ORDINANCE NO. 2024-013
AMENDING WHATCOM COUNTY CODE CHAPTER 2.145 TO CLARIFY MEMBER
REQUIREMENTS ON THE WHATCOM COUNTY FERRY ADVISORY COMMITTEE
WHEREAS, the Whatcom County Council adopted Ordinance 2023-057 in October
2023 to restructure the Lummi Island Ferry Advisory Committee into the Whatcom County
Ferry Advisory Committee; and
WHEREAS, the County Council intended for four of the positions on the advisory
group to be held by individuals who do not live on Lummi Island; and
WHEREAS, the previous Code restricted the off -island members from owning
property on the island, which was not included in the new Code language; and
WHEREAS, the language in Ordinance 2023-057 could be misinterpreted to allow
appointment of only 2 members who do not live on the island; and
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council to amend
Whatcom Courtt�Atba'6'68 ,tjon 2.145.040 as shown
in Exhibit A.

A. The committee shall consist of nine voting members.
1. Five members who live on the island,
2. Four members who do not live or own property on Lummi Island, with priority given
to one Lummi Nation representative when possible:
a. Two members who live in unincorporated Whatcom County, not including
Lummi Island
b. Two members who live anywhere in Whatcom County except Lummi Island
3. One County Councilmember will be an ad hoc non -voting member
B. The county council shall appoint the committee members. Member terms will be three
years; provided, that the terms of members first appointed will be staggered so that three
of the committee members shall be appointed for two years. Members of the committee
shall serve without compensation. (Ord. 2023-057 Exh. A; Ord. 2012-005 Exh. A).
