7 APPROVING THE SAMISH WATER DISTRICT
8 COMPREHENSIVE SEWER PLAN UPDATE

11 WHEREAS, the Samish Water District Comprehensive Sewer Plan was prepared in
12 May 2023 at the request of the Samish Water District Board of Commissioners and in
13 accordance with the Washington State Department of Ecology (DOE) guidelines as
14 presented in Washington Administrative Code MAC) 173-240-50.; and
15
16 WHEREAS, a determination of non -significance was issued by the Samish Water
17 District for the Comprehensive Sewer Plan on May 31, 2023, pursuant to the State
18 Environmental Policy Act; and
19
20 WHEREAS, RCW 57.I.6.010(7) requires that all comprehensive water and sewer
21 system plans and plan amendments be either approved, conditionally approved, or rejected
22 by the legislative authority of the county in which the district is located: and
23
24 WHEREAS, as required by RCW 57.16.010(7)_, the Whatcom County Health
25 Department approved the Comprehensive Sewer Plan on August 31, 2023; and
26
27 WHEREAS, as required by RCW 57i6.010 _ A, Whatcom County Public Works
28 approved the Comprehensive Sewer Plan on September 5, 2023, with the following
29 notations:
30 - The District should coordinate its planned water and sewer system facilities
31 construction program with the County's planned road construction program.
32 - All work performed in County public road right-of-way requires a Revocable
33 Encroachment Permit as a prerequisite.
34 - Depending on the scope of work of any given District planned water and sewer
35 system facilities project, the County might require:
36 o Other permits (e.g., building, conditional use, land disturbance, shoreline)
37 as a prerequisite to. project execution, and
38 o Stormwater management documentation, with possible consequent
39 engineered stormwater management system design; and
40
41 WHEREAS, a review of the Samish Water District's Comprehensive Sewer Plan by
42 the Whatcom County Planning and Development Services Department resulted in no
43 comments or concerns; and
44
45 WHEREAS, in accordance with RCW 57.16.010 7 , before becoming effective, the
46 plan shall be approved by any state agency whose approval may be required by law; and
47
48 WHEREAS, the Samish Water District submitted the Comprehensive Sewer Plan to
49 the Washington State Department of Ecology on August 2, 2023 for review and comment;
50 and
51
1 WHEREAS, according to RCW 57.16.160, the appropriate state agency has 90 days
2 to review and either approve, conditionally approve, reject, or request amendments; and
3
4 WHEREAS, Whatcom County has reviewed the Samish Water District
5 Comprehensive Sewer Plan for compliance with the approval criteria set forth in RCW
6 57.16.010(71 and RCW 57.02.040 and finds that the plan satisfies these criteria.

NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council hereby
approves the Samish Water District Comprehensive Sewer Plan (dated May 2023) as
presented.
