HISTORY OF LEGISLATIVE FILE Date: Acting Body: Action: Sent To: 09/26/2023 Council INTRODUCED FOR PUBLIC Council HEARING Aye: 7 Buchanan, Byrd, Donovan, Elenbaas, Frazey, Galloway, and Kershner Whatcom County Page 1 Printed on 1012512023 Agenda Bill Report Continued (AB2023-622) Nay: 0 10/24/2023 Council APPROVED Aye: 7 Buchanan, Byrd, Donovan, Elenbaas, Frazey, Galloway, and Kershner Nay: 0 Attachments: Proposed Resolution, Parcel Information Whatcom County Page 2 Printed on 1012512023 PROPOSED BY: Treasurer INTRODUCTION DATE: 9/26/2023 RESOLUTION NO. 2023 - 035 RESOLUTION TO SELL TAX TITLE PROPERTY BY PUBLIC AUCTION 1 WHEREAS, RCW 36.35.120 allows the County to sell real estate acquired by tax 2 foreclosure where it is found to be in the best interest of Whatcom County to sell the 3 same; and, 4 5 WHEREAS, the County has owned tax title parcel # 370406 028466 0000 6 (herein "Property"), further described below, since November 20, 2015; and, 8 WHEREAS, the Whatcom County Property Management Committee 9 recommends that the resolution be passed to effectively meet the legal requirement for io the disposal; and, 11 12 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price 13 for said unit of property and to determine whether or not a contract will be allowed, or if 14 it will be a cash price; and, 15 16 WHEREAS, the Whatcom County Property Management Committee 17 recommends that the Property be offered for sale by public auction for a price not less 18 than the accumulated taxes, interest, penalty, and costs; and, 19 20 WHEREAS, the accumulated taxes, interest, penalty, and costs total $2,630.14; 21 and, 22 23 WHEREAS, the Whatcom County Code as well as the state law allows the 24 County to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or 25 other resources if the Council finds that it is in the best interest to reserve these; 26 27 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the 28 County to sell the Property described herein by public auction, to the highest and best 29 bidder, for a price not less than the accumulated taxes, interest, penalty, and costs 30 totaling $2,630.14: 31 32 Parcel # 370406 028466 0000 / PID 29083 33 34 LOT 85, PLAT OF SUDDEN VALLEY, DIVISION NO. 22, ACCORDING TO THE 35 PLAT THEREOF, RECORDED IN VOLUME 11 OF PLATS, PAGES 57 36 THROUGH 60, INCLUSIVE, RECORDS OF WHATCOM COUNTY, 37 WASHINGTON. SITUATE IN WHATCOM COUNTY, WASHINGTON. 39 40 BE IT FURTHER RESOLVED that said price shall not be allowed under contract 41 and shall be paid in either cash, certified check, or money order to the Whatcom 42 County Treasurer at the time of sale; and, 43 44 BE IT FURTHER RESOLVED that said parcels shall be sold subject to restrictive 45 covenants allowing for imposition of Community Association fees, if any, as set forth in 46 Whatcom County Resolution No. 88-37; and, 47 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil, 48 gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the 49 right to mine for and remove the same in conformity with zoning regulations in force and 5o effect; and, 51 52 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby 53 authorized and directed to sell such property at not less than a certified price and said 54 sale shall take place in accordance with the duties as established in RCW 36.35.120; 55 and, 56 57 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public 58 hearing on the matter of the sale of said property, under said terms, be held on the 59 24th day of October , 2023, at 6:00 p.m., at 311 Grand Ave, Bellingham 60 Whatcom County, Washington; and, 61 62 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council 63 shall give notice of such hearing in the manner prescribed by law under RCW 64 36.34.030. 65 66 67 APPROVE[�t�ai�c�# o day of October 2023.
