Council Minutes - Final November 8, 2023 COUNTY COUNCIL CALL TO ORDER Council Chair Barry Buchanan called the meeting to order at 6:02 p.m. in a hybrid meeting. MINUTES CONSENT Byrd moved to accept the minutes consent items. The motion was seconded by Frazey (see votes on individual items below). 1. MIN2023-070 Committee of the Whole for October 24, 2023 Byrd moved and Frazey seconded that the Minutes Consent be APPROVED BY CONSENT. The motion carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Frazey, Galloway, and Kershner Nay: 0 2. 1V IN2023-0.71 Regular County Council for October 24, 2023 Byrd moved and Frazey seconded that the Minutes Consent be APPROVED BY CONSENT. The motion carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Frazey, Galloway, and Kershner Nay: 0 INTRODUCTION ITEMS Tyler Schroeder, Director of Administrative Services, briefed the Councilmembers on the introduction items, and the rules in the Whatcom County Code and Charter for when a public hearing should be held on a mid -biennium budget ordinance. Since it states it should be in November, he recommends they introduce the ordinances and hold a hearing on November 21, 2023, and then Council can make a decision about postponing action until the meeting in December. Donovan moved to introduce items one through fifteen. The motion was seconded by Kershner. Galloway stated she would like to flag that there is a substitute ordinance that she has proposed for Introduction item number four (AB2023-714) and asked about the process for introducing both versions. Clerk's note: They added that item as a sixteenth item under Introduction, and after the meeting, it was assigned a unique file number (AB2023-760). Kershner moved and Frazey seconded that Galloway's substitute ordinance be added to the list of introduction items. CONSENT AGENDA (From Council Finance and Administrative Services Committee) Kershner reported for the Finance and Administrative Services Committee and moved to approve Consent Agenda items one through eleven. Byrd requested that they vote on Consent Agenda items three, ten, and eleven separately. Dana Brown -Davis, Clerk of the Council, stated that Introduction Item number fifteen (AB2023-279) was a substitute. Clerk's note: Councilmembers took a short break before they voted on the consent items. Councilmembers voted on Consent Agenda item numbers 1 and 2, and 4 through 9 (see votes on individual items below). 1. AB2023-678 Request authorization for the County Executive to enter into an interlocal agreement amendment between Whatcom County and the City of Bellingham to increase the subscriber fees by $1,260 for use of the City radio system, for a total amended annual contract amount of $6,300 Kershner reported for the Finance and Administrative Services Committee and moved that the Interlocal be AUTHORIZED BY CONSENT. AB2023-695 Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County and City of Bellingham for funding to support ongoing maintenance and operations at the County's crisis stabilization center, in the amount of $65,000 Kershner reported for the Finance and Administrative Services Committee and moved that the Interlocal be AUTHORIZED BY CONSENT. Councilmembers discussed that this is the same contract they had last year and that this amendment adds another year. AB2023-690. Appointment of one councilmember to serve as liaison for the Climate Vulnerability Assessment (CVA) Project Galloway reported for the Climate Action and Natural resources Committee and stated there was not a recommendation from the committee. Elenbaas nominated himself and spoke about why. Frazey nominated Galloway. Councilmembers discussed the time commitment. Elenbaas was appointed by the following vote: Elenbaas: 5 - Buchanan, Byrd, Donovan, Elenbaas, and Kershner Galloway: 2 - Frazey and Galloway This agenda item was APPOINTED. Appointed Elenbaas with five votes. COUNCIL APPOINTMENTS TO BOARDS, COMMISSIONS, AND COMMITTEES 1. AP2023-679 Appointments to fill vacancies on the Whatcom County Ferry Advisory Committee - Applicants: Janice Catrell, Pamela Gould, David Hamiter, Diane Harper, Janice Holmes, Carol Landt, Fabian Mendoza, Thomas Philpot, Catherine Shornick, Merritt Scott, and Tess Winds-Johnsons Jill Nixon, Council Office Staff, explained the process for voting. She stated it was suggested by a speaker during open session (Bob Anderson) that they also appoint a fourth islander position beginning in February of 2024 to replace the position that Jim Dickenson would be vacating so that is the first question for Council. Buchanan moved that they fill James Dickenson's position (a fourth position) beginning in February of 2024 (when it becomes vacant). Councilmembers discussed the motion, whether applicants may not have applied at this time thinking they could apply in January, and that having three vacant positions adequately shows the need for people to apply. Buchanan's motion carried by the following vote: Aye: 5 - Buchanan, Byrd, Donovan, Galloway, and Kershner Whatcom County Page 11 Printed on 1112212023 Council Minutes - Final November 8, 2023 Nay: 2 - Elenbaas and Frazey Nixon stated one of three islander vacancies (Position 3) is a partial term that expires in January 2024 and an idea was suggested to appoint someone to complete that partial term and then also fill the subsequent full term starting February 1 st of 2024. Councilmembers and staff discussed the options. Dana Brown -Davis, Clerk of the Council, and Nixon answered whether appointing the applicants and appointing the specific positions should be a separate vote. Donovan moved to have all of the applicants for the four island positions (Pamela Gould, David Hamiter, Diane Harper, Janice Holmes, Thomas Philpot, Catherine Shornick, and Tess Winds -Johnson) considered for nomination. The motion was seconded by Frazey (this motion was not voted on but Councilmembers considered all the applicants in their appointment). The following applicants addressed the Council: • Pamela Gould • Thomas Philpot • Catherine Shornick • Diane Harper • Tess Winds -Johnson Elenbaas asked Winds -Johnson when she graduated from Western Washington University. Councilmembers cast their votes for the applicants and Pamela Gould (6 votes), Thomas Philpot (6 votes), Catherine Shornick (6 votes), and Diane Harper (5 votes) were appointed as follows: Buchanan: Gould, Harper, Shornick, and Philpot Byrd: Hamiter, Harper, Holmes, and Johnson Donovan: Gould, Shornick, Harper, and Philpot Frazey: Gould, Philpot, Shornick, and Johnson Galloway: Gould, Harper, Philpot, and Shornick Kershner: Shornick, Harper, Philpot, and Gould Elenbaas: Johnson, Gould, Shornick, and Philpot Buchanan stated the next step is to assign the islanders to specific "Otcom County Page 12 Primed on 1112212023 Council Minutes - Final November 8, 2023 positions. Byrd moved and Kershner seconded to assign the appointees to terms alphabetically as follows: • Position 1: Pamela Gould • Position 2: Diane Harper • Position 3: Thomas Philpot • Position 4: Catherine Shornick Byrd's motion carried by the following vote: Aye: 7 - Buchanan, Byrd, Donovan, Elenbaas, Frazey, Galloway, and Kershner Nay: 0 Councilmembers considered the off -island positions. Donovan moved and Frazey seconded to nominate both candidates (Janice Catrell and Merritt Scott) for Position 6. Janice Catrell was appointed with seven votes as follows: Byrd: Catrell Donovan: Catrell Elenbaas: Catrell Frazey: Catrell Galloway: Catrell Kershner: Catrell Buchanan: Catrell Councilmembers considered the two applicants (Carol Landt and Fabian Mendoza) for Positions 8 and 9. Byrd moved and Kershner seconded to appoint both applicants. Byrd's motion carried by the following vote: Aye: 7 - Donovan, Elenbaas, Frazey, Galloway, Kershner, Buchanan, and Byrd Nay: 0 Byrd moved to extend Position 3 (Philpot) for an additional full term. The motion was seconded by Galloway. Councilmembers discussed the motion, who was in Position 3, whether the group is diverse, and what will happen if they do not approve this motion. Motion approved 5-2, with Elenbaas and Frazey opposed, to fill James Dickenson's position beginning in February of 2024 (a fourth position). Appointed the following Islanders plus a fourth position (James Dickenson's position): Pamela Gould (6 votes), Thomas Philpot (6 votes), Catherine Shornick (6 votes) and Diane Harper (5 votes). Motion approved 6-1, with Elenbaas opposed, to extend Position 3 (Philpot) for an additional full term. 2. AB2023-6686 Appointment to fill a vacancy on the Forest Advisory Committee, Applicant(s): Herbert Barker, Richard Donahue, Tracy Petroske, Tom Smith, Paul Stuart Donovan moved to nominate or consider all the applicants. The motion was seconded by Galloway.
