(7) and RCW 57.02.040 and finds that the plan satisfies these criteria.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council hereby
approves the revised Samish Water District Comprehensive Sewer Plan (dated August
2024); and
BE IT FINALLY RESOLVED that, by approval of this Resolution, Resolution 2023-
032 is rescinded.
