7 CLOSING THE SOUTH FORK PARK IMPROVEMENT FUND 363

9 WHEREAS, on November 25t", 2014 Ordinance 2014-079 created the South Fork
10 Park Improvement Fund and funded the project; and,
11
12 WHEREAS, the Real Estate Excise Tax (REET) II fund 324 contributed $393,100
13 towards the project; and,
14
15 WHEREAS, the Parks Improvement fund 330 contributed $85,900 towards the
16 project; and,
17
18 WHEREAS, the project has not incurred any expenditures since 2020; and,
19
20 WHEREAS, section 6.8 of the Whatcom County Home Rule Charter allows for
21 project -based capital budget appropriation ordinances that lapse when the project has been
22 completed for abandoned or when no expenditure or encumbrance has been made for three
23 (3) years; and,
24
25 WHEREAS, the project fund is no longer needed; and,
26
27 WHEREAS, the current cash balance in the fund is approximately $32,382.95; and,
28
29 WHEREAS, remaining cash in the fund should be returned to the REET II fund in the
30 amount of $32,382.95; and,

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
South Fork Park Improvement Fund be dissolved and its remaining cash balance be
returned to the REET II fund.
