Committee member Carol Frazey called the meeting to order at 11:16 a.m.
in a hybrid meeting.

Announcements
Council "Consent Agenda" Items
Donovan moved to approve Consent Agenda items one through eleven.
Councilmembers voted on the Consent items (see votes on individual items
below).
1. P B202:3--4 53 Request authorization for the County Executive to enter into an interlocal agreement
between Whatcom County and Washington State Department of Ecology for
technical assistance and education outreach to small businesses, in the amount of
$275,075
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following
vote:
Aye: 3 - Donovan, Frazey, and Kershner
Nay: 0
2. AB2_023-454 Request authorization for the County Executive to enter into an interlocal agreement
amendment between Whatcom County and U.S. Department of Justice Organized
Crime Drug Enforcement Task Force (OCDETF) for continuing an OCDETF
investigation, in the amount of $14,000, for a total amount of $16,500
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following
vote:

3. AB2023-458.. Request authorization for the County Executive to enter into an interlocal agreement
between Whatcom County and the City of Bellingham for Aquatic Invasive Species
(AIS) enforcement patrols on Lake Whatcom and Lake Samish, in the amount of
$20,000.00

AUTHORIZATION BY CONSENT. The motion carried by the following

4. AB2023_459 Request approval for the County Executive to award Bid #23-50, Rental Rates for
Maintenance and Construction Equipment Without Operator, to all bidders with the
award for each vendor not to exceed $100,000.00

AUTHORIZATION BY CONSENT. The motion carried by the following
vote:

5. AB 023-460 Request authorization for the County Executive to enter into an interlocal agreement
amendment between Whatcom County and Washington State Department of Health
to deliver various public health services in the amount of $3,197,322 for a total
amended agreement amount of $12,178,417
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following
vote:

6. AB2023- 62 Request authorization for the County Executive to enter into an interlocal agreement
between Whatcom County and Washington State Department of Children, Youth and
Families for reimbursement for work performed related to the Juvenile Detention
Alternative Initiative (JDAI) in the amount of $28,000 per year for a total of $56,000
over 2 years
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following

7. A 2023-463 Request authorization for the County Executive to enter into an Interlocal agreement
between Whatcom County and Washington State Department of Children, Youth and
Families for reimbursement of services relating to programming for juvenile offenders

under the supervision of Juvenile Court, with reimbursement to continue at the
SFY2022-2023 rate in Whatcom County Contract No. 202106029 until the State
has determined the SFY 2024-2025 rates
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following

8. AB2023- 464 Request authorization for the County Executive to enter into an Interlocal agreement
between Whatcom County and The Administrative Office of the Court for
reimbursement for costs related to resentencing and vacating convictions for those
individuals affected by the Blake Decision in the maximum reimbursement amount of
$837,967
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following
vote:

9. AB2023•-467, Request authorization for the County Executive to enter into an Interlocal agreement
between Whatcom County and Washington State Health Care Authority for the
coordination and implementation of prevention programs and strategies, in the amount
of $260,000 annually with a not to exceed amount of $1,320,000
Donovan moved that the Interlocal be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following

10. AB2023-468 Request authorization for the County Executive to enter into a subrecipient agreement
between Whatcom County and the Whatcom Conservation District to complete
components of a National Estuary Program (NEP) funded grant scope of work
including data coordination, technical assistance and outreach, in the amount of
$773,332 (Council acting as the Whatcom County Flood Control Zone District
Board of Supervisors)
Donovan moved that the Contract (FCZDBS) be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following

11. A132023--476 Request authorization for the County Executive to enter into a lease between
July 25, 2023
Whatcom County and Lengosot LLC to provide temporary space to perform
autopsies in the amount of a base rent of $250 per autopsy and an additional $50
transportation cost per trip
Donovan moved that the Contract be RECOMMENDED FOR
AUTHORIZATION BY CONSENT. The motion carried by the following

Committee Discussion and Recommendation to Council
1. B2021-448 Ordinance Establishing the Central Shop NPDES Stormwater Improvements Project
Based Budget
Kershner moved that the Ordinance be RECOMMENDED FOR
ADOPTION.
Loni Patterson, Public Works Department, answered whether this is just for
the shop facility and stated it is, and it is to evaluate and design
improvements that need to be done to comply with our stormwater permit.
She answered whether there is an issue with other county facilities, what
about the Central Shop triggered us needing a National Pollution Discharge
Elimination System (NPDES) permit, and what the correction will be.
Patterson stated the facility is an industrial facility so it needs an industrial
stormwater general permit, which requires them to comply with the NPDES
standards.
Kraig Olason, Public Works Department, answered whether someone will
have to spend $200,000 to design their stormwater systems if they have a
similarly sized industrial facility, whether the cost is also for other
housekeeping and not just for project design, whether it is just due to being
a low-lying piece of property and not to having different standards because
it is a government facility, what elements we are failing at, what triggered
this change and how long we have been out of compliance, and whether the
Central Shop will be upgraded or the water table raised when we do the
Northwest Annex project.
Tyler Schroeder, Director of Administrative Services, stated the Northwest

Annex project itself has been going through stormwater designs but it is
separate from this project.
Elizabeth Kosa, Public Works Department Director, confirmed that they
are separate.
Kershner stated she had a tour of the site about a year and a half ago and it
was explained at that time that this was a problem and Council would be
seeing it on an agenda.
Kershner's motion that the Ordinance be RECOMMENDED FOR
ADOPTION carried by the following vote:

2. AB2023-451, Ordinance amending the 2023 Whatcom County Budget, request no. 10, in the
amount of 1,493,534
Donovan moved that the Ordinance be RECOMMENDED FOR
ADOPTION. The motion carried by the following vote:
