RESOLUTION NO. 2024-031
(A resolution of the Whatcom County Flood Control Zone District Board of Supervisors)
AMENDMENT NO. 4 OF THE 2024 BUDGET
WHEREAS, the 2024 budget for the Whatcom County Flood Control Zone District and
Subzones was adopted November 21, 2023, with Resolution 2023-047; and,
WHEREAS, the District was initially awarded USEPA Natural Estuary Program grant funds of
$564,477 in 2024 to expedite the WRIA fish passage barrier remediation; and
WHEREAS, the District entered into a Memorandom of Agreement with other WRIA
partners, such as the Lummi and Nooksack tribes, and Washington Department of Fish &
Wildlife, in the Puget Sound region in order to complete the pre -design of five fish passage
barriers by December 2025,
WHEREAS, the District has been awarded Washington State Recreation and Conservation
Office grant funds of $207,000 through the Brian Abbott Fish Barrier Removal Board to the
WRIA fish passage barrier remediation in order to complete construction design work for five
culverts in the Black Slough area of the South Fork Nooksack watershed; and
WHEREAS, the District will fund the $40,500 local match requirement for the grant utilizing a
portion of the previously awarded USEPA Natural Estuary Program grant funds and locally
funded staff hours; and
WHEREAS, the modifications to the budget have been assembled here for deliberation by
the Board of Supervisors,
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Flood Control Zone
District Board of Supervisors that the 2024 budget, as approved in Resolution 2023-047, is
hereby amended, adding the following amounts to the budgets presented below and further
described in Exhibit A of this resolution:

1a. Description of request:
Whatcom County Flood Control Zone District (FCZD) has been awarded a grant to complete construction
ready designs and cost estimates for five culverts in the Black Slough area of the South Fork Nooksack
watershed. This work will be coordinated with the Habitat Strategic Initiative Lead (HSIL) grant previously
awarded to the County to expedite Whatcom County fish passage barrier remediation. This budget
amendment will provide authority to implement this grant agreement.
1b. Primary customers:
Public Works Bridge and Hydraulics Division, Nooksack Indian Tribe, Lummi Nation, Washington State
Department of Fish and Wildlife (WDFW), neighbors and other community members including
recreational and commercial fishers.
2. Problem to be solved:
The WRIA1 Salmonid Recovery Plan guides recovery of ESA listed chinook salmon, steelhead, bull trout,
and other salmonid species in the Nooksack River and adjacent coastal streams. One component of the
plan is correcting fish passage barriers that block access to tributary, floodplain, and estuary habitats.
Whatcom County entered into a Memorandum of Agreement with Lummi Nation, Nooksack Indian Tribe,
and WDFW in July 2023 stipulating how the county will correct these barriers. In response, Whatcom
County created a fish passage group in Public Works to expedite this work. The FCZD has been awarded
a grant to complete construction designs and cost estimates for five county -owned culverts in the Black
Slough drainage.
3a. Options / Advantages:
This grant agreement provides funding to complete design work for Black Slough culverts with a $40,500
match requirement. The HSIL grant and locally funded staff hours will meet match requirements.
3b. Cost savings:
This grant agreement provides $207,000 in funding to complete design work for Black Slough culverts
with a $40,500 match requirement. The HSIL grant and locally funded staff hours will meet match
requirements.
4a. Outcomes:
Whatcom County Public Works will contract with a consultant to prepare construction ready designs and
cost estimates for 5 culvert replacements in the Black Slough drainage.
4b. Measures:
The designs and cost estimates will be completed and submitted to the granting agency.
5a. Other Departments/Agencies:
County staff will seek technical review from Lummi Nation, Nooksack Indian Tribe, and WDFW.
